ORDER

Plaintiff, Pan American Properties Corp., challenges the constitutionally of procedures

related to a Municipal Ordinance No. 12, 2017-2018 Series, linked to the 2018 festivities of San

Sebastian Street (Docket No. 1). It initiated the action on Friday, January 12, 2018 at 7:27 p.m. Id.

The case was electronically assigned to the undersigned today at 3:34 p.m. (Docket No. 2).

Having examined plaintiff’s “Verified Complaint for a Temporary Restraining Order,

Injunctive Relief” (Docket No. 1) and supporting documents, the request for a temporary restraining

order is GRANTED pending the hearing on, and the determination of, plaintiff’s request for a

preliminary injunction. Plaintiff shall serve process on all defendants with copy of the complaint,

supporting documents and this order not later than tomorrow, January 15, 2018 at 6:00 p.m. It shall

file a certification within two (2) hours of service to each individual defendant.

Defendants shall respond not later than January 16, 2018 at noontime. A

preliminary/permanent injunction hearing is hereby set for January 16, 2018 at 3:00 p.m. in

Courtroom No. 3. The parties shall be ready to present all the evidence and arguments in support of

their respective positions.

Plaintiff shall file with the Clerk of the Court, not later than January 16, 2018 at noontime,

an undertaking in the form of a bond or certified check from plaintiff, totaling the amount of

$5,000.00 for the payment of such costs and damages which may be incurred or suffered by

defendants if they have been found to have been wrongfully enjoined or restrained.

The court encourages the parties to reach an amicable settlement on this matter.

The Clerk shall make summons available to the plaintiff so that they can immediately served.
