Prayer

It is, therefore, most respectfully prayed that this Hon'ble

Court may graciously be pleased to release the applicant on bail

in Case Crime No. 596 of 2017, under sections 3/5/8 C.S. Act,

Police Station Deoband, District- Saharanpur, during the

pendency of trial before the court below; otherwise the

applicant will suffer irreparable loss and injury.

Affidavit of Mohd Salim, aged about 56

years, S/o Mohd Yameen, R/o , Labkri,
Labkari, Deoband, Saharanpur. By Religion
Muslim and Profession Private Farmer.

I, the deponent named above do hereby solemnly affirm and

state on oath as under:-

01- That, the deponent is the friend of the applicant in the above

noted bail application and doing pairvi on behalf of applicant

and as such he is well acquainted with the facts deposed to

below.

02- That, this is the first Bail Application filed on behalf of the

applicant in Case Crime No. 596 of 2017, under sections 3/5/8

C.S. Act, Police Station Deoband, District- Saharanpur.

03- That, as to the prosecution version the police party raided the

applicant’s house on the information of the local informant and

recovered 15 Kg. beef along with other slaughtering

equipments and one countary made tamancha but the applicant

was arrested other co-accused fled away to this effect an F.I.R.

was lodged on 25.08.2016 bearing Case Crime No. 596 of

2017, under sections 3/5/8 C.S. Act, Police Station Deoband,

District- Saharanpur. The certified and typed copy of the F.I.R.

dated 25.08.2017 is being filed herewith and marked as

Annexure No.1 to this affidavit.

04- That, no recovery has been made from the possession of the

applicant and neither from the house of the applicant but the

police has planted the beef though it was recovered somewhere

else recovery memo photo and typed copy 25.08.2017is biing

herewith and marked as Annexure No. 2 to this affidavit.

05- That, applicant is vegetable vendor and the police party asked

to the applicant for supplying vegetable to the police station for

some function but he showed his helplessness thus he has been

falsely implicated in this present case.

06- That, the police had also gone to the extent by implicating the

applicants in other false cases showing police party firing and

lodging another F.I.R. in case crime no. 597 of 2017.

07- That, there is no public witness.

08- That, the applicant is only one bread earner of their family and

there is no one to look after their family.

09- That, the applicant has applied for bail which has been rejected

by the Additional Sessions Judge Room No. 8, Saharanpur vide

order dated 29.08.2017 on extraneous grounds. The typed and

certified free copy of the bail rejection order dated 29.08.2017

is annexed as Annexure No. 3 to this affidavit.

10- That, the no recovery has been made from the possession of the

applicant.

11- That, the applicant is in jail 10.08.2017.

12- That, the applicant owns a house and as such if he is released

on bail there is no chance of absconding or tampering the

witnesses or misuse the privilege of bail.

13- That, in these facts and circumstances of the case, it is

expedient and necessary in the interest of justice that this

Hon’ble court may graciously be please to the applicant may be

release on bail in Case Crime No.596 of 2017, under sections

3/5/8 C.S. Act, Police Station Deoband, District- Saharanpur

during the pendency of their trial before the court below;

otherwise the applicant shall suffer irreparable loss and injury.
