Re: Risk of Death to Pod-Sitter

To: Mr. Joby P. Timm

We have not heard back from you regarding our April 8, 2018 request. We are concerned
currently about the immediate danger to the pod-sitter on Pocohantas Road which we mentioned in our
letter. We believe she has been without food or water for close to 30 days due to the actions of the Forest
Service.

By denying others the ability to feed the pod-sitter, the Forest Service has created a duty for itself
to protect her health and safety. See Deshaney v. Winnebago County Dept. of Social Services, 489 U.S. 189
(1989).

The Forest Service may claim that the pod-sitter has the volition to climb down, receive food and
be arrested. But, at this point, no agency nor independent inspector, has ascertained the health and
cognizant status of the pod-sitter. No one knows, whether she has the strength or volition to leave the
pod. If she cannot do so, the Forest Service’s actions in continuing to starve her out are tantamount to
torture and contrary to human rights and International Law.

Mr. Timm, you have a duty to protect the health and welfare of United States Citizens. The death
or significant injury to the pod-sitter will be on your shoulders should that transpire.
