Dear Mr. Harkness:

On December 1, 2016 I notified you and The Florida Bar: “I request Heidi Brewer be removed
from all matters I have before The Bar, including RFA 17-7301 for Wilson.” Ms. Brewer’s
misconduct was the basis for requesting she be removed from all matters I have before The Bar.

On December 15, 2016 I notified you and The Florida Bar: “I request Heidi Brewer be removed
from all matters I have before The Bar, including RFA 17-7301 for Wilson.”. Ms. Brewer’s
misconduct was the basis for requesting she be removed from all matters I have before The Bar.

Unfortunately you and The Florida Bar failed to remove Ms. Brewer from all my matters.

Enclosed/attached you will find Ms. Brewer’s correspondence to me dated January 10, 2017,
sent through the U.S. mail, Re: Curtis Alan Wilson; The Florida Bar File No. 2017-30,550 (9D).

Brewer’s correspondence to me of January 10, 2017 is being returned to you c/o The Florida
Bar. Given Brewer’s documented harassment toward me since November 29, 2017, I have no
confidence in her investigation Re: Curtis Alan Wilson; TFB File No. 2017-30,550 (9D).

Since you and The Florida Bar refuse to remove Ms. Brewer from all my matters, I am
requesting outside assistance, and temporarily withdrawing my complaint against Mr. Wilson.
Instead, I will provide complaints directly to the Supreme Court, c/o Justice C. Alan Lawson,
who may be the last Justice standing when this is over.

The Florida Supreme Court has exclusive jurisdiction to regulate the discipline of persons
admitted to the practice of law. Article V, Section 15, of the Florida Constitution states,

SECTION 15. Attorneys; admission and discipline.—The supreme court shall have
exclusive jurisdiction to regulate the admission of persons to the practice of law and the
discipline of persons admitted.

The Florida Bar is NOT the Supreme Court of Florida. The Florida Bar is not part of the
government of Florida. The Florida Bar is a private, unincorporated association, a private trade
association of lawyers. There is no provision in Article V, Section 1 for The Bar. Oddly there is
no jurisdiction under Article V, Section 3(b) “to regulate the admission of persons to the practice
of law and the discipline of persons admitted.” There is no provision in the Florida Statutes for
The Bar. The Bar does not appear on The Florida Electorate, a government organization chart.

It appears The Florida Bar has usurped power in Florida, and in the U.S. Eleventh Circuit, in
violation of 18 USC §§ 241 and 242, resulting in Honest Services Fraud, 18 USC § 1346.

1. The Public Service Commission is an arm of the legislative branch of government (s. 350.001, Florida Statutes).
2. The Administration Commission and the Land and Water Adjudicatory Commission are composed of the Governor and the Cabinet (ss. 14.202 and 380.07, Florida Statutes).
3. Chapter 2014-191, Laws of Florida, renamed the Parole Commission as the Florida Commission on Offender Review.
4. The Commissioner of Agriculture is not a member of the State Board of Administration (Article IV, Section 4.(e), Constitution of the State of Florida).
5. Chapter 2014-221, Laws of Florida, created the Agency for State Technology within the Department of Management Services. The agency is a separate budget program and is not
subject to control, supervision, or direction by the Department of Management Services.
6. The Division of Administrative Hearings is created as a division of the Department of Management Services, but the director/chief administrative law judge, who is appointed by the

NOTICE OF GRIEVANCE PROCEDURES

1. The enclosed letter is an informal inquiry. Your response is required under the
provisions of The Rules Regulating The Florida Bar 4 8.4(g), Rules of Professional Conduct.
Failure to provide a written response to this complaint is in itself a violation of Rule 4 8.4(g). If
you do not respond, the matter will be forwarded to the grievance committee for disposition in
accordance with Rule 3-7.3 of the Rules of Discipline.

2. Many complaints considered first by staff counsel are not forwarded to a grievance
committee, as they do not involve violations of the Rules of Professional Conduct justifying
disciplinary action.

3. "Pursuant to Rule 3-7. 1(a), Rules of Discipline, any response by you in these proceedings
shall become part of the public record of this nlatter and thereby become accessible to the public
upon the closure of the case by Bar counselor upon a finding of no probable cause, probable
cause, minor misconduct, or recommendation of diversion. Disclosure during the pendency of
an investigation may be made only as to status if a specific inquiry concerning tllis case is made

4. The grievance conlffiittee is the Bar's "grand jury." Its function and procedure are set
forth in Rule 3-7.4. Proceedings before the grievance committee, for the most part, are non­

5. If the grievance committee finds probable cause, formal adversarial proceedings, which
ordinarily lead to disposition by the Supreme Court of Florida, will be commenced under 3-7.6,

This is a complaint against Curtis Allen Wilson, FL Bar ID 77669. Article V, Section 15 of the
Florida Constitution states,

SECTION 15. Attorneys; admission and discipline.—The supreme court shall have
exclusive jurisdiction to regulate the admission of persons to the practice of law and the
discipline of persons admitted.

