The purpose of this procedure is to assist the timely delivery of Land Plots and of Right of Way
to the Pipeline Construction Contractor. The procedure is also intended to enable the follow up
of associated compensation payments.
Definitions
“Installation Act”: The Act issued by the Ministry of Environment, Energy and Climate Change
(YΠΕKA) which allows the pipeline to be installed.
“Loans & Funds Deposit”: The Government Funds from which compensation to landowners is paid
for the R.O.W.
The three (3) relevant Departments* of DESFA coordinated by the Project Manager.
“ROW Coordinator”: Engineer responsible to deliver on behalf of DESFA the ROW – Land Plots to
Contractor free of any legal defects.

“Ministerial Decision for Environmental Terms”: A decision issued by the Ministry of
Environment, Energy and Climate Change (YΠΕKA) approving the Environmental requirement of
the pipeline.
Crop Loss Compensation”: money paid to landowners / cultivators to compensate for the crops they
have lost or will be lost as a result of the pipeline construction works.
“Right-of-Way Compensation»: money paid to landowners to compensate for the passage of the
pipeline across their land and the stipulation of a R.O.W zone on either side of the pipeline axis.
The pre-estimation cost is prepared by the General Secretary’s (of the District) county decision.
“Mortgage Services”: a part of local authority which maintains Land Registry details.
“Cadastral Tables and Drawings’ Verification”: Supervision and R.O.W Co-ordinator proceed to the
Cadastral Verification according to the recent law of expropriation 2882/2001.

Legislation
“Law 2289 / 95: Law concerning compensation for crop loss and pipeline right-of-way.
Law 3734/2009: Law concerning passage from forests and forest land (combined with L. 998/1979).
Law 3335/2005: Law concerning passage from private forests and forest land.
Law 3428/2005 and Presidential Decree 33/2007: Both the law and the Decree are referred to the
Corporation to DESFA.

Description of the Procedure
The steps of the procedure are set out in the flowchart in APPENDIX A. The following notes provide
further elaboration.
2. The Engineer defines routing on 1:5.000 scale maps. During this definition phase the Engineer
contacts all competent Authorities and other related main parties and acquires their consent for
the routing of the pipeline.
3. The Engineer produces Cadastral tables and drawings on scale 1:1000. The Engineer shall ensure
that the final Cadastral Documentation is suitable, complete enough, correct and in accordance
with legal requirements.
The relevant Project Manager expedites the Engineer's adherence in accordance with Contract
stipulations.
4. The Engineer submits the Cadastral Documentation to the three (3) relevant Departments.
5. Project Manager forwards the Cadastral Documentation to the three (3) relevant Departments for
review/comments and further actions.

6. Department of Licenses forwards the Cadastral Documentation to DESFA 's Legal Services
Department in order to apply to the ΤΠΕΚΑ for the Installation Act issue.
7. The issue of a Ministerial Decision for Environmental Terms is a pre-requisite for the issue of an
Installation Act.
8. DESFA submits the Cadastral Documentation to the ΤΠΕΚΑ with an application for the issue of
the Installation Act.
9. The Installation Act is issued by the ΤΠΕΚΑ. The issuance of the Installation Act is published in
the Government Gazette. An original copy of the Installation Act and the Cadastral
Documentation which have been approved by the ΤΠΕΚΑ are received by the Department of
Land Acquisition Matters and the Project Manager, which submit a copy to the Department of
Licenses and the Project Manager.
10. When step 9 has been completed, the ROW can be delivered to the Contractor. Project Manager
informs the Contractor that the ROW is available. Upon agreement with the Contractor the ROW
is delivered by the ROW Coordinator. (In parallel with the ROW delivery, the Procedures for the
compensation of the relevant landowners are initiated - see step 11).

11. Department of Licenses in cooperation with ROW Coordinator submits the Cadastral
Documentation, the Installation Act and the relevant page of the Government Gazette to the
relevant Prefectures, town planning authorities etc. Departments of Land Acquisition matters
and Routing, Topography, Environment and Safety Studies and ROW Coordinator participate in
open community meetings in order to inform the landowners and/or cultivators for the
commencement of the construction works as well as for their rights for compensation according
to the law 2289/95.
12. The compensation for loss of crops is determined by a loss of Crops Estimation Committee which
is appointed by the General Secretary of the each District in accordance with the Law 2289/95.
Department of Land Acquisition is in constant communication with the committee in order to
expedite and receive their decision for Crop Loss Compensation.
13. Department of Land Acquisition receives from the Crops Loss Estimation Committee their
estimation for the Crop Loss Compensation and notifies the Contracts Administration
Management to issue the relevant Payment Certificates / Orders to DESFA in order to allow for
the payment of the beneficiaries. Department of Land Acquisition is responsible for the
management of the budget of compensation payments and must take due regard of this in
executing steps 11 and 12.
14. DESFA issues cheques to Department of Land Acquisition for Crop Loss Compensation.

15. ROW Co-ordinator provide the cheques issued by DESFA directly to the individual beneficiaries.
Department of Land Acquisition keeps a record of the Crop Loss Compensation payments.(It is
noted that an individual owner / cultivator may receive compensation on subsequent occasions,
as necessary, if the construction works result in loss of crops for subsequent seasons).
16. The value of land for ROW easement compensation is determined by the relevant Prefect as
provided by Law 2289/95. This value of Land Easement Compensation is usually determined by a
Land Estimation Committee appointed by the General Secretary of the each District, as provided
for under Article 15 of Law 2882/2001 concerning land expropriations. Department of Land
Acquisition is in constant communication with the General Secretary of the each District in order
to expedite and receive the determination of the required compensation.
17. Department of Land Acquisition receive the determination for ROW Easement Compensation
and proceed to the correction/completion of the Cadastral Documentation.
18. Project manager and the Department of Land Acquisition notify Contracts Administration
Management to issue Payment Certificates / Orders to DESFA in order to allow the payment of
ROW Easement Compensation to Loans & Funds Deposit. Department of Land Acquisition is
responsible for the management of the budget of compensation payments and must take due
regard of this in executing steps 16 and 17.
19. DESFA deposits ROW Easement Compensation to the Loans & Funds Deposit.

20. Department of Land Acquisition submits the corrected Cadastral Documentation to the
Mortgage Services for checking and further submission to the relevant First Instance Court.
21. The potential beneficiaries of the compensation must first apply to the court. Following a
suitable court decision the Department of Land Acquisition give order to Loans & Funds Deposit
to pay. Department of Land Acquisition monitors and records the payments made to
beneficiaries.
22. In cases where landowners disagree with the above defined value of land for the ROW Easement
Compensation, Law 2289/95 provides for their appeal to the court for higher compensation. In
these cases, Department of Land Acquisition support DESFA Legal Services in the presentation
of DESFA’s case. Department of Land Acquisition monitors and records any additional
compensation to be paid to the beneficiaries.
