Report on the Vetting of Police and Gendarmes


1. Executive Summary
This report is based on the findings from the OHCHR Human Rights Case database, Sage Joint
Operation Centre database, HRDDP files on Cosmos, UNPOL criminal database and the database
of the child protection unit.
2. Information collected
Information collected identified the following allegations of human rights violations. The
information has been divided into two sections (i) specific violations (ii) other recorded violations-
statistics.
i) Specific violations

a. Endjinede Firmin Kisito (Capitain Police)- one case for allegation of cruel inhuman and
degrading treatment & excessive or disproportionate use of force. Incident occurred in
Bria.
b. Koudemon Olivier Arsene (Captain Police, Commandant region militaire No.1)- 9
cases for allegation for threat to physical and mental integrity, death threats, cruel inhuman
and degrading treatment, extrajudicial execution or other killing and excessive or
disproportionate use of Force. Incidents recorded in Bangui.
c. Ndoroma Kothe Olivier (Marechal de Logis)- one case on allegation of sexual violence.
The incident happened when he was in the Brigade Territoriale in Bangassou.
d. Yapende Juldas Edgard Julien (Gendarme de 1ere classe)- one documented allegation of
threat to physical and mental integrity. NB: the incident occurred in Obo, and he is
registered as a FACA de 1ere classe. Important to find out if it is the same person, where
was he deployed in December 2016.
e. Dote Jean Sylvian Delmas (Gendarme de 2eme classe) – a case on allegation of threat to
physical and mental integrity. The incident occurred in Bossangoa.
f. Makavo Eric Victor (Adjudant Chef)- documented case of allegation of corruption and
misappropriation of property. Incident occurred in Bambari.

g. Horo Rufin (Adjudant Chef) - documented allegation of inhuman cruel & degrading
treatment. Incident occurred in Bossangoa.
h. Wedo Guy Arthur (Gardien de la Paix Major)- documented allegation of rape and threat
with a weapon.
i. Lacky Arsene Ghislaine Ovide (Commissaire de Police)- documented allegations of threat
to physical integrity-inhuman and degrading treatment. Incident occurred in Bangui.
j. Zandanga Albert (CPT Police)- documented allegations of threat to physical integrity-
inhuman and degrading treatment. Incident occurred in Bangui.
k. Ghosso Melchissedeck (Gendarme- Marechal de Logis Chef) – documented allegations of
threat to life, excessive use of force and cruel and inhumane treatment. Incidents took place
in Obo. Name not found on the list.
l. Documented allegations of threat to physical integrity-inhuman and degrading treatment
against Malenguiza Edith (Auxiliaire de Police). Incident occurred in Bangui. Name not
found on the list of Police.

ii) Other violations


See below Statistics got from the OHCHR human rights case database from 1 January 2015 to 16
March 2018 of violations committed by Police and Gendarme Units in CAR. 73 % of cases
documented by HRD from 1 January 2015 to 16 March 2018 are on violations concern arbitrary
arrest and detention often involving the absence of guarantee to be charged and brought before a
judge or magistrate in a timely manner.

Remarks
 The HRDDP Secretariat noted that it received names of police or gendarmes who were to
benefit from UN support whose names werenot found on the list for instance NGARO
FELICITE matricule number 05 .10.6548

Recommendations
• Investigations and judicial proceedings initiated for those who allegedly committed
violations.
• Internal Oversights mechanisms should be operationalized throughout CAR as deployment
of ISF unfold.
• The development of a code of conduct for the ISF.
• Engagement with ISF hierarchy and MINUSCA to establish joint monitoring and dialogue
platform which will address reported violations attributable to security forces.

• Continuous capacity building training on international human rights law, international
humanitarian law most especially on arrest and detention, use of fire arms following
international standards.
