RULES FOR PLAYER AUCTION

A. INTRODUCTION

1. These rules (together the “Rules”, with each individual rule being a “Rule”) set
out and regulate how the Player Auction (the “Auction”) will operate for the first
Season of ________________ (the “League”), which is anticipated to
commence on _____________. All ___ (_) Franchisees (the “Franchisees”) will
be participating in the Auction.

2. For the purpose of these Rules:


a. “Player(s)” shall mean any player who has been centrally contracted by
___________________ (“____”) and placed in the Auction pool for
selection by the Franchisees.
b. “Domestic Player” shall mean any player who is an Indian citizen
holding an Indian passport and eligible to represent the Indian national
Cricket team.
c. “Foreign Player” shall mean any player who is not an Indian citizen and
does not hold an Indian Passport and is eligible to represent his national
sports federation for Cricket.

3. The Auction will take place on February 16, 2018 at the


_____________________, however the date and the location may be changed
by _____ at its sole discretion.

4. A total of forty-eight (48) Players will be made available to the Franchisees


through the Auction, such that each Franchisee shall pick a total of four (4)
Players.

5. There shall be fifteen (15) Players in each team, four (4) shall be picked by the
way of this auction and the remaining eleven (11) Players shall be allotted by
the Governing Council.

6. Two crore Rupees from the franchisee fee shall be allotted to the franchisee as
“auction purse”.

B. Auction Sequence Selection

7. Auction shall be conducted in points, one thousand (1000) Points shall have the
value of Rupees one lakh (1,00,000).
8. Each Franchisee has a total "auction purse" of up to Rupees two crore that it can
spend on the Auction for players for ___. Franchises can make a bid that would
take them beyond Rupees two crore (2,00,00,000) or two lakh(2,00,000) Points
but this excess amount shall be paid for by the Franchisee and the league
owners shall not bear any costs.

9. There are forty-eight players in the Auction – a combination of Indian national


team and foreign cricketers. Each player has an annual "base player fee". The
base player fee will be the fee at which the bidding for that player starts.

10.The Players in the Auction will be arranged into categories of Platinum, Gold and
Silver according to their base player fee.

11.1. Base prices of Players :


a) Platinum player = 75,000 points
b) Gold Player = 50,000 points
c) Silver Player = 25,000

11.One Player is required from each of the categories mentioned in Rule 10 and the
4th Player shall be from either Gold or Silver category.

12.Within the categories, the order that players will be presented for auction will be
determined by a random draw that will take place in the Auction room.

13.A designated authority from ____ shall choose the draws referred to in Rule 12
one by one while representative from each Franchisee will put in bids for players
as and when the names of the players are announced for auction.

14.Each Franchisee must have at least _____ (_) representatives in attendance for
the entire duration of the Auction.

C. Auction Process

15.One week prior to the Auction, Franchises will be issued a list of the players that
will be auctioned, the composition of the sets and the order in which the sets will
be auctioned. This list has been prepared by ____ based on a best efforts basis
and in case of any error or other inaccuracy, neither ____, the
_______________(“____”) nor any of its’ or their respective officers,
employees, shareholders or agents shall be held liable or responsible for such
error / inaccuracy. The Franchisees are advised to conduct their own background
research on Players before making a choice in the Auction.
16.The Auction will be an open auction with each player being individually put up
for bidding by the franchises.

17.The auctioneer will announce the player’s name and teams will start bidding for
the player starting from the base price. The representatives of the teams will
have to raise their team paddle for the bid. The team with the highest bid will
get the player.

18.A player will go unsold if none of the teams raise their paddle.

19.The unsold players will come back into the auction after all the players go under
the hammer for the first time. The auctioneer will give the teams an option of
listing the unsold players they are interested in and will start the bidding war for
those players for the second time with the base price of the player slashed to
half.

20. The bidding increments will be as follows


i. Bids up to _____ - increments of _____
ii. Bids from ______ to _____ - increments of ____
iii. Bids from ____ to _____ - increments of _____
iv. Bids in excess of ______ - increments at the auctioneer’s discretion

21. As each player is sold, the Franchise will be required to sign a form confirming
the terms of the agreement (name of player, player fee agreed). The player fee
will be deemed to include any fee that may be payable to the player's agent.

22.Following the conclusion of each set, there will be a break to allow Franchises
time to re-evaluate their tactics.

23.Players for whom no bids are received when they are initially presented for
auction will be placed in a final set and will be re-presented for auction once all
of the initial sets have been concluded.

24.The contract with the player will be for a fixed term of ___ years. The Franchise
is obligated to sign both agreements in respect of players that it buys during the
Auction. Note that the player fee is inclusive of the fee that is due to the player's
agent.

25. The Franchisees shall, by email to ________________ and _____________ on


or before ___________, nominate up to ___ (_) persons who will be announcing
the names of the selected Players on the day of the Auction and only such
persons may announce his/her Franchisee’s selections during the Auction.

D. General

26.Each Franchisee will have a table in the room where the Auction occurs. Tables
will be allocated to Franchisees in a random manner determined by ____.

27.Each Franchisee can have up to a maximum of ____ (_) persons seated at the
table. Additional persons, if any, from a Franchisee will be seated at the side
chairs.

28.All Franchisee personnel in the room must remain seated at all times while the
Auction is in progress and may not move around the room, during any rounds of
the Auction.

29.The names of the Players selected and auctioned by all ___(_) Franchisees will
be announced officially by ____ following the completion of the Auction.

30.No media will be invited into the Auction room unless ____ decides otherwise.

31.Neither ____, _____ nor any of its’ or their respective officers, agents,
employees or shareholders shall be held liable, in any manner whatsoever, by
any Franchisee and/or other third party as a result of any inaccuracy in the
information supplied to the Franchisees in connection with the Auction, Player
and/or any malfunction or other error in connection with any information
technology supplied to the Franchisees or otherwise. _____ reserves the right to
vary, in its absolute discretion, any of the rules or procedures included in these
Rules.

32. ____ shall have the power to make decisions in relation to the Auction if there
are any unforeseen events or in respect of any matter not provided for in these
Rules and such decision shall be final and binding on all of the Franchisees.

33. Each Franchisee will be required to sign a copy of these Rules before the
Auction commences whereby it agrees to be bound by these Rules. By
participating in the Auction each Franchisee irrevocably and unconditionally
agrees to accept and abide by these Rules.
34. These Rules shall be governed by Indian laws and if there is any dispute in
connection with them, which cannot be resolved amicably, then such dispute
shall be submitted to the Courts of ______.

E. Injury Replacement

35. In the event of an injury to a Player and/or unavailability of a Player due to


other reasons (such as visa) for participation in the League after the completion
of the Auction, the Player shall be replaced only by a Reserve Player. Such
Reserve Player shall be of the same category as that of the injured /
unavailable Player and, ____ shall have the sole discretion and responsibility to
enter into an agreement with such Reserve Player and make the Reserve Player
available to the Franchisee on a best effort basis.

36. For injury replacements during and before the League ____ will have the right
to verify the extent of the injury and the time remaining for the League to end
before taking a decision on the requirement for a replacement. Once a Player is
replaced he may not play for the Franchisee again in any match during the
relevant Season.

F. Player Insurance

37. ____ shall take out and maintain in force (and meet all costs of) an insurance
cover for each of its Players.

38. For the avoidance of doubt, ____ shall bear the full costs of adequately insuring
all Players for the duration of the League.

39.All expenses incurred by a Player in regard to any visa (or similar


documentation) will be paid by ____.

40.All expenses incurred by ____ in regard to the procurement of Players, will also
be solely borne by ____.
