On 12 October 2010, The European Parliament brought an action against the Council of the European Union
to the European Court of Justice for annulment of Regulations 833/2010 and 617/2010 (case C-490/10),
reasoning incorrect legal basis (Article 337 TFEU and 187 EA instead of – as claimed by the EP - Article
194(2) TFEU). There hasn't been any ruling yet and the case is pending.
