1 In the interest of the service and pursuant to Republic Act 10931, also known as the

2 Universal Access to Quality Tertiary Education Act (UAQTEA), these Implementing

3 Guidelines are hereby adopted and shall be observed in providing public access to free

4 quality tertiary TVET education.

5 I. Rationale

6 The Republic Act No. 10931 is an Act promoting Universal Access to Quality Tertiary

7 Education by providing for free tuition and other school fees in State Universities and

8 Colleges (SUCs), Local Universities and Colleges (LUCs) and state-run Technical-Vocational

9 Institutions (STVIs), establishing the Tertiary Education Subsidy and Student Loan Program

10 (SLP), strengthening the Unified Student Financial Assistance System for Tertiary Education

11 (UniFAST), and appropriating funds therefor. It is hereby declared that quality education is an

12 inalienable right of all Filipinos and it is the policy of the State to protect and promote the

13 rights of all students to quality education at all levels. The State recognizes the

14 complementary roles of public and private higher education institutions and technical-

15 vocational institutions in the educational system and the invaluable contribution that the

16 private tertiary schools have made and will make to education. The “Universal Access to

17 Quality Tertiary Education Act aims to:

18 1. Provide adequate funding and such other mechanisms to increase the participation rate

19 among all socioeconomic classes in tertiary education;

20 2. Provide all Filipinos with equal opportunity to quality tertiary education in both private and

21 public education institutions;

22 3. Give priority to learners who are technically-able and who come from poor families;

23 4. Ensure the optimized utilization of government resources in education;

24 5. Provide adequate guidance and incentives in supporting young Filipinos with their career

25 choices towards the proper development and utilization of human resources; and

26 6. Recognize the complementary roles of public and private TVIs in the tertiary education

27 system.

28 II. Definition of Terms

29 In order to provide a common frame of reference in understanding the key

30 terminologies used in this Circular, the following terms are hereby operationally defined as

31 follows:

32 1. Act refers to Republic Act No. 10931, also known as the Universal Access to Quality

33 Tertiary Education Act (UAQTEA);

34 2. Assessment and Certification refers to a program that aims to assess and certify

35 the competencies of middle-level skilled workers through the Philippine Technical-

36 Vocational Education and Training (TVET) Competency Assessment and Certification

37 System (PTCACS);

38 3. Bundled Program refers to the combination of several qualifications with Training

39 Regulations (WTR) that are being offered as a single program to produce multi-skilled

40 graduates. This can be done either through vertical articulation (under the same

41 qualification and different National Certification levels) or horizontal or lateral

42 progression (under different qualifications within the same sector and the same

43 National Certification Levels); (Note: Refer to UTPRAS Guidelines)

44 4. Certificate of Competency (COC) refers to a document issued by the Technical

45 Education and Skills Development Authority (TESDA) to individuals who were

46 assessed as competent in a single unit or cluster of related units of competency, as

47 defined in Section 4 of the National Assessment and Certification Arrangements of the

48 Training Regulations;

49 5. Certificate of TVET Program Registration (CTPR) refers to a document issued by

50 TESDA to a concerned Technical Vocational Institution (TVI) as a manifestation that

51 the TVET program which the said institution is offering complies with the minimum

52 requirements or standards prescribed by TESDA;

53 6. Cluster of Units of Competency refers to a group of competencies, the combination

54 of which is deemed employable and can be registered as a program being proven

55 competent by virtue of assessment, as defined in the Training Regulations that

56 corresponds to a Certificate of Competency (COC).

57 7. Consumables refer to the supplies and materials needed by the learners to practice

58 the skills requirement of a training activity;

59 8. Cost of maintenance of facilities, equipment, and tools refers to the funds

60 necessary to keep the facilities, equipment and/or tools in good functional condition. It

61 is the imputed cost of utilization of facilities, equipment, and tools;

62 9. Cost of utilities refers to the cost of the amount of water and electricity consumed

63 during the training period;

64 10. Honorarium of trainer refers to the budget allocated to pay services rendered by a

65 contractual TVET trainer;

66 11. Instructional materials allowance refers to the amount provided to the learners for

67 the acquisition of the necessary learning materials/workbooks/handbooks and/or non-

68 print materials related to training programs.

