SUBJECT: Preliminary Investigation Report on the administrative complaint

against Mr. Ronnie L. Uy, Mc Jim Ondap and Zaldy Nobleza for alleged gross
violation of reasonable office rules and regulations and conduct
seriously prejudicial to the best interest of public service

PRELIMINARY INVESTIGATION REPORT

PROCEDURAL BACKGROUND:

On February 1, 2018, this office was in receipt of an indorsement

(Annex "A" hereof) from the Office of the Provincial Agriculturist, dated
January 31, 2018 relative to the report against Mr. Ronnie L. Uy, Mc Jim
Ondap and Zaldy Nobleza,(Ronnie, Mc Jim and Zaldy for brevity) Executive
Assistant I and Farmer I, respectively . Attached thereto are the report from
the CSU assigned at Lamdag Agro Eco–Tourism of Barangay Pasian,
Monkayo, Compostela Valley. The personnel complained of were
subsequently notified relative thereto and were requested to submit their
comments/answers with supporting evidence within the prescribed period.
Only Mr. Ronnie L. Uy did not received the show cause order personally.
Several attempts were made but all were proven futile. This office was
constraint to hand over the said order to the Office of the Provincial Human
Resource Management for the service of the same.

FACTUAL ANTECEDENTS:

On January 31, 2018, the Office of the Provincial Administrator was

copy furnished with an incident report (Annex "B" hereof) from the Office of
the Provincial Warden addressed to the Office of the Provincial
Administrator, detailing the circumstances and events which impute upon
Ronnie, Mc Jim and Zaldy some irregularities and unlawful acts that warrant
administrative disciplinary sanction. More particularly, the said report alleges
that three of the employees stationed at Lamdag Agro Eco–Tourism of
Barangay Pasian, Monkayo, Compostela Valley namely Mr. Ronnie L. Uy, Mc
Jim Ondap and Zaldy Nobleza, the persons herein complained of engaged in
drinking spree with students under the Work Immersion Program.

INVESTIGATION EVENTS:

Immediately after receipt of the indorsement, show cause orders were

referred to the personnel complained of for their written comments/answers
with express instruction to submit available controverting or supporting
evidence within the reglementary period.

On February 1, 2018, this office was in receipt of answers from

Ronnie, Mc Jim and Zaldy admitting all the allegation on the report however,
specifically denying the initiation of the said activity. Claiming that they were
only invited by the students to celebrate with them.

FINDINGS:

A. On the specific allegations of the complaints:

a. Mr. Ronnie L. Uy, Mc Jim Ondap and Zaldy Nobleza were caught
drinking hard liquor together with the students under Work Immersion
Program inside the government training center at Lamdag Agro Eco
Tourism Complex for a number of time.

B. On the part of the personnel complained of:

Mr. Ronnie, Mc Jim and Zaldy in their respective written Answers

(Annex "C", "D" and "E" hereof) admitted the allegations in the report but
averred in defense that they were not the ones who initiated the drinking
spree rather, it was the students-trainees who initiated and caused the
same. However, they likewise admitted that they knew that the said
activities were not sanctioned and violative of their office house rules.
Finally, they asked forgiveness and consideration of the acts complained of.

C. Remarks of the Investigation Committee.

The Constitution requires, as a continuing obligation, that public

officers and employees must, at all times, be accountable to the people,
serve them with utmost responsibility, integrity, loyalty, and efficiency; act
with patriotism and justice, and lead modest lives. For this reason, the
prohibition of alcohol drinking within the premises of government facilities is
a valid and reasonable house rules recognized by the Civil Service
Commission and other administrative agencies including our own.

On the basis of the evidence presented and on the strength of the

admission from the lips of the persons complained of, this office has
sufficient and substantial bases to indict herein subject personnel for formal
administrative disciplinary action for gross violation of reasonable office rules
and regulation and conduct seriously prejudicial to the best interest of public
service.
RECOMMENDATION:

WHEREFORE, foregoing premises considered, this committee upon

finding the existence of a Prima Facie Case that the acts complained of
probably exist and that the personnel complained of are probably
responsible thereto, recommends that a formal charge be issued against the
personnel complained of, Mr. Ronnie L. Uy, Mc Jim Ondap and Zaldy
Nobleza, for gross violation of reasonable office rules and regulation and
conduct seriously prejudicial to the best interest of public service.
