‘230-hectare Busco property exempted from agrarian reform’

a misleading news article about the legitimate ownership
of its 230-hectare sugar milling site in Barangay Butong,
Quezon town. Ironically, the supposed source of the news
article was an association of indigenous people.
In a hand-delivered statement, the Busco Sugar Milling
Company Inc., through its lawyers, reiterated that they
acquired the lot in question through the Asset Privatization
Trust, a government institution mandated to dispose of
sequestered properties of the government.
The sugar company said the lot in question had actually
been foreclosed by the Philippine National Bank from its
previous owner and had been transferred by PNB as a
foreclosed property to the Asset Privatization Trust.
“Busco Sugar Milling Company, Inc. bought [sic] this
230-hectare lot A-1 including improvements from the
Philippine Government in the amount of P730 million. Thus,
a deed of absolute sale was duly executed in favor of (the
company) on May 29, 1989. Consequently, TCT #T-28074 in
the name of Asset Privatization Trust was cancelled and in
its stead TCT #T-28622 was duly issued by the Registry of
Deeds for the Province of Bukidnon on May 31, 1989 in the
name of the (company),” the statement of Soriano, Araña,
Saarenas, and Associate, the company’s legal counsel, reads
in part.

Minor who killed widow faces murder rap

a male teenager who al-
legedly stabbed to death
a 47-year-old widow and
injured her nine-year-old
son in Barangay Zone-2,
this city early this month, a
welfare executive said over
the weekend.
Local DSWD chief
Felomina Navidad, said
Noynoy (not his real name)
is facing charges before the
court for killing Analiza
Cabigas Molde and crit-
ically wounding her son.
The killer, whose name
was withheld, is current-
ly under the custody of
the Department of Social
Welfare and Development,
according to Navidad.
Navidad said Molde
sustained multiple stab
wounds in different parts
of her body, while her son
sustained a fatal wound to
the neck.
Navidad said, the po-
lice immediately arrested
the suspect hours after the
crime was committed since
he lived few meters away
from the crime scene.
Navidad said the social
welfare office has estab-
lished discernment on the
part of the suspect which
prompted them to file the
charges to the court.
While waiting for the
court decision, Navidad
said the suspect was placed
at the halfway home along
with more than 30 other
children being watched
by 12 social workers di-
vided into three eight-hour
shifts.
Navidad said the half-
way home houses children
in conflict with the law
and other special concerns
which are under the super-
vision of DSWD.
“If the court will con-
vict the suspect who is a
minor during the time of
the trial, the verdict will be
suspended until he reaches

legal age,” Navidad ex-
plained.
The suspect will remain
under DSWD until he will
reached 18 years old where
a retrial will be conducted
to determine if he has al-
ready reformed or getting
worse.
Navidad admitted, prior
to the incident the sus-
pect was already reporting
to the DSWD for acts in
conflict with law but he
became more violent.
“We recommended for

the immediate transfer of
the murder suspect to the
rehabilitation center to
avoid the occurrence of
untoward incident inside
the halfway home,” she
said.
She said two murder
charges against minors
were filed awaiting deci-
sion from the court.
“His presence will pose
a threat to them and the
social workers due to the
severity of the crime he
committed,” Navidad said.

themselves from armed
groups and even Moro
secessionist rebels.
The peace and order sit-
uation in the Lanao prov-
inces, he pointed out, was
grim in 2008, when several
Lanao towns were attacked
by rogue elements within

months should not expect
too much.
This was the advice of
Department of Tourism
(DOT-10) Director Marie
Elaine Unchuan, describ-
ing Camiguin, an island
province situated in the
Bohol Sea and about 10
kilometers off the northern
coast of Mindanao, as “laid
back.”
“Camiguin doesn’t
have much in terms of
modern tourist amenities
that Boracay has,” Unch-
uan said, adding that tour-
ists should instead expect
“a laid-back sleepy town
for people who just want

to escape urban life.”
Unchuan issued the
advice following Cami-
guin Rep. Xavier Jesus
Romualdo’s invitation to
both foreign and domestic
tourists, whose bookings
have been cancelled, to
divert to Camiguin instead.
“There are no bars there
(Camiguin), there is some
nightlife but there aren’t
really no DJs (disc jock-
eys) there like we do in
the night circuit here in
(Cagayan de Oro),” Unch-
uan said, referring to this
region’s capital.
In 2017, DOT records
showed that a total of
568,649 tourists visited
Camiguin. This pales in
comparison to the millions
of visitors that Boracay

takes in every year.
Unchuan said Cami-
guin has three resorts ca-
tering to high-end tourists
with a combined total of
less than a hundred rooms.
Combining all other
places to spend for a night
along with home stays, Ca-
miguin can offer as many
as 200 rooms.
However, tourists may
still find the variety of local
and international cuisines
interesting, Unchuan said.
Camiguin has “a lot
of diverse gourmet like
French, Vietnamese and
other specialty restau-
rants,” she added. “And
their hospitality field is
one of the best because all
the resorts’ staff are well-