The Florida Bar receives discipline complaints on behalf of the Supreme Court of Florida.

Curtis Allen Wilson, FL Bar ID 77669, is a Florida licensed lawyer who represents Reverse
Mortgage Solutions, Inc., in a foreclosure action on my Florida residential homestead on a
federal Home Equity Conversion Mortgage, called a HECM, or “reverse” mortgage.

Reverse Mortgage Solutions, Inc. vs. Neil J. Gillespie, et al, Case 2013-CA-00115, Marion
County Florida, Fifth Judicial Circuit. Circuit Judge ANN MELINDA CRAGGS presiding.

Danielle Nicole Parsons, FL Bar ID 29364, formerly of McCalla Raymer LLC, commenced the
foreclosure in January 2013 by filing a Verified Complaint To Foreclose Home Equity
Conversion Mortgage, and, inter alia, a Civil Cover Sheet, Form 1.997, see enclosed.

Ms. Parsons indicated on the Civil Cover Sheet, and certified by her signature, the following:

FORM 1.997. INSTRUCTIONS FOR ATTORNEYS COMPLETING CIVIL COVER SHEET

The instructions for Form 1.997 clearly delineate between a commercial foreclosure and
homestead residential foreclosure:

(R) Commercial foreclosure — all matters relating to the termination of a business


owner’s interest in commercial property by a lender to gain title or force a sale to satisfy
the unpaid debt secured by the property. Check the category that includes the estimate of
the amount in controversy of the claim (section 28.241, Florida Statutes).

(S) Homestead residential foreclosure — all matters relating to the termination of a


residential property owner’s interest by a lender to gain title or force a sale to satisfy the
unpaid debt secured by the property where the property has been granted a homestead
exemption. Check the category that includes the estimate of the amount in controversy of
the claim (section 28.241, Florida Statutes).

Mr. Wilson gave notice of change of responsible attorney for plaintiff and designation of email
address for service of papers in this case on November 10, 2014, copy enclosed.

Mr. Wilson knows this is a homestead residential foreclosure, not a commercial foreclosure.

Mr. Wilson litigated the case anyway. Mr. Wilson violated his Oath of Attorney, the Creed of
Professionalism, the ABOTA Code, and the following Rules Regulating The Florida Bar:

Rule 4-3.1 Meritorious Claims And Contentions. A lawyer shall not bring or defend a
proceeding, or assert or controvert an issue therein, unless there is a basis in law and fact for
doing so that is not frivolous, which includes a good faith argument for an extension,
modification, or reversal of existing law...

Rule 4-3.2 Expediting Litigation. A lawyer shall make reasonable efforts to expedite litigation
consistent with the interests of the client.

Rule 4-3.3 Candor Toward The Tribunal.


(a) False Evidence; Duty to Disclose. A lawyer shall not knowingly:
(1) make a false statement of fact or law to a tribunal or fail to correct a false statement of
material fact or law previously made to the tribunal by the lawyer;
(2) fail to disclose a material fact to a tribunal when disclosure is necessary to avoid
assisting a criminal or fraudulent act by the client;
(3) fail to disclose to the tribunal legal authority in the controlling jurisdiction known to
the lawyer to be directly adverse to the position of the client and not disclosed by
opposing counsel; or
(4) offer evidence that the lawyer knows to be false. A lawyer may not offer testimony
that the lawyer knows to be false in the form of a narrative unless so ordered by the
tribunal. If a lawyer, the lawyer’s client, or a witness called by the lawyer has offered
material evidence and the lawyer comes to know of its falsity, the lawyer shall take
reasonable remedial measures including, if necessary, disclosure to the tribunal. A lawyer
may refuse to offer evidence that the lawyer reasonably believes is false.

(b) Criminal or Fraudulent Conduct. A lawyer who represents a client in an adjudicative


proceeding and who knows that a person intends to engage, is engaging, or has engaged in
criminal or fraudulent conduct related to the proceeding shall take reasonable remedial measures,
including, if necessary, disclosure to the tribunal.

(d) Extent of Lawyer's Duties. The duties stated in this rule continue beyond the conclusion of
the proceeding and apply even if compliance requires disclosure of information otherwise
protected by rule 4-1.6.

Rule 4-1.2(d) prohibits the lawyer from assisting a client in conduct that the lawyer knows or
reasonably should know is criminal or fraudulent.

Rule 4-3.4(b) prohibits a lawyer from fabricating evidence or assisting a witness to testify
falsely.

Rule 4-8.4(a) prohibits the lawyer from violating the Rules of Professional Conduct or
knowingly assisting another to do so.

Rule 4-8.4(b) prohibits a lawyer from committing a criminal act that reflects adversely on the
lawyer's honesty, trustworthiness, or fitness as a lawyer.

