ACUERDO ENTRE LA REPUBLICA DE GUATEMALA Y BELICE PARA LA HOMOLOGACION DE HORARIOS DE LOS PASOS TERRESTRES DE ENTRADA LEGALMENTE HABILITADOS. La Repiblica de Guatemala y Belice en lo sucesivo “las Partes”, COMPROMETIDOS con el objetivo de mantener y profundizar las relaciones bilaterales amistosas; CONVENCIDOS que el paso constante de personas y bienes conduce al respectivo desarrollo econémico de las Partes; DESEOSOS de facilitar el paso de personas y de comercio a través de los pasos terrestres de entrada legalmente habilitados de ambas Partes; Acuerdan lo siguiente: ARTICULO 1 OBJETIVO El objetivo del presente Acuerdo es que ambas Partes operen las veinticuatro (24) horas del dia los pasos terrestres de entrada legalmente habilitados. ARTICULO 2 DE LAS OPERACIONES MIGRATORIAS A partir de la entrada en vigor de este Acuerco, las Partes operarin las veinticuatro (24) horas del dia en los pasos terrestres migratorios legalmente habilitados. ARTICULO 3 DE LAS OPERACIONES ADUANERAS A partir de la entrada en vigor de este Acuerdo, las Partes mantendrin aquellas operaciones de aduana que estimen necesarias las veinticua:ro (24) horas del dia en los pasos terrestres Jegalmente habilitados.ARTICULO 4 OTRAS OPERACIONES A partir de la entrada en vigor de este Acuerdo, ‘as Partes mantendrén las veinticuatro horas (24) del dia todas las operaciones nacionales y regionales en los pasos terrestres legalmente habilitados. ARTICULO 5 DISPOSICIONES FINALES 1. EI presente Acuerdo esté fundamentado en el “Acuerdo sobre un Marco de Negociacién y Medidas de Fomento de la Confianza entre Guatemala y Belice’, suscrito el 7 de septiembre de 2005, en el cual uno de los propésitos es el de mantener y profundizar las relaciones bilaterales amistosas hasta que el Diferendo Territorial, Insular y Maritimo sea resuelto de manera permanente. 2. Este acuerdo también se fundamenta en el Mapa de Ruta para el Fortalecimiento de la Relacién Bilateral firmado cn Washington, D.C. Estados Unidos de América, el 24 de enero de 2014 por los Ministros de Relaciones Exteriores de las Partes en el que se convino elaborar un programa ¢e actividades para el fortalecimiento de la relacién bilateral. 3. El presente instrumento no constituiré renuneia total o parcial de la soberanfa sobre ningiin territorio (terrestre, insular y maritimo) reclamado por cualquiera de las artes; ni iré en detrimento de derecho alguno de las Partes sobre dicho territorio; ni constituird precedente para el fortalecimiento o debilitamiento de la reclamacién de cualquiera de las Partes sobre ningim territorio. Cada una de las Partes reserva expresamente sus derechos con respecto a sus reclamos de soberania sobre cualquier territorio (terrestre, insular 0 maritimo). 4, Las Partes acuerdan que ninguna de ellas usar contra la otra, en ningtin foro ante el cual su diferendo territorial sea llevado en el futuro, el hecho de que cualquiera de las Partes haya aceptado, acordado, acatado o aplicado cualquiera de las medidas de fomento de la confianza. 5. Cualquier controversia relacionada ccn la aplicacién 0 interpretacién de este ‘Acuerdo sera resuelta de manera amistosa por las Partes por la via diplomética, 6. Este Acuerdo entrard en vigor en la fecha en la que ambas Partes hayan recibido la notificacién respectiva por la via diplomética sobre el cumplimiento de sus respectivos requisitos legales internos.7. El presente Acuerdo tendré una duracién de diez (10) afios y se prorrogaré autométicamente por periodos iguales, salvo que alguna de las Partes, mediante notificacién escrita por la via diplomética, lo de por terminado, terminacién que surtiré efecto un (1) afio después de la notificacién respectiva. 8. En ningin caso Ja terminacién del Acue-do afectaré los derechos adquiridos por los particulares en virtud del mismo. 