Duterte rating in Mindanao: ‘Excellent’
DAVAO City — The coun-
try’s first Mindanawon Pres-

Metro Manila” and “good”
in the balance of Luzon,
but nationwide, his rating
dropped two points from
+58 in the last quarter of
2017 to +56 in the first quar-
ter of 2018, the latest Social
Weather Station (SWS) sur-
vey said.
The March 23 to 27 sur-
vey found 70% of adult
Filipinos nationwide satis-
fied with President Rodri-
go Duterte’s performance,
14% dissatisfied and 17%
undecided, giving him a net
satisfaction rating of +56.
In the last quarter of
2017, Duterte received +58
(71% satisfied, 13% dissat-
isfied, 15% undecided).
The SWS terminology
for net satisfaction ratings
is “excellent” for +70 and
above; “very good for +50 to
+69; “good” for +30 to +49.
The SWS said the two-
point drop in President
Duterte’s net satisfaction
rating was due to the decline
of 11 points in the Balance
of Luzon and one point in
Metro Manila, combined
with increases of 12 points
in the Visayas and 2 points
in Mindanao.
Duterte’s satisfaction rat-
ings in March 2018 reflects a
similar trend in pre-election
SWS surveys and net satis-
faction ratings with Mind-
anao giving him the highest
percentage points followed
by Visayas, Metro Manila
and the balance of Luzon at
the bottom.
Duterte received an “ex-
cellent” rating at +82 (87%
satisfied, 5% dissatisfied)
in March 2018, up by two
points, from +80 (84% sat-
isfied, 5% dissatisfied) in
December 2017.
Mindanao has consis-
tently given Duterte the
highest ratings nationwide
since he assumed the post of
President on June 30, 2016.
Dissatisfaction in the
balance of Luzon, however,
is growing, from 14% in
December 2017 to 19% in

ADB economist says PH trade deficit a sign of growing domestic demand

Development Bank (ADB) on
Wednesday said the Philippines’
trade deficit was not alarming
but an indicator of growing do-
mestic demand.
“The country is running a
trade deficit and it is not alarm-
ing. It is not a sign of over con-
sumption, it is not a sign of over
investment, over spending of
the country. It is a sign of grow-

etary Fund (IMF) on Tuesday
warned that synchronized in-
creases in house prices around
the world would heighten the
risks of economic slowdown.
The latest IMF study found
that house prices move in tan-
dem across countries and ma-
mist for the Philippines at ADB,
said in a press briefing.
Chongvilaivan explained
there has been a slowdown in
Philippine export growth this
year given the high base ef-
fect after exports accelerated in
2017.

growth is mainly driven by

2017.

been driving the country’s con-
sistent GDP expansion for the
past several years and is expected
to be sustained up to 2019.

guess, if I make up my mind, I may run
as an independent candidate come May
14 which, by the way, ought to be the
case for all candidates in the barangay

Friends here in Consolacion told me
to push through even if I wasn’t in any
slate. They said that if I decide to run,
they’ll campaign for me in their respec-
tive communities within the barangay.
It might be an even steeper uphill climb
for me but I may need to still push on
through, they said.
Last week, a complete slate of
candidates went house-to-house around
the barangay shaking people’s hands,
and introduced themselves as candi-
dates. Now, I wouldn’t know if that
is considered premature campaigning
since I didn’t know if they already filed
their candidacy. That is the loophole.
How can one campaign prematurely if
they aren’t candidates yet? Anyway, a

The phrase, “a kind of maximum
decentralization, short of federaliza-
tion”, is how local autonomy under the
1987 Constitution must be understood.
This means the current local autonomy
framework established in Article X al-
ready has federal features. I am referring
to the revenue-raising power sections
(5, 6 and 7) and the “consolidation of
efforts” sections (13 and 14).
But the non-federalist aspect of these
provisions is represented by the fact that
these prescriptions are not immediately
enforceable. To be implemented, they
either need an enabling law or the initia-
tive of the President.
Indeed, Section 3 provides that,
“Congress shall enact a local govern-
ment code which shall provide for a
more responsive and accountable local
government structure instituted through
a system of decentralization.”
Pertinently, according to the Supreme
Court, “Autonomy, in the constitution-
al sense, is subject to the guiding star,
though not control, of the legislature,
albeit the legislative responsibility under
the Constitution and as the ‘supervision
clause’ itself suggest-is to wean local
government units from over-dependence

