ANNEX “A”

MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (“Agreement,” for brevity) entered into this 15th of
February 2017, by and between:

USST COLLEGES, INC., a non-stock, non-profit educational institution with SEC


Registration No. AN094004107, duly represented by its Officer-in-charge of Criminology, Mr. Ricardo S
Mariano and School Administrator, Renato B Alonzo, Jr, with office address at USST Colleges, San
Isidro, Tarlac City and hereinafter referred to as the “First Party”;

-and-

BARANGAY COUNCIL OF STO. ROSARIO, a public institution, with address at Capas,


Tarlac, represented by its Chairman, Solomon Sicat, hereinafter referred to as the “Second Party”.

WITNESS THAT:

WHEREAS, the First Party recognizes the limitations of theoretical or classroom instruction in
providing its B.S. Criminology students with the necessary training and development essential to their
careers;

WHEREAS, the First Party is cognizant of the importance of supplementing theoretical


training and instruction with actual practice and hands-on experience;

WHEREAS, it is to the advantage of the graduating students of the First Party to undergo on–
the–job training from a barangay hall such as the Second Party and for which reason this Agreement is
entered into;

WHEREAS, the First Party seeks the aid of the Second Party in helping it provide its B.S
Criminology Interns with a complete learning experience so as to enhance their training and
development as future law enforcement authorities;

NOW, in view of the foregoing premises, USST Colleges, Inc., and the Barangay Council of
Labney hereby agree on the following terms and conditions.

A. COMMITMENTS

The First Party shall:

1. Be responsible for the overall management of its Criminology Interns undergoing their On–
the–Job Training (OJT);
2. Allocate funds for its on–site supervisor for inspection purposes;
3. Provide a practicum instructor to be in charge of its Criminology interns prior to and during the
actual OJT;
4. Conduct inspection and monitoring of the trainees on any day between Monday to Friday,
anytime from 8 am to 5 pm through its coordinators;
5. Provide training materials such as kits, hand-outs, and other instructional materials to its B.S
Criminology Interns;
6. Monitor the compliance of the undertakings stated in this Agreement; and
7. At the start of the internship, provide the Performance Evaluation Sheet (PES) to be
accomplished by the “Second Party”.
The Second Party shall:

1. Provide technical assistance and instruction to the B.S Criminology Interns for them to acquire
the skills essential in the day–to–day operations of a Barangay Hall especially in terms of settling
disputes;
2. Train, expose and assist the Interns in conducting patrol, investigation, security, and other related
work within the vicinity of the barangay;
3. Provide and distribute copies of training materials such as hand-outs and other reading materials
to the Criminology Interns;
4. Facilitate the coordination between the interns and its security complement for the duration of
the internship;
5. Ensure the personal safety of the interns within the vicinity of the barangay hall for the duration
of the internship;
6. Submit periodic reports to USST Colleges regarding the performance of its interns through the
USST’s designated practicum instructors; and,
7. Accomplish fully the Performance Evaluation Sheets, folded and sealed, to be provided by the
First Party through the interns’ Team Leader.

B. PROVISIONS COMMON TO BOTH PARTIES

 The internship shall be at no cost to either party, other than minimal expenses to cover food and
transportation, which shall, in any case, be borne respectively by each party; and
 It shall be understood that this Agreement does not in any way create an employer-employee
relationship between the Second Party and its representatives and the interns of the First Party.

C. AMENDMENT

The parties hereto may, with mutual consent, amend or modify this Agreement through an
addendum/amendment duly signed by them any time before the expiration of this Agreement.

D. EFFECTIVITY

This Agreement shall take effect upon its signing by both parties and shall remain in force and in effect
until ___ days after the last day of the internship, unless sooner terminated for cause, in which case a
written notice to the other party shall be served at least seven (7) calendar days prior to date of
termination.

IN WITNESS WHEREOF, the parties have set their hands, this ___________________ at Tarlac
