SPECIAL PROVISIONS
SP – 01 Location of the Project

(1) The project area is located in Bannu Basin of Bannu and Lakki Marvat districts, NWFP.Most of the
project area is located between Kurram and Tochi-Gambela rivers while a small portion lies on the left bank
of Kurram river. Baran or Lora nullah traverses the upper part of the sub project from Northwest to
Southeast and makes its confluence with Tochi River. Gambela River is formed when Tochi and Bara nullah
join each other. The confluence of Kurram and Gambela River is the most southern part of the project area.

SP – 02 Site of the Works

(1) The Site of the Works is the area for Remodelling and Rehabilitation of surface drains, its related
structures, and Construction of sub surface drains within the right-of-way and within any other lines,
boundaries and limits shown on the drawings and such additional areas adjacent thereto as may be designated
by the Engineer from time to time for the construction to be performed under the Contract, and all such areas
and additional areas shall comprise the Site as defined in Conditions of Contract.

(2) Within the areas which may be defined as the Site, the Contractor shall carry out and perform the
construction of the Works. Subject to the approval of the Engineer, the Contractor will be permitted to
construct temporary roadways, camps, buildings and temporary works which he may require for the
construction of the Works. If the Contractor wishes to use any land other than as aforesaid for construction of
camps or for any other Contract purposes, the Contractor shall make all necessary arrangements with the
owner thereof and shall bear all rentals or other costs connected therewith. The Contractor shall furnish to the
Engineer, for approval, plans for additional land 14 days prior to the use of such land. Such land shall be
deemed to be part of the Site.

SP – 03 Access to Site & Haul Roads

(1) The project area is served by existing transportation, communication, product distribution, marketing
and professional and community services at Bannu. Bannu is connected by metalled roads with Peshawar and
D.I.Khan.

(2) The Contractor shall make his own investigation of the condition of available public or private roads
and of clearances, restrictions, bridge load limits and other limitations that affect or may affect transportation
and ingress or egress at the job sites. Non-availability of transportation facilities or limitations thereon shall
not become a basis for claims or damages or extension of time for completion of the Works. It shall be the
Contractor’s responsibility to construct and maintain, at his own expense and at his own risk, any access roads,
haul roads, bridges, or drainage structures required for construction operations. The Contractor shall obtain
any required permits for travel on or work within the right-of-way of all public roads.
(3) Existing secondary or tertiary roads are available for the Contractor’s use subject to restrictions
imposed by the local authorities. The Contractor shall meet all conditions imposed upon the use of the existing
roads by those having jurisdiction, including (without limitation of the generality of the foregoing) seasonal or
other limitations or restrictions, the payment of excess size and weight fees, and repair of road damage caused
by the Contractor.
(4) The hauling of sand, gravel, earth or rock materials, or other hauling within the project, over the
existing public highways, roads, or bridges shall be in compliance with the applicable local regulations and
shall be such as to minimise interference with or congestion of local traffic. Where haul routes cross public
highways or roads, the Contractor shall provide traffic barricades, flagmen, and other necessary precautions
for the safety of the public. Where haul routes utilise existing unmetalled canal access roads, the Contractor
shall maintain such roads in good condition by regular grading.

SP – 04 Climatological Data
(1) The climate of the area varies with physiography and elevation. Its climate is semi arid and sub
tropical ranging from semi arid in the south Lakki district and sub-humid in Bannu district. Summer is hot
and dry in June humid in July and August, while winter are mild. The mean monthly temperature in Bannu
town in June is about 34 C and in January 11.8 C, humid in July and August monthly temperature ranges
from 15oC to 41oC.

(2) Table SP2 shows rainfall distribution in the project area . Mean annual rainfall from 1961 to 2000 is
about 14.61inches (371mm). The highest rainfall months are July, August and March. On the average 53%

Of the annual rainfall occurs in these months March August and July are the wettest months of winter,
summer respectively.

SP – 05 Topography

The general land slope of the project area is gentle with slightly undulating surface relief along the main
natural streams. Abandoned flood plain formed by Kurram river alluvial deposits is the second largest
landform. The Nurmali Unit is basically an extension of the abandoned flood plain, which was subsequently
covered by silty sand transported by northeasterly winds. The land is sloping towards Kurram river and has
a general slope ranging from 0.5 to 0.55%.

SP – 06 Geology

(1) Any geological information given hereunder or elsewhere in the Specification or shown on the
Drawings is to assist the Contractor at the time of bidding. Such information shall be deemed to be
information provided by or on behalf of the Employer. The information is not warranted by the Employer or
the Engineer and the Contractor shall make use of and interpret the same on his own responsibility.

(2) major part of the project was formed in alluvium, but there are soils that are of Aeolian origin. The
alluvium has its origin in sedimentary rocks of the surrounding hills. It has been transported and laid
down by streams that traversed the area. Deposits are calcareous and exhibit various shades of
brown and grey colors. Soils are generally permeable , well retentive o f moisture and plant nutrient,
but contain little organic matter.

(3) Drains will be constructed, remodelled or rehabilitated in areas where drainage water from adjacent
areas may be standing for prolonged periods. The depth of the water table in the vicinity fluctuates during
winter and summer season, but may well occur in the top meter of the soil profile for most of the year.

