Subject: Clarification on the date of commencement of early pension.

Sir/Madam,

Your kind attention is invited to the Head Office Circular No.

Pen/5/6/2001/TN/Main/33598 dated 26.08.2004 on the above subject. In view of
the Judgement of Hon’ble High Court of Orissa in WP C No.12860 of 2006 and
other similar judicial pronouncements it is felt necessary to re-examine the above
Circular to accommodate the interpretation of the Higher Judiciary. Accordingly, it
is decided to modify the above circular to the effect that a member can now
choose ANY DATE from the date following the date of exit from service or
attainment of 50 years, whichever is later, upto the date of attainment of 58
years, as the date of option for the commencement of early pension.

In the absence of any option date, the date of receipt of claim application in
Form 10-D may be taken as option date.