69 12. Library fee refers to the fee intended for the use of and access to library service in aid

70 of research and instruction. This fee shall not cover fines and penalties incurred by

71 student library users. This also includes license fees to cover large-scale reproduction

72 of copyrighted materials which shall be paid to collective licensing organizations;

73 13. Medical and dental fees refer to all fees intended for health services provided to the

74 students including physical, dental, and mental health assessment, examination, and

75 treatment in the institution to ascertain that the student is physically and mentally fit

76 and does not have any contagious diseases;

77 14. Miscellaneous fee for TVET refers to “other school fees” that cover the following

78 services:

79 a. accident insurance - an all-purpose student insurance to cover in-campus and off-

80 campus activities;

81 b. access to library/learning resource center collections;

82 c. school ID card;

83 d. medical and dental services- refer to health services provided to the students

84 including physical, dental, and mental health assessment, examination, and

85 treatment in the institution to ascertain that the student is physically and mentally

86 fit and does not have any contagious diseases; and

87 e. student support services such as career guidance and job linkage for graduating

88 learners;

89 15. Mobilization Fund refers to the immediate payment provided to SUCs and LUCs and

90 State-run TVIs from the funds appropriated for the free higher education and free

91 TVET provisions to ensure the immediate and unhampered implementation of the said

92 provisions;

93 16. National Certificate (NC) refers to the document issued by TESDA to individuals

94 after being subjected to a National Competency Assessment and proven competent in

95 all the required units of competency of a national qualification defined under the

96 promulgated Training Regulations;

97 17. National Competency Assessment refers to a process of collecting evidence and

98 making judgments to confirm if an individual can perform according to the standards

99 expected at the workplace, as expressed in the Training Regulations;

100 18. National Competency Assessment Fee refers to the standard amount charged to a

101 candidate by an Accredited Assessment Center for the purpose of a national

102 competency assessment;

103 19. Nominal Duration refers to the estimated learning hours which indicate the time for

104 an average person to achieve the learning outcomes of the units of competency,

105 inclusive of classroom contact time, laboratory/field work/practicum, and other

106 methods of study/assignment, as defined in the Training Regulations;

107 20. Opt-out refers to the voluntary decision of the student to forego the benefits of the

108 Free TVET in STVIs and instead pay the institution the amount equivalent to the

109 waived subsidy;

110 21. Quality assured TVET programs are those TESDA-registered TVET programs

111 consistently complied with UTPRAS guidelines. These are registered TVET Program

112 Level I to Diploma and Bundled programs/qualification still subject to the existing

113 UTPRAS Compliance Audit and likewise Technical Audit, National Inspection, as

114 deemed appropriate.

115 22. Starter toolkit refers to a set of hand tools, power tools that would help learners

116 create business opportunities.

117 23. State-run Technical-Vocational Institutions (STVIs) refer to technical-vocational

118 institutions operated by TESDA or LGUs, provided that, in the latter, the LGU is

119 accredited by TESDA. These institutions include TESDA Technology Institutions

120 (TTIs), State Universities and Colleges (SUCs), Local Universities and Colleges

121 (LUCs,) and LGU-run training centers offering registered TVET programs under the

122 Unified TVET Program Registration and Accreditation System (UTPRAS).

123 24. Technical-Vocational Education and Training (TVET) refers to the education

124 process designed at post-secondary and lower tertiary levels, officially recognized as

125 non-degree programs aimed at preparing technicians, para-professionals, and other

126 categories of middle-level workers by providing them with a broad range of general

127 education, theoretical, scientific and technological studies, and related job skills

128 training;

129 25. Technical-Vocational Institutions (TVIs) refer to learning institutions offering post-

130 secondary TVET. These include TESDA Technology Institutions, Public and Private

131 Technical Vocational Institutes, Private Higher Education Institutions (HEIs), State

132 Universities and Colleges (SUC), Local Universities and Colleges (LUCs), Training

133 Centers, and enterprises offering TVET programs;

134 26. TESDA Technology Institutions (TTIs) refer to the schools, Regional and Provincial

135 Training Centers that are under the management of TESDA. These include TESDA

136 Regional Training Centers, TESDA Provincial Training Centers, TESDA-administered

137 schools, and TESDA-specialized centers (e.g., TESDA Women’s Center, Language

138 Skills Institute (LSI), etc.;

139 27. Unified Student Financial Assistance System for Tertiary Education (UniFAST)

