JUDICIAL AFFIDAVIT OF GLORIA RIVERA

This is the testimonial Affidavit of GLORIA RIVERA, in question and answer form,
which was taken by Atty. Diane G. Bihasa on February 13, 2017 at Caloocan City, pursuant to
Section 5 paragraph (k) of the Supreme Court Administrative Circular No. A.M. No. 03-109-SC.

PRELIMINARY STATEMENT

The testimony of petitioner GLORIA RIVERA is being offered to validate and prove the
material allegations of the Petition filed by petitioner seeking for a judicial declaration of nullity
of her marriage to respondent Ernesto Rivera on the ground of lack of marriage license.

I, GLORIA RIVERA, of legal age, married and residing at 456 B Sta. Quiteria, Caloocan
City after having been duly sworn to according to law, hereby depose and state:

That I am the petitioner in Civil Case No. 9876-Q, a case for declaration of nullity of
marriage which I filed against my husband, Ernesto Rivera at the Regional Trial Court of
Caloocan City, Branch 123;

That my lawyer, Atty. Diane G. Bihasa, asked me the following questions and I responded
to her questions according to my personal knowledge and she reminded me that I am under oath
and I may face criminal liability for false testimony or perjury.

1. Q: Please state your name and other personal circumstances for the
record.
A: GLORIA RIVERA

2. Q: Are you the same GLORIA RIVERA, the petitioner in this case?
A: Yes ma'am.

3. Q: Do you know a certain ERNESTO RIVERA?


A: Yes ma'am. He was my husband.

4. Q: How did you meet respondent ERNESTO RIVERA?


A: We were classmates at Polytechnic University of the Philippines. We
enrolled at the same course-Civil Engineering in June 1990 and
became couples on our second year in college.

5. Q: How long have you been together with the respondent?


A: Ernesto and I have been together for about 10 years. After his work in
Cebu for a 2 year contract, we have been living together in Caloocan
since 1995.
6. Q: Are you married to the respondent and if in the affirmative, please state
how your marriage was solemnized?
A: We got married on July 28, 2005. The marriage was solemnized by Rev.
Florian Galang before the Caloocan City Hall. In lieu of marriage
license, we presented a sworn affidavit that we have been living together
for about 5 years. However, said affidavit is fraudulent because it was not
respondent's signature but of another person.

7. Q: Do you have the proof of your allegations?


A: Yes, I have ma'am. The sworn affidavit dated June 26, 2000 was signed
not by the respondent but of another person. His signatures in his
Identification Cards (company ID, SSS ID) were not similar with the
signature in the said affidavit. The original sworn affidavit and certified
true copies of his Ids were attached as “Annex A” in my petition.

8. Q: Did the solemnizing officer checked the genuiness of your sworn


affidavit?
A: I do not think so ma'am. I do not personally know Rev. Galang, but
respondent know him.

9. Q: Were you able to acquire a marriage certificate of your marriage?


A: No ma'am. I was told by the respondent that he will be the one who will
get the same. But upon inquiry on August 12, 2007 from the
Registration Office of Caloocan City, there was no marriage
certificate between me and the respondent.

10. Q: Did your marriage to the respondent produce any child?


A: No ma'am. We have no children.

11. Q: Are you still living with the respondent?


A: No ma'am, we have been separated since 2012 and have since then
neither of us had the insterest to contact each other.

12. Q: Did you acquire any property during your marriage which may be
considered as conjugal propery?
A: None ma'am.

13. Q: What are you asking this court with respect to this case?
A: I am praying that the Honorable Court would grant my petition for
Declaration of Nullity of my marriage with Ernesto Rivera on the
grounds that our marriage is void ab initio for lack of marriage license.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 13 th day of


February, 2017 at the City of Caloocan.

SUBSCRIBED AND SWORN TO BEFORE ME, a notary public in and for the city of
Caloocan this 13th day of February 2017. Affiant personally came and presented to me her
Passport No. 1234756 issued on 2012 at POEA DFA Branch, as valid and competent proof of
her identity, known to me as the same person who personally signed the foregoing judicial
affidavit before me and avowed under penalty of law to the veracity of the contents of said
instrument.
