1. In the morning of Dec 17, 2017

2. Grandmother went to him saying he saw the body of the son on the floor, and latter ask to help
open the door

3. Inserted a chisel to forcefully open the door

4. Saw JR face down on the floor, touched him and felt that JR was already cold

5. Went to thirdy on the crib, touched him, and felt that he too was already cold

6. Ms Guarin was there comforting Mrs. Maximina

7. He then called the barangay and the police

Estella Guarin

1. In the evening of 15 Dec, she saw leave their home without her children
2. She saw Wynona had a large suitcase which seems to be heavy as if full with clothes

3. Asked Wynonna where she would go. Wynona said nothing, but glanced at her

4. Noticed that Wynona was nervous at that time

5. In the morning of 17 Dec, Maximina ran to her house and ask for her help to forcefully open the
door

6. When the door was opened they say the lifeless bodies of JR and Thirdy

7. Then Mr. Orosa called the Barangay and the Police

8. Mr. Maximina told her that she the former is unable to contact Wynona.

9. So she said that she saw Wynona on the eve of Dec 15

Police Blotter

1. Manuel Orosa called a police station in Pasig City at about 1030am of Dec 17, and reported that
around 10am they found 2 dead minors inside the house of Wynona

2. PO2 Gil Tupil et. al were dispatched to respond

Second Police Progress Report (Dec 22, 2017)

1. Acting on a report, they formed a team headed by SPO1 Kaiser Mijares. This team of police
arrived at the scene of the crime around 10:45am, Dec 17

2. Guarin said that 730pm of Dec 15, she heard the siblings of Wynona crying, and such cry
became louder

3. That while talking with somebody on the phone during that night, she saw Wynona leave the
house without her children, and carrying a heavy suitcase

4. The progress report also took also the testimony of Manuel Orosa
5. A cctv directly facing the crime was obtained, found in the lower left corner of the ceiling

6. Maximina narrated to them that the last time she saw Wynona was on 15 Dec

7. Cause of death of Thirdy is asphyxiation

8. The suspect is Wynona

9. Then they conducted manhunt

10. Rex cannot be contacted since 15 Dec. Such problem in communication caused
misunderstanding between them, and such misunderstanding lead to commission of the crime

11. No signs of robbery or burglary, because the belongings inside the house are intact; except for
the cabinet which was left ajar, and half empty

12. An open vault inside the room was also seen

13. Wynona, in an attempt to conceal her crime, suddenly disappeared to manage her escape

14. Investigator believes that these facts lead to a compelling belief that Wynona is the primary
suspect for killing the two minors

15. The first responder is PO2 Gil Tupas

16. Then police investigator Joseph Navora came to check on the crime scene

17. There was discoloration found on the neck of JR

18. No discoloration was found on the neck of Thirdy

19. Other appliances of value are still in tact. Laptop was still there

20. But cabinets in the master bedroom were left ajar, and half of its contents are empty

21. An open vault was also seen inside the room

PLDT representative

1. On 26 of Dec, PLDT issued a certification of a true and faithful copy of video recording which
captured what transpired in the house of Wynona between 5:00am – 11:59pm of Dec 15

2. Signed by the head of technical department of PLDT

Autopsy report on the body of JR (9am, Dec 18)

1. Date of death is 15th of December


2. 10 years old
3. Wearing blue shirts, black sweatpants
4. Height is 4’7, weighs 28 kilograms
5. Eyes are open
6. Iris are dark brown
7. Corneas are cloudy
8. Severe haemorrhaging
9. Engorged blood vessels are present in the conjuctival surfaces of the eyes
10. Hair is 4 inches in length
11. There are 3 areas of bruises: (in anterior and lateral areas of the neck)
12. Thryroid cartilage is visibly fractured
13. There are tissue engorgement of the neck muscles above and around the level of bruising
14. Fingernails are medium length
15. Blood clots were found in the second and third fingers of the right hand
16. Blood clots were found in the second and third fingers of the left hand

17. No lesions on the oral cavity


18. Petechial haemorrhaging is present in the mucosa of the lips and the interior of the mouth
19. Mucosa is intact
20. There are no injuries on the lips, teeth or gums

21. Tracheal arches are collapsed at the level of thyroid cartilage, cauising the distraction in the
airways
22. The mucosa of the epiglottis, glottis, piriform sinuses, and major bronchi are anatomic
23. No injuries are seen
24. No mucosal lesions
25. The hyoid bone, the thyroid and the cricoid cartillages are fractured

26. Broken hyoid bone


27. Fracture hyoid bone, Thyroid cartilage and cricoid cartilage

28. Type B
29. 15 swabs from various body locations, to be tested for presence of hypochlorite

30. Carbon dioxide levels in blood sample is elevated

31. Time of death: between 7:30 – 9:30 of Dec 15

32. Cause of death: asphyxiation through strangulation

33. Manner of death: homicide through strangulation

Autopsy of Thirdy

1. 10 months
2. Died 15 December
3. Body measures 38 inches, weighs 14 kilograms
4. Eyes are open, iris dark brown
5. Corneas are cloudy
6. Severe hemorrhaging and engorged blood vessels are present in the conjuctival surfaces if the
eyes
7. General cyanosis is observed, with no visible injuries in the head or neck
8. Internal examination is waived as requested by next of kin

34. 15 swabs from various body locations, to be tested for presence of hypochlorite
35. Carbon dioxide levels in blood sample is elevated
9. Immediate cause of death: asphyxiation

Report on the results of the missing person dated 26 Dec

Complaint affidavit of Rex (Executed 9th of January)


1. Was only informed of the death of his children on 20 Dec (facilities went back to normal), by his
mother, through email
2. Barangay tanod came first, then the police
3. Maximina seem to be out of the picture that time
4. He was so sure based on the Fam Cam that the person slapping Jr and the one who put a pillow
on Thirdy was Wynona
5. At 9:30 Wynona went out of the master bedroom, all dressed up, carrying her largest suitcase

Amended complaint (executed: )

1. On 16 of Dec Maximina tried to call Wynona on the phone to inform her that she will not be able
to make her weekly visit. First time, it cannot connect. The second time, out of converage

2. Since the wife was missing at that time, she coordinated with the police as to the whereabouts of
the wife

3. 1pm of Dec 15, JR was watching TV on the sofa, baby was in the crib, Wynona was in front of the
family computer

4. Wynona became restless and did random things at the house

5. Wynona slapped JR, and the latter was swept off the floor. The floor touched his cheek

6. Wynona took a pillow, proceeded to the crib. She pushed the pillow hard on the baby inside the
crib

7. JR tried to pull her mommy’arm away from Thirdy

8. Bu Wynona hit JR with an elbow, and placed her hands in his throat

9. After a few minutes, she released JR

10. Then Wynona just stood right there without moving. Then she started to cry and curl on the floor

11. At 930 she went out of the master’s bedroom carrying the largest suitcase. Proceeded to the door
of the unit without batting an eye on JR who was still on the floor

12. He was sure based on the CCTV footage that it was Wynona
