SIDE LETTER TO THE PROTOCOL OF PROVISIONAL ACCEPTANCE IN FRANCE FOR THE SHIP, ON BOARD SPARE PARTS, TOOLS AND DOCUMENTATION DATED 17 OCTOBER 2015 Ref. Contract Number: TRAK/810/PLN/VIII/2012/AL between Ministry of Defence of the Republic of Indonesia with OCEA S.A. France dated 1 August 2012 We, hereby acknowledge that even though the Provisional Acceptance Protocol for Ship No.2 has been signed by both Parties on 17 October 2015, OCEA still has to fulfill its obligations according to the Contract until ship No.2 (KRI Spica-934) leaving France. The obligations (including works, sea acceptance tests/trial, Integrated Logistic ‘Support which are not finished yet) are as follows: Life firing test 20mm canon Coring equipment (to reach 1000m depth if weather permit) CTD equipment (to reach 1000m depth if weather permit) ROV equipment (to reach 1000m depth if weather permit) UHF Communication Documentation Load the Spare Parts and Tools on board vessel Other works which are mentioned in the Minutes of Meetings and Satgas input, as follows: a. MoMof Military Worthiness Team dated 2 October 2015 b. MoM of Commodore Inspection Team dated 8 October 2015 c. MoMs and Input of MoD Delegates (Satgas) dated 15 October 2015 (Copy of the list with the outstanding items is attached) PNOVEREN> In this regards, OCEA will be responsible to arrange the permit/clearance from French Authority to do the sea testitrial for some scientific equipment and 20mm sea firing, This side letter is meant as goodwill to avoid any misunderstanding during the process of OSV Procurement.
