Sub: The Sexual harassment of Women at the Workpiace (Prevention and
Redressal)
Sir,
This is in continuation of the Office Circular No. Wel, Fund/Women Cell/2005/20936
dated 30,5.2005 on the subject cited , a copy of which alongwith enclosures is enclosed
herewith. in accordance with the guidelines laid down by the Supreme Court in the case of
Vishaka Vs. the State of Rajasthan and others (JT 1997 (7) SC 384), certain administrative
‘measures are required to be implemented which are as under:
i) Constitution of a permanent Internal Complaints Committee in accordance :
with the Supreme Court guidelines.
ji) Visible display of notice prohibiting sexual harassment in all the Offices
Prominent display of the names and contact number of the members of
the Complaints Committee.
Wii) yearly work report to be submitted to the Central Provident Fund
Commissioner from all the Regional Offices Complaints Committees as well
as Head Office complaints committee.
iv) Members of the complaints committees to be trained by the Competent
Gender Sensitive Lawyers in the procedure of handling sexual harassment
cases.
Further as the order dated 26.4.2004 passed by Supreme Court in the case of Medha
Kotwal Lele & Ors. Versus Union of India and Ors, the Complaint Committee referred to abovewill be deemed to be an inauiry authority for the purpose of the Central Civil Services (Conduct)
Rules, 1964 and its report shall be deemed to be an inguiry seport under these rules
Since, the Complaint Committees will be deemed to be an Inquiry. Authority for the
purpose of the Central Civil Services (Conduct) Rules, 1964 and its report shall be deemed to be
an inquiry report under these rules. the members. of the Internal Complaints Committees are
also eligible for Honorarium as ver rule.
All the Regional Provident Fund Commissioners-Incharge of the Regions are reauested to
constitute the Complaints Committee afresh and are requested to take appropriate action on the
above guidelines so as to comply the guidelines of the Hon'ble Susreme Court of India
‘Action on the above lines are expected to be completed by 31.3.2009, A copy of the
action taken in this regard may kindly be endersed to the undersiqned,