140 refers to the harmonized, State-run and administered system of higher education and

141 technical-vocational scholarships, grants-in-aid, student loan, and other modalities of

142 student financial assistance program promulgated under Republic Act No. 10687;

143 28. Unified TVET Program Registration and Accreditation System (UTPRAS) refers to

144 a two-stage quality assurance process that covers the following: (1) the mandatory

145 registration of TVET programs with TESDA and the monitoring for continuous

146 compliance with the prescribed minimum requirements; and (2) the voluntary

147 accreditation of institutions which deals with the institutionalization of quality

148 management systems at the institutional level;

149 29. Voluntary Contribution refers to the decision of the student to contribute at his/her

150 free will some financial amount to the SUC, LUC, or LGU-run TVI, while availing

151 himself/herself of the free higher education or free TVET provisions in the Act; and

152 30. With Training Regulations (WTR) refers to the programs with Training Regulations

153 registered under UTPRAS.

154 III. Qualifications/Program Coverage

155 1. Any STVI with TESDA-Registered TVET Program qualifies as training provider.

156 2. Quality assured TVET programs are those TESDA-registered TVET programs

157 listed/indicated in the TESDA compendium as of July 2017 and remains to be in TESDA

158 Compendium as of June 2018. These are registered TVET Program Level I to Diploma

159 and Bundled programs/qualification still subject to the existing UTPRAS Compliance Audit

160 and likewise Technical Audit, National Inspection, as deemed appropriate. Programs shall

161 be subjected to compliance audit following the documented procedure on UTPRAS.

162 3. All Filipino learners who are currently enrolled at the time of the effectivity of the Act, or

163 shall enrol at any time thereafter provided, that they comply with the admission and

164 retention policies and existing residency rules of the STVIs;

165 4. To give priority to deserving learner and who come from:

166 a. The most recently updated Listahanan (National Household Targeting System for

167 Poverty Reduction)

168 b. Poorest of the poor

169 c. Orphans

170 d. Dependents of informal settlers

171 e. Rebel of returnees

172 f. Drug dependents

173 g. Indigenous Peoples (IPs)

174 h. Persons with Disabilities (PWDs)

175 i. People in the construction industry as a priority sector (e.g. Construction workers)

176 j. Internally displaced population

177 k. Relatives of AFP/PNP Personnel Killed-In-Action, Wounded-In-Action

178 l. Dependents of OFW returnees

179 5. The requirements for admission should be based on:

180 a. Entry requirement as stipulated in Section III of the relevant Training

181 Regulations

182 b. NCAE/MATB/YP4SC Profiling; and

183 c. Other STVI entry requirements if applicable

184 6. The following learners are NOT ELIGIBLE to avail themselves of the Free TVET benefit:

185 a. Learners who have obtained a bachelor’s degree;

186 b. Learners who are already holders of a certificate or diploma for a technical-

187 vocational program equivalent to National Certificate Level III or higher, unless

188 the trainee is enrolled in bundled programs leading to Level IV or Diploma;

189 c. Learners enrolled in TVET programs not registered under TESDA; and

190 d. Learners who voluntarily opt out of the free TVET provision.

191 Learners who are NOT ELIGIBLE to avail themselves of the Free TVET

192 benefits shall be charged the training cost and other training-related costs determined

193 by TESDA based on the policy of composite fees formulated by the UniFAST Board,

194 subject to the transitory provisions in Section 54 of the IRR.

196 The free TVET provision in STVI shall cover the following:

201 2. Provision for three (3) pieces uniform t-shirt per learner

202 b. Cost of utilities - This is the cost of water and electricity consumed during the

203 conduct of the training.

204 c. Cost of maintenance of facilities, equipment and tools. This is the imputed cost

205 of utilization of facilities, equipment and tools.

206 d. Honorarium of trainers based on TESDS II SG 16

207 e. Miscellaneous fee covers: Php 450.00/trainee

209 (There will be a national Memorandum of Agreement between TESDA and

217 Learners

218 Aside from the tuition and other school fees, the learners shall be given the following

219 benefits:

220 a. Living allowance;

221 1. This covers either a) Php 3,500/month for dormitory expenses of the

222 learner; or b) Php 160.00 for daily transportation and one meal. Living

223 allowance computed at Php 160 shall be released to the concerned

224 learners every two (2) weeks on payroll basis by authorized personnel

225 2. The first payment shall be given during the Training Induction Program

226 (TIP) covering the first two (2) weeks of training. Subsequent payments

227 shall correspond to the actual number of days of attendance of the previous

228 two (2) weeks.