9. Bl presente Acuerdo podré ser modificado de comtin acuerdo por las Partes por escrito y por la via diplomatica. Las medificaciones entraran en vigor siguiendo el procedimiento establecido en el parrafo 6 de este Articulo. Suscrito en Placencia, Belice el dia 17 de diciembre de 2014, en dos ejemplares originales en espaiiol y en inglés, siendo ambos textos igualmente auténticos. POR LA REPUBLICA DE GUATEMALA POR BELICE, MINISTRO DE RELACIONES|EXTERIORES — PROCURADOR GENERAL Y MINISTRO DE —_ RELACIONES EXTERIORES SECRETARIO GENERAL DE LA ORGANIZACION DE LOS ESTADOS AMERICANOS (TESTIGO DE HONOR)AGREEMENT BETWEEN BELIZE AND THE REPUBLIC OF GUATEMALA ON THE HARMONIZATION OF OPERATING HOURS AT LEGAL TERRESTRIAL ENTRY POINTS Belize and the Republic of Guatemala, hereinafter "the Parties", COMMITTED to the objective of maintaining and deepening friendly bilateral relations; CONVINCED that the steady movement o° people and goods is conducive to the economic development of the respective Parties, DESIROUS of facilitating the movement of people and of trade through legal terrestrial entry points of both Parties; Agree as follows: ARTICLE 1 OBJECTIVE ‘The objective of this Agreement is for both Parties to maintain twenty-four (24) hour operations at their legal terrestrial entry points. ARTICLE: 2 IMMIGRATION OPERATIONS Upon entry into force of this Agreement, the Parties will maintain twenty-four (24) hour immigration operations in legal terrestrial entry points. ARTICLE: 3 CUSTOMS OPERATIONS Upon entry into force of this Agreement, the Parties will maintain twenty-four (24) hour customs operations as are deemed necessary at legal terrestrial entry points. ARTICLE: 4 OTHER OPERATIONS Upon entry into force of this Agreement, the Parties will maintain twenty-four (24) hour operations of all other national and regional operations in all legal terrestrial entry points.ARTICLE 5 FINAL PROVISIONS The present Agreement is based on the “Framework Agreement for Negotiations and Confidence Building Measures between Belize and Guatemala,” signed on 7th September 2005, that has as an objective the maintenance and deepening of friendly bilateral relations until the Territorial, Insular and Maritime Dispute is permanently resolved. This Agreement is also based on the Road Map for the Strengthening of the Bilateral Relations signed in Washington, D.C. United States of America on 24th January 2014 by the Ministers of Foreign Affairs of the Parties, in which it was agreed to develop a programme of activities for the strengthening of the bilateral relations. ‘The present instrument shall not constitute a total or partial waiver of sovereignty over any territory (land, insular and mar-time) claimed by either Party; nor shall any rights of either Party to such territory be prejudiced; nor shall any precedent be established for the strengthening or weakening of either Party's claims to any such territory. Each Party expressly reserves its rights with respect to its claims of sovereignty over any territory (land, insular or maritime). The Parties agree that neither Party will use against the other, in any forum in which their territorial differendum may be addressed in the future, the fact that either of the Parties has accepted, agreed to, complied with or implemented any of the confidence building measures included kerein. Any dispute arising from the interpretation or application of this Agreement shall be resolved amicably through diplomatic ckannels This Agreement will enter into force cn the date when both sides have received notification via diplomatic note that their respective legal requirements have been met. ‘The present Agreement will have a duration of ten (10) years and will be automatically extended for equal periods, unless any of the Parties, through written communication via diplomatic channels, revokes it, and the termination will be effective one (1) year after the respective notification,8. The termination of this Agreement shell not affect the rights or benefits already acquired by the individuals by virtue of this Agreement. 9. This Agreement may be amended by mutual agreement of the Parties through written communications via diplomatic channels. Its entry into force will be in accordance with paragraph 6 of this Arti Done in Placencia, Belize, on December 17, 20:4 in two original copies, in the Spanish and English language, both texts being equally authentic.
