MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

The PROVINCIAL LOCAL GOVERNMENT UNIT of Surigao del Sur, a local government unit
created and existing under the laws of the Republic of the Philippines with postal
address at Sangguniang Panlalawigan Building, Telaje, Tandag City, Surigao del Sur,
represented by Vice-governor MANUEL O. ALAMEDA, SR., hereinafter referred to as
the PLGU;

-and-

The CASAMA LAHDZ III, INC., a non-stock non-profit organization organized and
existing under the laws of the Republic of the Philippines with postal address at
MDH Compound, Pagbahanan 2, Poblacion, Marihatag, Surigao del Sur represented by
Dr. JOSEPH D. ORQUIO, hereinafter referred to as CASAMA LAHDZ;

-WITNESSETH-

WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code of
1991 has mandated the local government units to be providers of the basic social,
economic and agricultural services;

WHEREAS, the PLGU of Surigao del Sur prioritized a program of assistance to non-
stock non-profit organizations that cater to the medical and health needs of
residents of the province particularly in providing logistics support;

WHEREAS, CASAMA LAHDZ is organized to promote medical and health supports

particularly in terms of logistics to the Marihatag District Hospital and in this
case is requesting for provision for fuel assistance from PLGU;

NOW, THEREFORE, FOR AND IN CONSIDERATION of the foregoing premises and

considerations, the parties hereto agree as follows:

ARTICLE I – GENERAL PROVISION

This Memorandum of Agreement shall cover the activity entitled: PROVISION FOR FUEL
(DIESEL) FOR USED BY AMBULANCE OF MARIHATAG DISTRICT HOSPITAL FOR ONE (1) YEAR.

ARTICLE II – RESPONSIBILITIES AND DUTIES OF THE PLGU

1. Review and validate and conform to the program of work(s), plans and
specifications prepared and submitted by the CASAMA LAHDZ;
2. Release to the CASAMA LAHDZ, subject to the availability of cash allocation the
amount not to exceed FIFTY THOUSAND (PHP 50,000.00) PESOS;
3. Conduct monitoring and evaluation on the progress of the work through its duly
appointed/designated inspection engineer/office and ascertain that the project
was implemented in accordance with the approved POW, plans and specifications.

ARTICLE III – RESPONSIBILITIES AND DUTIES OF THE CASAMA LAHDZ

1. Administer, manage and disburse the funds in accordance with the existing
government accounting and auditing rules and regulations;
2. Observe applicable provisions and stipulations of Republic Act No. 9184 in the
implementation of the project/program;
3. Undertake the implementation of the project in accordance with the approved POW
and plans;
4. Prioritized employment of displaced local workers;
5. Submit to the PLGU digital photos/videos, before, during and after
implementations;
6. Keep the books of accounts open for examination by PLGU through its authorized
representative;
7. Implement the project within the duration of ONE (1) YEAR as stipulated in the
program of works;
8. Submit liquidation report or report of disbursement to report the utilization of
the funds after project completion;
9. Be responsible for the settlement of the road right-of-way and for the
acquisition of environmental clearance from proper authorities, whenever
applicable and necessary;
10.Be responsible for the repair and maintenance for the said project/program;

ARTICLE IV – EFFECTIVITY AND AMENDMENT

This agreement shall take effect on the date of signing hereof by the contracting
parties and shall remain in force and effect unless sooner terminated by the
parties for due course with prior notice of termination. Upon satisfactory
fulfillment of all terms and conditions embodied herein, this agreement shall be
deemed terminated. Any modification or amendments to this agreement as proposed by
either party shall be mutually agreed upon in writing.