229 3. STVIs shall adopt a “no attendance, no allowance policy”.

230 During TIP conducted on the first day of training, the qualified learner should be

231 accompanied by their parents/guardians. The STVIs shall ensure that TIP

232 shall cover the following topics:

235 c. Community Service (RA 9418 Section 14 Integration of Volunteerism in the

236 Education Curriculum – Volunteerism as a concept and practice shall be

237 integrated at all level of education across grades and across subjects)

238 d. Financial Literacy

240 b. Instructional materials allowance;

241 1. This covers the learning materials/workbook and/or handbooks to be used by the

242 learner amounting to Php 5,000.00/ qualification

243 2. Payroll system shall be implemented to monitor the release of instructional

244 material allowance.

245 3. Payment of instructional allowance:

246 This is a provision for learners that they may use to acquire the necessary

247 learning materials/workbook/handbook and/or non-print materials.

248 3.1 Instructional materials allowance of Php 5,000.00 per qualification shall be

249 given to the trainees by the authorized disbursing officer of the STVIs no

250 later than five (5) working days after TIP. A list of instructional materials

251 shall be provided by the trainer during the TIP. The allowance received by

252 the trainees shall be liquidated not later than ten (10) working days upon

253 receipt or no later than 50% of the training duration, whichever is sooner.

254 To ensure that the instructional material allowance was used according to

255 its purpose, official receipts of purchased resources should be submitted to

256 the authorized officer as part of the liquidation report; and

257 3.2 Any amount not utilized within the period as defined above shall be

258 refunded by the learner to and properly receipted by the authorized

259 disbursing officer, of the STVIs, or, shall be deducted from their succeeding

260 living allowance. Furthermore, any unauthorized use of the instructional

261 materials allowance by the learner shall be considered invalid therefore the

262 same amount shall be deducted from the living allowance of the learner.

263 c. National Competency Assessment fee;

264 This is the allowable cost in the conduct of Competency Assessment based on

265 attached TESDA-Approved Schedule of Fees (Annex A).

266 Learners in the WTR programs shall be subjected to mandatory assessment as

267 applicable.

268 The STVI shall develop a National Competency Assessment Plan that

269 contains or reflective of the date of start and date of finish of the training, requested

270 date of assessment with corresponding amount to be paid to the assessment center,

271 and indicative assessor. This should be submitted to the TESDA PO for approval as

272 per assessment procedure. The TESDA PO should ensure that the assessment is

273 conducted before the end of the training program.

274 Fees will be paid by the STVIs or its authorize Offices to the Accredited

275 Assessment Center subject to the attached Schedule of Assessment Fees.

276 d. Starter tool kit:

277 1. A Starter Tool Kit amounting to approximately Php 8,000.00 is provided to every

278 graduate as start-up provision for a small business.

279 2. Issuance of Starter Tool Kit shall be supported by an Acknowledgment Receipt in

280 accordance with the standards accounting rules and procedures.

281 3. Annex B Illustrates the Process on the Distribution of Starter Tool Kit.

282 V. Opt-Out Mechanism

283 The decision of the learner to voluntarily opt out must be made during the enrolment

284 period of a TVET program and shall be considered final and irrevocable for that particular

285 program. If the program enrolled is in a bundled program, the learners can change their

286 decision in subsequent programs that they shall be enrolling in.

287 Learners who voluntarily opt out of the Free TVET provision shall pay, not later than five

288 (5) calendar days after the start of training program, the amount equivalent to the full training

289 cost and other training-related costs of the corresponding TVET program as indicated in the

290 policy of composite fees formulated by the UniFAST Board, subject to the transitory

291 provisions in Section 54 of the IRR.

292 Learners who choose to voluntarily opt out shall sign and submit a waiver to the STVI

293 they are enrolling in.(Opt out will not receive TES component, toolkit, living allowance, and

294 instructional material allowance and TSHIRT)

295 All payments received from learners shall be remitted by the STVIs to their respective

296 TESDA ROs within one month from the start of the training program. The TESDA RO

297 disbursing officer shall issue an official receipt for the amount received. TESDA RO deposits

298 the same amount to the TESDA Development Fund (TDF) in accordance with the

299 government accounting procedure.

