TERMS & CONDITIONS

General Terms

1. Applicant agrees that the following terms and conditions apply to all business transactions between ALLWORLD
INTERNATIONAL, INC (“AWI”) ALLWORLD CARGO or ALLWORLD EXPRESS and the Applicant.
2. Applicant agrees that the following terms and conditions shall constitute a contract between AWI and the applicant for all such
business transactions; this is a commercial transaction and not a consumer transaction.
3. All services provided by AWI shall be paid for in accordance with the terms of sale.
4. The undersigned agrees that in the event the account becomes more than thirty (30) days past due they shall accrue a FINANCE
CHARGE of one-and-one-half percent (1.5%) PER MONTH which is an ANNUAL PERCENTAGE RATE of eighteen percent
(18%). Payment received will be applied first to payment of FINANCE CHARGES and then to any outstanding principal amount.
5. The undersigned agrees that if any remittance check to AWI is returned for any reason the undersigned shall pay a handling fee
of $25.00, which shall be added to the account balance; the undersigned agrees to pay any and all collection costs associated
with their delinquent account including reasonable attorneys’ fees.
6. The undersigned acknowledges that all bills submitted shall be considered true and accurate unless the undersigned contests the
accuracy of any such bill by sending written inquiry to AWI.
7. The undersigned warrants and confirms that the undersigned has full legal ownership, title, and/or authority for any goods,
vehicles, or other items (“property”) delivered to the premises of AWI. Any fraudulent packages received will be handed over to
the police for full prosecution.
8. The undersigned acknowledges that title to ownership of any property delivered to the premises of AWI shall not transfer to AWI
unless such transfer is agreed to in writing by both AWI and the undersigned.
9. The undersigned warrants and confirms that any property delivered to the premises of AWI is in full compliance with the relevant
laws of the United Sates of America and the relevant laws of the country of the port of destination.
10. Any property delivered to the premises of AWI shall be kept free of charge for a period of up to 15 days. Storage fees shall apply
for any time period following the initial 15 free days at a rate of $5/$15 per day per cargo/automobile until such property has been
removed from the premises of AWI (non-auto items shall be assessed based on the space occupied relative to standard auto
size). Any vehicles delivered to AWI and subsequently removed from the premises without shipping shall incur a minimum $75
“in-out” charge plus storage fees as calculated in this Section 10; trucks and over-size vehicles shall incur a $100 “in-out” charge
plus storage fees as calculated in this Section 10.
11. No customers, including the Applicant, are allowed in the warehouse/loading area at any time; any customer, including the
Applicant, who fails to adhere to this strict policy do so at his/her own risk and agrees to hold AWI harmless under any and all
circumstances.

Notice of Claim and Time for Suit

12. AWI shall exercise reasonable care to protect the property from theft or damage. AWI shall not be liable for missing items from
packages received via UPS, USPS, FEDEX, DHL or any other carrier. It is not the responsibility of AWI to verify items received
via the carrier’s listed.
13. It is not the responsibility of AWI to track packages received at our facility or to notify you of any packages received. The tracking
of packages is the sole responsibility of the customer. We can charge a reasonable fee for this service if requested by the
customer.
14. AWI shall not be liable for any damage to the property that occurred prior to delivery to the premises of AWI.
15. AWI shall not be held liable for any damages that did not result from AWI’s negligence including whilst in transit on board ground
vehicle, ocean vessel, or air transport.
16. Any claim made by the undersigned for damages to the property must be confirmed immediately at the time of delivery at the
port/airport of delivery including photographic evidence and independent third party verification.
17. Unless written notice of loss or damage, including the specific nature of such loss or damage, is given to AWI before or at the
time of delivery at the port of delivery, the property shall be deemed to have been delivered as described in the Airway Bill/Bill of
Lading.
18. The undersigned acknowledges AWI is not responsible for airline/vessel delays or work stoppage.

Termination

19. AWI reserves the right to terminate this contract at any time.
