Legal and Ethical considerations, codes of practice and regulations

Design and Patients Act

The year the copyright designs and patients act was first established was in 1988. once a film
is registered it is protected for 70 years after the authors death, but in most countries, it
could be longer, there are 3 types of work covered by the act these are literary, design and
musical. It is not ok to use anyone elses work even if you are not making money of it
because you are still using somebody elses work that isnt yours, however You can copy the
name or title of someones work but you cant copy the content in the work because that is
stealing somebody elses work. The difference between copyrights and patents is the type of
property they protect. Copyrights and patents are legal designations granted to intellectual
property holders, designed to protect such property from being copied, sold or used in any
way without owner authorization. It makes no difference how the work is stored; the rule
still applies so you cant use someone elses work on the internet. Some people believe that
you can use 10% of work legally without it being infringement, however this is not the case,
unless it is allowed under fair use dealing rules, any unauthorised use of copyright can
potentially lead to legal action. The legalities that you should be aware of are that a sound
recording will have a separate copyright to the underlying musical composition. What this
means is that a new recording of an old piece of music will still be protected under
copyright, even if the copyright on that piece of music has expired in the original music.
Finally, some people believe that it is hard to prove copyright infringement, however this is
not the case, copyright law is principally civil not criminal law, Civil law requires a lower
burden of proof, making it easier to prove infringement.

Ethical Considerations

The ethical considerations that Gap Travel should be aware of is the confidentiality of
information. This means keeping a clients information between you and the client, and not
telling others including co-workers, friends and family. An example of this would be
maintaining confidentiality such as including individual files that are locked and secured.
Also in Gap Travel I will not use any information that will be considered private or personal
to the user because I could get prosecuted for using this sort of information because I dont
own it which makes this illegal. For example, in my product, I will use my own information so
I dont have this issue, and I can make it more appealing to the target audience. Gap Travel
also needs to be aware of decency and liberal laws, for example I will not use any
inappropriate images that could offend or upset individuals, because Gap Travel needs to
maintain and keep a professional appearance. I will not be using any liberal or verbal untrue
information because this might offend individuals, all the information that I will write down
will all be true.

Representation

Gap Travel needs to be aware on how they are representing Race, Gender, Religion and
Sexuality. Gap Travel must not be bias towards different races and religions. For example,
my product must show a variety of images towards different races (White, Black etc.) Also I

must show images of different religions (Hindu, Judaism, Christianity etc.) Furthermore, I
must show male and females in my product so it isnt bias towards different genders. Finally,
I must not show a different opinion towards different sexualities for example gays. The
reason I must do this is so I dont offend anyone in any way at all.

Codes of practice regulations

The codes of practice and regulations that Gap Travel need to be aware of is the Advertising
and standards law. This is the self- regulatory organisation of the advertising industry in the
United Kingdom. Its code of advertising practice broadly reflects on the legalisation in many
instances.
The British Interactive Media Association is an industry that represents a digital industry in
the United Kingdom.