300 VI. Voluntary Contribution Mechanism

301 The decision of the learner to pay any amount as voluntary contribution to the school

302 must be made during the enrolment period for a particular program and shall be considered

303 final and irrevocable for that program. These students shall be allowed to change their

304 decision in subsequent program.

305 Learners who choose to pay a voluntary contribution shall sign and submit a notarized

306 Voluntary Contribution Form (Annex C) to the STVI in which they are enrolled.

307 The total amount of contribution shall be remitted to the TESDA RO and TESDA RO

308 shall deposit the same amount to the TESDA Development Fund (TDF) within one

309 month from the start of the training program. Accordingly, the special authorized officer

310 shall issue an official receipt of the amount collected.

311 All STVI shall create a mechanism to encourage the learners with financial capacity

312 to pay their education to contribute voluntarily in any amount to the school;

313 The said contribution must be done during enrolment period of the program and

314 shall be considered final and irrevocable for the duration of the program.

315 For bundled programs, the learner can change their decision the program that they

316 are enrolled in. For this detail, the learner shall sign and submit a Voluntary Contribution.

317 Voluntary Contribution:

318 a. A Pro-forma Waiver Form shall be accomplished by the learners for either opt-out or

319 voluntary contribution (Annex C)

320 b. The whole amount of contribution shall be remitted to the TESDA Development Fund

321 (TDF) thru the RO within one (1) month from the start of the training program.

322 Accordingly, the special authorized officer shall issue an official receipt of the amount

323 collected.

324 All payments collected from the learners opted out or made voluntary contribution to the

327 VII. Procedures in the Preparation of Qualification Map

328 1. The STVIs shall prepare and submit to a QM, covering the period from July-December

329 2018.

330 2. The Regional Office shall check the validity of the programs indicated in the QMs then

331 coordinate with the STVIs for any correction required.

332 3. TESDA RO approved and endorse validated QM to the central office for budgeting

333 purposes (ANNEX E).

334 VIII. Administrative and Financial Requirements

335 1. The source agency (CHED-UniFAST) issues a check in the name of TESDA Central

336 Office which in turn deposits the same amount under Trust Fund Account.

337 2. Upon receipt of the amount a corresponding official receipt shall be issued by TESDA

338 Central Office to CHED-UniFAST.

339 3. The TESDA Central Office shall transfer or release the funds to TESDA ROs for the

340 implementation of the Free TVET

341 4. The fund transfer shall be taken up by the TESDA RO as a Trust Liability Account, and

342 shall be deposited to an Authorized Government Depository Bank (AGDB). The TESDA

343 ROs and the Implementing warrant that the aforementioned funds shall be allotted and

344 used solely and exclusively for the implementation of the approved Qualification Maps

345 based on the cost centers as bases for the monitoring of the project and utilization and

346 liquidation of funds.

347 5. Release of funding requirements to Implementing Units:

348 5.1 TTIs

349 5.1.a. TESDA RO shall release the mobilization fund to the Implementing Units the

350 amount equivalent to 50% of the budget allocated to TTIs based on the approved

351 QM. The amount shall be deposited in the trust fund account of the Implementing

352 Unit in an AGDB.

353 5.1.b. TESDA Provincial Training Center which does not maintain separate books of

354 accounts, the release of funds shall be made to the Provincial Office concerned and

355 the same amount shall be deposited in the trust fund account.

356 5.1.c. The released mobilization fund shall be fully liquidated at the end of

357 December 2018. The post-audit of transaction by the designated Resident

358 Auditor is not a prerequisite to the succeeding release of funds as contained in

359 COA Circular No. 2016-002 dated May 31, 2016.

360 5.1.d. The TTIs concerned shall return to TESDA Regional Office any unused

361 balance of the mobilization fund released for the purpose.

362 5.1.e. For subsequent releases to the TTIs, payment shall be made by the Regional

363 Office concerned on a reimbursement basis and upon submission of the required

364 supporting documents, based on the attached checklist of requirements (minimum)

365 (Annex F).

