DEFENDANT

I, ANTONIO BONIFACIO, of legal age, married, and living at 63 ABC St., Pasay
City, defendant in this case, after having been duly sworn, hereby attests that:

PRELIMINARY STATEMENT

The person examining me is Atty. Cesar Hidalgo with office address at 980
Singkamas St., Pasay City. The examination is being held at the same address. I am
answering his questions fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of defendant ANTONIO BONIFACIO is being offered

to prove that defendant’s first marriage contracted on January 18, 2009 with JUANA
SANTOS (Juana Bonifacio in the complaint), has been legally dissolved as evidenced by
the Divorce Decree issued by the California Court of Justice on November 15, 2012
(Exhibit “3”) and that the second marriage contracted with plaintiff LUNA BONIFACIO on
June 12, 2014, is consequently not bigamous and is therefore VALID.

A. ANTONIO BONIFACIO.

2. Q. Are you the same ANTONIO BONIFACIO, the defendant in this case?
A. Yes sir.

3. Q. Do you know a certain LUNA BONIFACIO?

 A. Yes sir. She is my wife, the woman I married on June 12, 2014.

6. Q. Do you have of proof your marriage with LUNA BONIFACIO?

A. Yes sir, I have a NSO Certified marriage contract as my Exhibit “1"

9. Q. How about a certain JUANA SANTOS do you know her?

A. Yes sir, she is my ex-wife.

10. Q. Where did you meet JUANA?

A. We were co-workers when I worked as a teacher in California a decade

ago.

10. Q. Do you have proof of this previous marriage with JUANA?

A. Yes sir, I have our marriage certificate which is my Exhibit “2".

11. Q. You say that she is your ex-wife. What do you mean by that?

A. After a few years of marriage, we decided to go our separate ways. Our

divorce was finalized on November 15, 2012.

12. Q: Do you have proof of that divorce?

A: Yes sir. I have the divorce decree issued by the California Court of Justice
as my Exhibit “3”.

14. Q: What are you asking this court with respect to this case?

A: I am praying to the Honorable Court that judgment be rendered dismissing

the complaint for lack of merit. My second marriage is valid and is not
bigamous because my first marriage was legally dissolved by way of
divorce.

judicial affidavit before me and avowed under penalty of law to the veracity of the contents