Rule 4-8.4(c) prohibits a lawyer from engaging in conduct involving dishonesty, fraud, deceit, or
misrepresentation.

Rule 4-8.4(d) prohibits a lawyer from engaging in conduct that is prejudicial to the
administration of justice.

Rule 4-8.3(a) Reporting Misconduct of Other Lawyers. (Ms. Parsons, Mr. Allgood) A lawyer
who knows that another lawyer has committed a violation of the Rules of Professional Conduct
that raises a substantial question as to that lawyer's honesty, trustworthiness, or fitness as a
lawyer in other respects shall inform the appropriate professional authority.

Rule 4-8.3(b) Reporting Misconduct of Judges. (Judge Stancil; Judge Craiggs) A lawyer who
knows that a judge has committed a violation of applicable rules of judicial conduct that raises a
substantial question as to the judge's fitness for office shall inform the appropriate authority.

Rule 4-1.6(b) requires a lawyer to reveal information to the extent the lawyer reasonably
believes necessary to prevent a client from committing a crime.

This rule, 4-3.3(a)(2), requires a lawyer to reveal a material fact to the tribunal when disclosure
is necessary to avoid assisting a criminal or fraudulent act by the client, and 4-3.3(a)(4) prohibits
a lawyer from offering false evidence and requires the lawyer to take reasonable remedial
measures when false material evidence has been offered.

Rule 4-1.16 prohibits a lawyer from representing a client if the representation will result in a
violation of the Rules of Professional Conduct or law and permits the lawyer to withdraw from
representation if the client persists in a course of action that the lawyer reasonably believes is
criminal or fraudulent or repugnant or imprudent. Rule 4-1.16(c) recognizes that notwithstanding
good cause for terminating representation of a client, a lawyer is obliged to continue
representation if so ordered by a tribunal.

To permit or assist a client or other witness to testify falsely is prohibited by section 837.02,
Florida Statutes (1991), which makes perjury in an official proceeding a felony, and by section
777.011, Florida Statutes (1991), which proscribes aiding, abetting, or counseling commission of
a felony.

Florida caselaw prohibits lawyers from presenting false testimony or evidence. Kneale v.
Williams, 30 So. 2d 284 (Fla. 1947), states that perpetration of a fraud is outside the scope of the
professional duty of an attorney and no privilege attaches to communication between an attorney
and a client with respect to transactions constituting the making of a false claim or the
perpetration of a fraud. Dodd v. The Florida Bar, 118 So. 2d 17 (Fla. 1960), reminds us that "the
courts are . . . dependent on members of the bar to . . . present the true facts of each cause . . . to
enable the judge or the jury to [decide the facts] to which the law may be applied. When an
attorney . . . allows false testimony . . . [the attorney] . . . makes it impossible for the scales [of
justice] to balance." See The Fla. Bar v. Agar, 394 So. 2d 405 (Fla. 1981), and The Fla. Bar v.
Simons, 391 So. 2d 684 (Fla. 1980).

course of the attorney's relations as an attorney or otherwise, whether committed within
or outside the state of Florida, and whether or not the act is a felony or misdemeanor,
may constitute a cause for discipline.

Notice: A tax lien can be Imposed on your property pursuant to 196.161, Florida Statutes.

Section 196.161 (1) provides:

(1) (a) "When the estate of any person is being probated or administered in

another state under an allegation that such person was a resident of that state and the

estate of such person contains real property situate in this state upon which

homestead exemption has been allowed pursuant to s. 196.031 for any year or years

within 10 years immediately prior to the deathof the dec~ased,

after the death of such person the property appraiser of the county where the real

property is located shall, upon knowledge of such fact, record a notice of tax lien

against the property among the public records of that county, and the property shall be

subject to the payment of all taxes exempt thereunder, a penalty of 50 percent of the

unpaid taxes for each year, plus 15 percent interest per year, unless the circuit court

having jurisdiction over the ancillary administration in this state, determines that the

decedent was a permanent resident of this state during the year or years an

exemption was allowed, whereupon the lien shall not be filed or, if filed, shall be

canceled of record by the property appraiser of the county where the real estate is

located. (b) In addition, upon determination by the property appraiser that for any

year or years within the prior 10 years a person who was not entitled to a homestead

exemption was granted a homestead exemption from ad valorem taxes, it shall be the

duty of the property appraiser making such determination to serve upon the owner a

notice of intent to record in the public records of the county a notice of tax lien against

any property owned by that person in the county, and such property shall be identified

in the notice of tax lien. Such property which is situated in this state shall be subject to

the taxes exempted thereby, plus a penalty of 50 percent of the unpaid taxes for each

year and 15 percent interest per annum. However, if a homestead exemption is

improperly granted as a result of a clerical mistake or omission by the property

appraiser, the person improperly receiving the exemption shall not be assessed

penalty and interest. Before any such lien may be filed, the owner so notified must be

given 30 days to pay the taxes, penalties, and interest.