366 5.1.f. The TTIs shall maintain a separate subsidiary Ledger/record of transactions

367 made to be available during the field visit and monitoring activities of the TESDA

368 and CHED-UniFAST

369 5.1.g. The TESDA Training Institutes shall deposit all payments received from the

370 Regional Office in their respective SSP/IGP maintained account. Disbursement

371 made there from shall be subject to the rules and regulations stipulated in COA-

372 DBM-DOF Joint Circular No. 7-85 dated July 29, 1985 and TESDA Circular 26

373 series 2018 dated April 2018.

374 5.2. SUC, LUC and LGU-run Training Centers

375 5.2.a. Forged Memorandum of Agreement between TESDA and SUC, LUC and

376 LGU-run training centers as the legal basis to facilitate the release of fund.

377 5.2.b. The release of funding requirements shall follow the provisions in 5.1.b up to

378 5.1.f. of the herein Circular.

379 6. The Regional Office shall submit to the Central Office a monthly fund utilization report

380 of the release funds every fifth (5th) day of the following month. TESDA Central Office

381 shall submit to CHED-UniFAST the agency consolidated report every seventh (7th) day

382 of the following month.

383 7. Within ten (10) calendar days after the end of the three (3) month period/quarter and

384 thereafter, the Regional Office shall submit the Report of Checks Issued and

385 Cancelled (RCIC) and the Report of Disbursements (ROD) together with the copies of

386 paid disbursement vouchers (does not include the supporting documents) to support

387 the report on the utilization of funds. Said report shall be approved by the Head of the

388 Office.

389 8. The Regional Office shall return to the TESDA Central Office any unused balance of

390 the funds transferred upon completion of the Project.

391 9. The TESDA-Central Office shall submit to CHED-UniFAST a quarterly partial

392 liquidation report duly verified and certified by the TESDA Chief Accountant and

393 approved by the Agency Head, with photocopies of paid disbursement vouchers.

394 10. TESDA-Central Office shall submit to CHED-UniFAST a final consolidated Liquidation

395 Report within thirty (30) calendar days, upon completion of the project and in

396 accordance with COA Circular No. 94-013 dated December 1994. The liquidation

397 Report shall be approved by the Head of Agency. In addition, the Chief Accountant

398 shall issue a Certification that funds previously transferred to TESDA (Implementing

399 Agency) has been liquidated and accounted for in books as approved for in COA

400 Circular No. 2016-002 dated May 31, 2016.

401 11. TESDA-Central Office shall return to CHED-UniFAST any unused balance of the funds

402 transferred upon completion of the project.

536 Witnesseth:

537 WHEREAS, the TESDA is a national government agency created through

538 Republic Act No. 7796, otherwise known as the “Technical Education and Skills

539 Development Act of 1994”, mandated by law, to provide relevant, accessible, high quality

540 and efficient technical education and skills development in support of the development of

541 high quality Filipino middle level manpower responsive to and in accordance with

542 Philippine development goals and priorities;

543 WHEREAS, Section 8 of Republic Act No. 7796 states that TESDA shall primarily

544 be responsible for formulating, continuing, coordinated and fully integrated technical

545 education and skills development policies, plans and programs;

546 WHEREAS, Section 32 of the TESDA law further provides that it shall adopt a

547 system of allocation and funding of scholarship grants which shall be responsive to the

548 technical education and skills development needs of the different regions in the country.

549 WHEREAS, the SUC/LUC/LGU-TVI is a State-run academic and training

550 institution, that offers TESDA-registered Technical Vocational Education and Training

551 (TVET) program, to its students/constituents/beneficiaries;

552 WHEREAS, Republic Act (RA) No. 10931 otherwise known as the “Universal

553 Access to Quality Tertiary Education Act (UAQTEA)” was signed into law last August 2,

554 2017 while its Implementing Rules and Regulations (IRR) was approved by UniFAST

555 Governing Board last November 10, 2017;

556 WHEREAS, both parties are covered and governed by the mandate of R.A.

557 10931 on providing free and universal access to quality tertiary education;

558 WHEREAS, the UAQTEA provides three (3) modes by which a student can

559 access quality technical vocational education and training (TVET) through: a) Free TVET

560 in State-Run TVIs; b) Tertiary Education Subsidy (TES); and c) Loans;

561 WHEREAS, Rule III, Section 13 of the Implementing Guidelines of R.A. 10931

562 provides for the coverage of Free TVET in the Post-Secondary State-run TVIs whereby all