I am very liberal in the belief of my
family. My wife is a Catholic. She goes
to church as often as possible and do
penance sometimes. I am a Protestant
by baptism in the river. All my children
were baptized in a Catholic church. My
two kids from my second wife grew up
with their cousins in Gospel Church and
opted to be baptized again in a Protes-
tant Church. I told them, “Do that when

THE Sustainable Rice Platform (SRP) is
a global initiative to ensure the continu-
ing supply of rice worldwide forever,
so to speak. What
is unique about the
platform is that they
are purposely bringing
together all the players
in the rice supply chain,
meaning to say not
only the producers
and the consumers, Ike Señeres
but also the research-
ers, the traders and the advocates of this
particular cause. As I see it, this is the
way how it should be done, this way
of doing it through the supply chain
approach, and coupling it with a holistic
framework. Having liked this approach
and framework so much, I decided to
create a pneumonic device for it. The
device is an acronym for consumers,
organizations, producers, policy makers,
entrepreneurs, researchers and societies
(Coppers).
To some extent, I actually took some
poetic license in creating the pneumonic
device, because “organizations” would
mean non-government organizations
(NGOs), entrepreneurs would mean
businessmen in general and traders in
particular, and societies would mean
“civil society”, inclusive of all advo-
cates and activists, so to speak. There
might be some redundancies here be-
cause many NGOs are also civil society
players, but never mind that, because it
is better to have all bases covered. What
is important here is that all players are
included, meaning to say that no one
is left out. By the way, for purposes of
this pneumonic device, “policy mak-
ers” would include both the Legislative
Branch and the Executive Branch.
Don’t get me wrong, because as I see
it, the Coppers device could also be used
for all aspects of human life in general,
and for all aspects of good governance
in particular, meaning to say that it is not
just for rice sustainability. What is im-
portant to note here is that governance is
a two-sided process that should include
not only the structured government,
but also the governed, the people who
are represented by the civil society. As
simple as it sounds, it should be made
clear that the basic premise here is that
both sides of the governance equation
are talking to each other, in other words
they are coordinating and communicat-
ing. In much simpler terms, that should
mean that they are always meeting,
either online or in person.
In a manner of speaking, it could
be said that the people who are using
social networking sites and mobile apps
are actually always meeting with each
other, either via chat, video confer-
ences, instant messaging, net meetings
or whatever you might want to call it.
For all intents and purposes, it could be
said that what used to be called “tele-
conferences” could now also be done
via online and mobile means, in means
that are better and cheaper, perhaps even
faster. In other words, to cut a long story
short, several online and mobile means
are now available for the government
and the people to virtually meet either
jointly or severally, the latter should be
interpreted to mean one side meeting on
their own.
Believe it or not, there are existing
mechanisms where the government and
the people could meet in person, and
these mechanisms are even backed up

enactment of the Local Gov-
ernment Code of 1991. And
this provision, which requires
a local government code to
establish a system of decen-
tralization, is the very reason
why our local autonomy
framework is not federal.
According to Ronald
Watts, considered as the
preeminent authority on fed-
eralism, “The key is not the
degree of decentralization,
but the degree of constitu-
tionally guaranteed autono-
my that the constituent units
may exercise.”
Therefore, in designing
the federal set-up for the Phil-
ippines, the autonomy of the
regional government must be
self-evident in the new feder-
al charter. We do not want a
repeat of the, “a kind of max-
imum decentralization, short
of federalization”, structure
in the 1987 Constitution.
Simply put, there should be
no need for an enabling law
to operationalize the federal
system.
Moreover, for the federal
system to work the regional
government structure itself
must be configured to facil-
itate a community-oriented
governance mindset. Perti-
nently, a regional govern-
ment framework meeting
this requirement is found in
the proposed Bangsamoro
Basic Law.
Accordingly, the region-
al governance structure in
the new federal constitution
must be parliamentary with
members elected through
single-member legislative
districts and through polit-
ical party representation.
The chief executive of the
regional government shall
then be elected by the region-
al parliament from its ranks.
Members of the region-
al executive cabinet shall
also be members of the re-
gional parliament. Howev-
er, non-members may be
designated to a cabinet post
subject to confirmation by the
regional parliament.
One necessary change
that must be made here is
to remove the supervisory
power of the president over
the regional executive and
over local government units.
This institutional link under-
mines the autonomy of the
subnational level of govern-
ment. Indeed, it is a peculiar
facet of a presidential-unitary
structure and has no place in
a federal system.
Note however that the re-
gional parliament shall func-
tion as the check and balance
mechanism to the regional
executive. Moreover, it must
have oversight functions
over local government units
within the region.
Most important of all, the
principle of subsidiarity must
be self-evident in the federal
charter itself. But simply
defining this principle in the
constitution will not suffice.
This must be expressed in
constitutional language as
immediately enforceable. For
example, in the Constitution
of the Swiss Confederation,
Article 3: “The cantons are
sovereign insofar as their
sovereignty is not limited
by the federal constitution;
they exercise all rights not
transferred to the federation.”
The Australian Constitu-
tion, particularly in Chapter
V—The States, 107. Sav-
ing of power of State Par-
liaments, provides: “Every
power of the Parliament of a
Colony which has become or
becomes a State, shall, unless
it is by this Constitution ex-
clusively vested in the Parlia-
ment of the Commonwealth
or withdrawn from the Par-
liament of the State, continue
as at the establishment of the
Commonwealth, or as at the
admission or establishment
of the State, as the case may
be..”
These are examples of
federal constitutions and
clearly, they limit the powers
and functions of the national
government. A charter es-
tablishing a unitary structure
would be the exact opposite
because the central govern-
ment primarily holds state
power and merely devolves
some functions to the subna-
tional level government. This
is our current governance
framework. A federal consti-
tution for us should therefore
have this provision clearly
stipulated:
“Regions shall enjoy
full autonomy subject only
to limitations set forth in
the federal constitution and
shall exercise all powers
not vested on the national
government.”
To conclude, we must
remember that if the goal of
charter change is to establish
a federal system, then the
new charter must not be
a substantial carbon copy
Article X of the 1987 Con-
stitution.
Constitutional reform
must result to the improve-
ment of the current system.
If the same ill-designed in-
stitutions and mechanism are
retained, then the entire pro-
cess would be all for nothing.

