PASAL II
JANGKA WAKTU
PIHAK KEDUA menerima dan sanggup

waktu tersebut berakhir, apabila PIHAK
PERTAMA tidak puas dengan kinerja PIHAK

PERTAMA merasa puas dengan mutu / hasil
kegiatan PIHAK KEDUA, dimana untuk kedua hal
tersebut dengan pemberitahuan sekurang-
kurangnya 7 (tujuh) hari sebelumnya.
Waktu penyelesaian sebagaimana dimaksud
diatas, tidak dapat diubah oleh PIHAK KEDUA,
kecuali adanya keadaan memaksa sebagaimana
telah diatur dalam Kesepakatan ini.
Dan apabila ternyata pekegiatan atas permintaan
sendiri meminta pulang sebelum tanggal
berakhir yang di setujui dan masih ada yang
belom di selesaikan maka PIHAK PERTAMA tidak
akan bertanggung jawab atas seluruh biaya
pemulangan ke daerah asal.
PASAL III
PROGRAM DAN HUBUNGAN
1. PIHAK PERTAMA memberi program yang 1.

tidak lengkap APD (Alat Pelindung Diri)), maka
tidak ada bentuk kompensasi apapun yang
diberikan oleh PIHAK PERTAMA.

PASAL VII
FASILITAS KEGIATAN
1. PIHAK KEDUA akan menerima pinjaman
peralatan dari PIHAK PERTAMA, selanjutnya
PIHAK KEDUA menerima dan bertanggung
jawab penuh terhadap barang inventaris
peralatan tersebut.
2. PIHAK PERTAMA meminjamkan Radio HT,
total station, dan alat alat pendukung
lainnya kepada PIHAK KEDUA sebagai
sarana.
3. PIHAK KEDUA menerima dan menggunakan
inventaris yang diberikan PIHAK PERTAMA
sesuai dengan ketentuan dan peruntukan
yang sudah ditentukan dan diberikan.
4. Apabila target/ volum telah diselesaikan dan

wajib mengembalikannya alat perlengkapan
kepada PIHAK PERTAMA.
5. Jika terjadi kerusakan, kehilangan
perlengkapan yang disebabkan kelalaian dari

ARTICLE VII
FACILITIES
1. The SECOND PARTY will receive equipment
loan from the FIRST PARTY, then the SECOND

for the inventory of the equipment.
2. The FIRST PARTY lends Radio HT, total
station, and other supporting tools to the
SECOND PARTY for tool.
3. The SECOND PARTY receives and uses the
inventory provided by the FIRST PARTY in
accordance with the terms and designations
specified and provided.
4. When target/ volume has been complete and
this Deal is completed thus the SECOND
PARTY must return the equipment/ tools it to
the FIRST PARTY.
5. In the event of damage, loss of equipment
caused by negligence of the SECOND PARTY
then the FIRST PARTY have right to deduct
the SECOND PARTY's fee based on tool price.

dari kegiatan PIHAK KEDUA.
2. PIHAK PERTAMA berhak memerintahkan
kepada PIHAK KEDUA mengeluarkan
anggota karena melakukan pelanggaran.
3. PIHAK KEDUA bertanggung jawab terhadap
barang milik daerah yang dipinjamkan
dan/atau diserahkan kepada PIHAK KEDUA
meliputi pemeliharaan, menjaga kondisi,
perbaikan atau kerusakan, penggantian atas
milik daerah tersebut jika tidak
mengindahkan peraturan dan melakukan
pelanggaran.
4. PIHAK KEDUA, wajib melaporkan kepada
PIHAK PERTAMA data anggota dan setiap
kali akan dilakukan penggantian anggota.
5. PIHAK KEDUA, hanya boleh mengambil
anggota yang memenuhi syarat / kualifikasi
sesuai dengan tuntutan yang dilakukan.
6. PIHAK KEDUA, wajib mengarahkan,
mengatur dan mengawasi setiap anggotanya
agar dapat melaksanakan tugasnya dengan
benar, mentaati segala peraturan dan tata
tertib yang berlaku di PIHAK PERTAMA.
7. PIHAK KEDUA, bertanggung jawab atas
segala akibat yang ditimbulkan oleh
pembuatan / tindakan ataupun kelalaian
anggotanya, baik yang merugikan dirinya
sendiri, PIHAK PERTAMA maupun pihak lain.
8. Melaksanakan sampai selesai sesuai dengan
Standard Operational Procedure (SOP) PT.

tidak dapat diberlakukan sama sekali karena
peraturan perundang-undangan atau
ketertiban umum maka keabsahan dan
keberlakuan ketentuan lain dalam
Kesepakatan ini tetap berlaku dan mengikat
kedua belah pihak.
PASAL XVIII
KEJADIAN YANG TIDAK TERDUGA
Kesepakatan ini dinyatakan batal demi hukum
apabila terjadi hal-hal diluar kekuasaan dan
kemampuan PIHAK PERTAMA seperti:
1. Peristiwa bencan alam, banjir, kebakaran,
gempa bumi, angin topan/badai yang luar
biasa, peperangan, huru-hara,
keributan/kerusuhan, perselisihan
perburuhan, peogokan, wabah penyakit

PASAL XIX
PENUTUP

yang melanggar aturan-aturan yang sudah
ditetapkan di dalam Kesepakatan ini, maka
Mandor berhak menegur dan
memperingatkan anggotanya.
3. Apabila dalam hubungan kegiatan terjadi
pelanggaran-pelanggaran lain yang tidak
tercantum dalam lampiran ini, maka hal
tersebut adalah menjadi hak dan keputusan
PIHAK PERTAMA untuk menentukan sanksi-
sanksi atas pelanggaran tersebut, dengan
tetap mengacu pada undang-undang yang
berlaku.