563 Filipino learners who are currently enrolled at the time of the effectivity of the Act, or

564 shall enroll at anytime thereafter, in any TESDA-registered TVET program leading to a

565 non-degree certificate or diploma, including diploma courses and bundled programs, and

566 offered by State-run TVIs (STVIs) shall be eligible for the free TVET provision;

567 WHEREAS, Section 7 of Republic Act 10931 provides that in order to support the

568 cost of tertiary education or any part or portion thereof, a TES is established for all

569 Filipino students who shall enroll in the undergraduate post-secondary programs of SUCs,

570 LUCs, private HEIs and all TVIs;

571 WHEREAS, Section 8 of Republic Act 10931 provides that in order to support

572 further the cost of tertiary education or any part or portion thereof, a student loan

573 program for tertiary education is likewise established for all Filipino students who shall

574 enroll in SUC, LUC, private HEI and TVET Program in all TVIs registered under TESDA;

575 WHEREAS, consistent with Section 56 of the IRR of Republic Act 10931, the

576 budgetary appropriation in the General Appropriations Acts (GAA) for the implementation

577 of the Free TVET Program in state-run TVIs and Tertiary Education Subsidy (TES) for

578 private TVIs is with the account of CHED whereas the actual implementation and quality

579 assurance thereof is lodged with TESDA in accordance with the provisions of Sections 42

580 and 58 of same IRR;

581 WHEREAS, there is a need to transfer the funding requirements from TESDA to

582 SUC/LUC/LGU-TVI in order to implement the Free TVET Program in its campuses in

583 accordance with the legislative intent of the Republic Act 10931;

584 NOW THEREFORE, for and in consideration of the foregoing premises and their

585 mutual covenants hereinafter set forth, the parties have agreed on the following terms

586 and conditions:

587 COVERAGE:

588 This Memorandum of Agreement covers the budgetary appropriation transfer from

589 TESDA to SUC/LUC/LGU-TVI in the total amount of _________________ Pesos (₱

590 ___________.00) as initial tranche;

591 A. PURPOSE OF FUND TRANSFER:

592 The budgetary appropriation transfer contemplated in this MOA shall be used by

593 SUC/LUC/LGU-TVI strictly for the purpose of implementing the Free TVET Program in its

594 campuses as component of the Universal Access to Quality Tertiary Education under

595 Republic Act 10931 for Calendar Year 2018;

596 B. PRINCIPAL OBLIGATION OF TESDA:

597 TESDA hereby commits to transfer to SUC/LUC/LGU-TVI the total amount of

604 2. Shall implement, using the above-cited funds, the Free TVET Program in its

605 campuses for the Calendar Year 2018 as a component of the Universal Access to

606 Quality Tertiary Education under the Republic Act 10931 and subject to applicable

607 laws, rules and regulations;

608 3. Shall be fully responsible for the accounting and disbursement of the transferred

609 funds in accordance with existing COA and other government regulations. In

610 addition, it shall submit verified Quarterly Liquidation Reports in accordance

611 with the COA Circular No. 94-013 dated December 13, 1994;

612 4. Shall make available the records and related documents to TESDA for inspection

613 and monitoring;

614 5. Aside from the foregoing Quarterly Liquidation report, it shall also submit to

615 TESDA a Monthly Utilization Fund Report duly verified and certified correct by

616 the SUC/LUC/LGU-TVI Chief Accountant and approved by the Agency Head,

617 with copies of the paid disbursement vouchers in connection with the

618 implementation of the Free TVET Program in its campuses;

619 6. Shall submit to TESDA the corresponding Enrolment Report, Daily Attendance

620 Sheet of Attendance, 03-02 from T2MIs and Terminal Report as attachments to

621 the Monthly Utilization Fund Report;

622 7. Any unused balance for this purpose shall be returned to TESDA with

623 corresponding liquidation at the end of the Calendar Year.

624 D. GENERAL PROVISIONS:

625 1. The parties mutually agree to perform and abide with all of the provisions and

626 requirements contained or could reasonably be inferred from this MOA. Failure of

627 either party to ensure compliance thereof shall not be construed to be waiver of

628 such provisions or a waiver of right of each thereafter to enforce or settle the

629 same; and

630 2. This MOA may be amended/ modified in writing in order to be responsive/ to

631 conform to the provisions of COA, DBM, and other pertinent government

632 regulations and guidelines.
