Madam:
In compliance with the 1st indorsement dated August 24, 2017 by Acting LMO III Joseph
L. Sancho, relative to the above-noted subject. I have the honor to report that I have been
on the premises, examined and investigated the land with the following findings, to wit

1. That the land subject hereof is situated at Brgy. F. Magallanes, Masbate

City, Province of Masbate; covered by FLA No.054111-776 with an area of
420 sq.m.

2. That the subject FLA is found to be within the Foreshore Land of Block 1,
Alienable and Disposable Land, LC Project No.3, Masbate City, Certified
on December 22,1924, per LC Map No. 452.

3. That the herein parcel of land is portion of Lot 1076 Cad 627-D Masbate
Cadastre as surveyed for the Barangay of Magallanes.

4. That Emmanuel C. Uy executed a “Waiver and Transfer of Rights” in favor

of Joel V. Ibañez over the same area under Document No. 191; Page No.
20; Book No. 127 and Series of 2013 dated November 25, 2013.

5. That the area is actually used as residential which is also indicated and
specifically stated on the application form of Emmanuel C. Uy attached
herewith and that said are is not covered by the proposed improvement of
the City Local Government Unit.Furthermore, the purpose of the requestee
is just to apply for the same FLA or if possible, for an MSA.

6. That the said land is free from any claims and conflict and is not covered by
any subsisting free patent application for the title nor any land application
for the title nor any land registration cases filed in court.;
 7. That said Emmanuel C. Uy has paid the occupation fee on the said lot for
the period from August 23, 2011 to August 22, 2017 in the amount of
₱4,295.30 with Official receipt no. 5129609 dated August 01,2017.

IN VIEW OF THE FOREGOING, it is respectfully recommended that the

aforementioned FLA No.054111-776 of Emmanuel C. Uy be rejected and that an MSA
may be filed by Joel V. Ibañez be given due course.