THE Asia Pacific Economic Co-
operation (APEC) Business Advi-
sory Council (ABAC) Philippines
has set out to craft a digital inno-
vation roadmap for the country,
saying this is an area that must be
given priority.
ABAC Philippines said in a
statement Monday that it is in the
process of organizing a public-pri-
vate sector task force to formulate
the digital innovation roadmap.
The group said that the en-
visioned roadmap should to be
linked to government policies, the
educational system, and training
programs.
This initiative is ABAC Phil-
ippines’ contribution to APEC’s
goal of promoting economic
growth and inclusive growth in
the region.
“Digital innovation will bring
us to the future. However, many
of the jobs we have today will dis-
appear 20 years from now. What
are the skills and the competen-
cies that a Filipino worker must
have to ‘survive’ in the future?
What kind of educational system
will we need to prepare our chil-
dren? These are critical questions
that must be answered to ensure
that the Philippines will not be left
behind,” ABAC Philippines Chair
Tomas Alcantara said.
ABAC noted a study by inter-
national consulting firm McKin-
sey indicating that 48 percent of
jobs in the Philippines could be

than 4,791 sugar planters, more than 85% of whom are small
landowners, and 712 contractors. At least 30,000 people are
employed and have benefited by the utilization of the property
by the sugar company as its sugar milling site.
Busco Sugar Milling Company, Inc. expressed grave
concerns on the massive unemployment and economic
dislocations of the constituents of Bukidnon, who are dependent
in their livelihood and means of living through the mill site could
produce ghastly effects and hardships.

whose very existence are even doubtful, at the expense of

be meeting regularly, as
provided for in the Local
Government Code (LGC).
As it is supposed to be, all
the regional directors are
supposed to be attending
the RDC meetings, but they
are apparently not coordi-
nating and communicating
with each other about what
they should discuss in those
meetings. As a remedy to
that shortcoming, I propose
the creation of the Alliance
of Coordinating Councils
for Organized Regional
Development (Accord).
As implied in the name, all
regional directors should
create their own coordinat-
ing councils for their own
areas of concern, before they
move up to the Accord level.
Accord should be good
enough for the coordination
of the government at the
regional level, but aside from
that, we also need coordina-
tion among the people at the
regional level. Towards that
end, I propose the creation
of the Federation of Citizens
and Leaders (Focal). This
could be used as the forum for
bringing together the agendas
of all NGOs and Civil Society
Organizations (CSOs) at the
regional level. As provided
for in the LGC however, the
RDC is supposed to be the
apex of lower development
councils at the barangay and
municipal levels. It goes with-
out saying therefore that both
Accord and Focal should also
have people at the local levels.
As it is supposed to be, all the
actions of the RDCs should be
coordinated by the National
Economic Development Au-
thority (Neda).
For whatever it is worth,
it could be said that both Ac-
cord and Focal could conduct
their meetings via online and
mobile means. First of all
however, they should know
each other and more import-
ant than that, they should be
able to contact each other.
In this connection, CCS, a
