MI 48824 Mr. Noto, Pursuant to the authority inherent in the House of Representatives of the State of Michigan and Provided for in Section 17 of Article | and Sections 1, 16, and 17 of Article IV of the State Constitution of 1963, we write to request certain records in the University’s possession. These materials, which are outlined below, are requisite to inquiries launched by our committees concerning Michigan State University's handling of the Lany Nassar case, including its administration of existing laws as well as possibly needed changes to remedy any defects thereof. More specifically, we request that you produce the following relevant records in unredacted form to our offices by 5 p.m. on Friday, February 9, 2018: ‘All reports initiated, completed, or issued by the University or its agents in 2014 relating to allegations against Larry Nassar, including but not limited to all versions of the Office of Institutional Equity's Final Investigative Report regarding complainant Amanda Thomashow that ‘was completed by Kristine Moore. All reports initiated, completed, or issued by the University or its agents in 2015 relating to allegations against Larry Nassar, including but not limited 10 the report completed by the Michigan State University Police in July 2015 (Report 14-01682). * All repors initiated, completed, or issued by the University or its agents in 2016 relating to allegations against Larry Nassar. + All repors initiated, completed, or issued by the University or its agents in 2017 relating to allegations against Larry Nassar, including but not limited to the Office of Institutional Equity’s Final Investigative Repos regarding complainant Rachel Denhollander that was completed by Lin-Chi Wang in March 2017. Its our sincere hope thatthe University will cooperate with our request and inquiries without the need to employ means of compulsicn. If necessary, however, the House Law and Justice Committee is authorized under MCL 4.541 to subpoena and have produced before it the records and files of any state Institution. As a state institution, Michigan State University is thus obligated "to produce before the committee as required by the subpoena, or permit the members of any such committee to inspect its a cerecords and files.” Jd. Failure to comply with # subpoena may be punished as for contempt of the Legislature, See MCL 4,82-83, To the extent thatthe records requested consist of material deemed confidential by law, the disclosure of | such to the committee ard its members is not « breach of that confidentiality. The Michigan Attomey General declared in Opinion No. 4998 (1976) that “providing (confidental] materials to tre committee does not constitute public disclosure” of confidential information. A committe, however, i obligated to “not disregard the rights of privacy of individuals (that are the subjects of the confidential records) by unressonebly or arbitrary making public (the confidential information).” Jd. The presentation of the requested materials to the committee “does not absolve the members of the committee from their duly to respect the right of privecy enjoyed (by the subject of the confidential record).” Jd. To that end, the ‘committee and its members ae authorized to review the requested records in a closed mesting as necessary ‘See MCL 15.268.
