Introduction

“Be peaceful, be courteous, obey the law, respect everyone; but if someone puts his hand on you,
send him to the cemetery” (Malcolm X)

A contract is a legally compulsory or lawful agreement between two parties The law will consider
an agreement to be substantial if the agreement contains the greater part of the components, for
example, offer and acknowledgment, an expectation between the parties to make restricting
relations, thought to be paid for the guarantee made, legitimate limit of the parties to act etc.

business contract creates certain responsibilities that are to be fulfilled by the parties who entered
into the contract. (Crucitti, 2015) Legally, one party's failure to fulfill any of its contractual duties
is called a breach of the contract. Breach of contract is a contract broke by the party, limiting from
failure to fulfill any term of a contract without a admissible, legal excuse. (GERALD, 2002) A
breach of contract might occur when a worker refuses to complete his/her job or when an employee
does anything which prevents him/her by his job in a contract; or even when a customer prevents
the contractor from filling the commitment or finishing the project at hand When a person fails to
perform on time, does not perform according to the firm requirements and rules mentioned in the
contract

Breach of contract allows for suing for damages arising from the breach. Where the owner can
sue the person for his damages and consequences caused.

In this case, Laila a hair dresser in mas LTD, which is a hair dressing saloon. The employment
contract of Laila stated that Laila cannot work with any competitive or similar saloon within half
a mile from Max’s enterprise. The contract was valid for 12 months or for one year. Laila was
fired by Max for valid reason and a week later she was employed by another saloon which is only
two doors away from MAXs saloon. Max decides to sue Laila for the breach of contract. We as a
plaintiff wants to sue Laila for the breach of contract and want to give penalty for the consequences
caused.
