Subject: Regarding the Hamad Matter
as
Good morning,
Nothing is more important than the safety and well-being of our students and our campus
community. To that end, I want to begin by stating that I fully support Provost Sue
Mattison in her handling of the Professor Hamad matter. From the moment she received
the allegation against Professor Hamad in May of 2017, Provost Mattison has acted in the
best interest of our students - which is always her driving motivation. She did a
remarkable job of bringing the matter to a conclusion that respected and protected the
interests of our students and other members of our community. Sue Mattison is an
outstanding Provost for Drake University and she has my unwavering confidence.
Many of you have expressed frustration regarding a lack of information surrounding
Professor Hamad’s departure. I fully understand this frustration and appreciate that some
of you are even angry at not being told more, However, neither Provost Mattison nor I can
publically share all of the details regarding this matter. Provost Mattison has previously
released what can be shared: following a thorough investigation of the allegations against
him, in December Professor Hamad resigned from Drake effective June 1 and he did not
have any assigned teaching duties this spring. To share any more details could put the
resolution of this matter in jeopardy.
There has been reporting that has criticized the “administration” for not firing Professor
Hamad. In light of this, itis important to note that the University's governance policies do
not allow the summary termination of employment of any tenured faculty member.
1Pursuant to the University's Faculty Manual and Academic Charter, the only two options
for securing the removal of a tenured faculty member on conduct grounds are resignation
ora referral of the matter to a faculty disciplinary committee. In the event of referral to a
disciplinary committee, the faculty member can demand a hearing that could include the
examination and cross-examination of witnesses, the receipt of additional forms of
evidence, and opening and closing statements from the faculty member or his/her
counsel, A recommendation to remove the faculty member from employment would be
forwarded to the Drake University Board of Trustees for its review and action. The Board
could decide, among other things, to hold a second hearing or to refer the matter back to
the disciplinary committee for further consideration, This process would undoubtedly be
a protracted and stressful experience for those involved. Provost Mattison was balancing
all of this in reaching a resolution in Professor Hamad’s case.
I strongly encourage any student who is facing difficulty because of their experience with
Professor Hamad to get in touch with me, Provost Mattison, Dean Parker, ora trusted
faculty or staff member. We are here to help you in any way we can.
Sincerely,
Marty
PS. In the event some of you have not seen this, here is a statement released this weekend
by David Courard-Hauri, Faculty Senate President, and Renee Cramer, Faculty Senate
President Elect:
We, the current and incoming president of the Faculty Senate at Drake University are
{fully aware of the investigation, the findings, and the terms of the settlement regarding
Mahmoud Hamad. We condemn his actions, and applaud the University’s proactive
treatment of the allegations from students, received officially in May 2017. In our
2reading of the materials, the university has acted appropriately since receiving the
complaint, to protect students’ identities and well-being and effectuate Hamad's
departure from campus. We believe the terms of the separation agreement and the
outcome of the investigation serve our students and our community. We are
concerned that recent reporting mischaracterizes the process and outcome, and has
the potential to do harm to alumni and current students. We are confident that
students who report sexual misconduct or assault on campus will not be met with
retaliation and will receive support.
Sincerely,
David Courard-Hauri, Faculty Senate President
Renee Cramer, Faculty Senate President Elect
