TheComplainantstatesthatthefollowingfactsestablishprobablecause:

OnSeptember6,2017,around1:00a.m.,KevinRudolphScaia,dob05/07/1967,hereinafterDefendant,
wasattheTTDomeBarlocatedintheCityofChisholm,St.LouisCounty,Minnesota.Videosurveillance
depictstheDefendantapproachingtwofemalesseatedatthebar,theVictimandherfriend.Thetwo
womenwereseatednexttooneanother.TheDefendantgetsupfromhisbarstoolandapproachesthe
Victimandherfriend.AsheismovingfromtheVictim'sleftsidetostandingdirectlybehindher,the
Defendantreachesbothofhishandsaroundher,includingunderneathherleftarm,andsqueezesbothof
herbreasts,oneineachofhishands.TheVictimisobservedimmediatelystrikingtheDefendant'shand
awayfromherusingherhands.TheDefendantisthenobservedstandingbehindthewomen,placinghis
armsaroundeachofthem.TheVictimtoldtheDefendantto"knockitoff"andleaveheralone,towhichthe
Defendantresponded"Ohcomeon[Victim'sname]."

Inv.MarkSteeloftheSt.LouisCountySheriff'sOfficeinterviewedtheDefendant,whodeniedsexually
assaultingtheVictimandbegantospeakpoorlyofher.TheDefendantthensaidhemayhavehuggedthe
Victim"facetoface"aftertheywerealloutsidesmoking.Whenconfrontedwiththecontentsofthevideo
surveillancefrominsideofthebarbyInv.Steel,theDefendantsaidhe"didn'tmeananythingbyitanditwas
justsomethingIdid."TheDefendantopinedtoInv.Steelhe"isapoliticaltargetandbelievessomebody
withinthecityisbehindtheallegation."
