For the value received, I/We _____________________________________,

of ________________________________________ jointly and severally
promised to pay JSKY AGRIVET SUPPLY/ Nemesio Salabit Jr., with their
address at Tigbawan, Tabuelan, Cebu, Philippines, without need of
notice or demand, the total amount that I/We have loaned for the supply
of feeds for our pig/chicken/livestock. The total amount shall be broken
down as follows:

The total amount of ________________________ as acknowledge by me

or my duly authorized representative shall be paid in full on or before
_________________ or upon harvesting of the animals. That I/We hereby
agree that the ____________heads of ___________________ shall be made as
a collateral or security for payment of the total amount that I have
borrowed for the feeds of the said animals.

 In the event that I/We failed to pay upon the maturity date or upon
the date of harvest of the said animals, the rate of Ten Percent (10%) per
month plus applicable service charges and other fees incurred for the
collection of the total obligation.

In the event of failure on my/our part to pay this promissory note

or any interest, service charges, penalties and applicable fees thereon on
the due date of any of the case covered by Article 1198 of the New Civil
Code, the entire sum outstanding under this note shall immediately
become due and payable without the necessity of notice or demand
which I/We hereby jointly and severally promise to pay a late payment
charge on my overdue sum under this note at the rate of TEN PERCENT
(10%) to be collected in additional to the interest and applicable service
charge stipulated therein.

It is further agreed that upon such default, Attorney’s services are

availed of an additional sum equal to Twenty-Five (25%) Percent of the
total sum-due which likewise shall not be less than Five thousand pesos
(P5,000.00) for liquidated damages aside from expenses of collection and
legal cost provided for in the Rules of Court.

I/We hereby submit to the jurisdiction of the courts of Cebu City

for all legal actions, which may arise out of this note or in connection
with the chattels subject hereof.

In case of judicial execution of the obligation or any part of it, I/We

waive all our rights under the provisions of Section 12 of Rule 39 of the
Rules of Court.

Acceptance by the holder of payment or any installment or any part

thereof after due date shall not be considered as extending the time for
the payment of any of the installment aforesaid as a modification of any
of the conditions thereof.