(4) The Employer does not guarantee the correctness of the designations of any materials described in the
Bid Documents nor any interpretations, deductions, or conclusions relative to subsurface conditions. The
Contractor must form his own opinion of the character of the work and of the materials to be excavated. He
must also make his own interpretation, and satisfy himself by his own investigations and research regarding all
conditions affecting the work to be done. The Contractor must assume full responsibility for deductions and
conclusions as to the nature or condition of the materials and for executing the Works in the conditions
encountered.

SP – 07 Extent of Works

In this Contract the Contractor shall construct all the Works referred to in Clause SP-08 as shown on the
Drawings and in strict adherence to the Specification. This includes but is not limited to earthwork for drain
sections, placing the excavated material in fill areas, spoil banks, compaction, dressing and constructing all
related structures and works shown on the Drawings. The Contractor is required to obtain approval of the
Engineer for the final location of all structures, especially the inlet structures. The location of the inlet
structures, as specified on the drawings, may be changed by the Engineer who will first get consent of the
farmers and inspect the area at site in order to verify the topographical justification.
The Contractor shall procure, furnish, provide and arrange for all the necessary electric power, water and
services; be responsible for the construction and maintenance of the necessary construction camps, offices and
warehouse; and perform all other work necessary for completion of the Works described herein in strict
conformity with these Specifications.

SP – 08 Description of the Works

The works for “Rehabilitation, Remodelling and Extension of Surface Drains and Construction of Sub-
surface drains in Bannu Scarp area”, falling under this Contract No. FA / 48 / ABL, consist of furnishing all
plant, labour, equipment, materials, superintendence and all other services and facilities required to
construct, complete and maintain the works as specified and as shown on the Drawings, or as directed by the
Engineer from time to time. A list of assets to be remodeled, rebuilt or new construction is given in
Appendix-I to Special Provisions. The scope works includes but not limited to:

a. Rehabilitation of 47 km surface drains;


b. Remodelling of 30 km surface drains;
c. Extension of 3.3 km surface drains;
d. Construction of 100,000 m sub-surface lateral drains in 5400 acres of land;
e. Construction of 38,000 m sub-surface collector drains;
f. Construction of 10 pump stations;
g. Electric connections to the pump stations from the existing WAPDA distribution line in the area; and
h. Supply and installation of 11 kV power lines and 25 kVA pole mounted transformers for electric
connections to 10 pump stations.

About 47 hectares of land will be acquired by the Employer for the proposed project works.

SP – 09 Contract Drawings

(1) Bid Drawings: The Drawings as listed in Volume – II of the bidding documents hereinafter referred to
as Bid Drawings, show the scope of the work to be performed by the Contractor. The Bid Drawings shall not
be used as a basis for Construction but may be used as a basis for placing preliminary orders for materials,
subject to corrections based on the future issue of Drawings as provided under Construction Drawings.
(2) Construction Drawings: After award of the Contract, the Bid Drawings will be replaced by Drawings
issued for construction (Construction Drawings) including supplementary Specifications as may be necessary.
The drawings issued for construction will include Bid Drawings reissued, bid drawings as may be modified and
additional Drawings as required to develop the work in greater detail, and will show modifications as necessary
for further detailing the construction required. The Drawings issued for construction that show changes from
the Bid Drawings and Specifications will be reviewed by the Engineer for his determination of adjustments (if
any) of the Contract Price. The work shall be executed in conformity with the Drawings issued for
construction.
(3) Definition of Term Drawings: The term Drawings means the drawings referred to in the Specification
and any modification of such drawings approved in writing by the Engineer and applies to both the Bid
Drawings defined in sub-clause SP-9(1) and to the Drawings issued for Construction as described in sub-
clause SP-9(2) and such other Drawings as may from time to time be furnished by the Engineer, or approved in
writing by the Engineer.
(4) Checking Drawings: The Contractor shall check all Construction Drawings carefully as soon as
practicable after receipt thereof, and shall promptly bring it to the notice of the Engineer, if any errors are

discovered. Where Drawings provided by the Engineer show typical details for the positions, dimensions or
levels of foundations, supports, holes or openings through walls or floors, for items of equipment or plant to be
provided by the Contractor as part of the Works, the Contractor shall satisfy himself before construction that
such positions, levels or dimensions are correct for the actual items, being supplied by him. In the event that
such Construction Drawings require to be changed to suit the items being supplied the Contractor shall prepare
drawings of such changes and submit them for approval.
(5) Record Drawings: The Contractor shall provide a complete and accurate “record” set of all drawings
to detail parts of the Permanent Works, regardless of whether such drawings were originally prepared by the
Engineer, by the Contractor or by his sub-contractors or suppliers. During manufacture installation or
construction the original drawings shall be progressively marked up to show any changes which may become
necessary, and to show correct dimensions, levels, sizes, equipment details and the like so as to provide a
complete and accurate record of the Permanent Works. This set of drawings is referred to as Contractor's
record drawings. Each Contractor's record drawing shall be completed and submitted to the Engineer within
one month of the time that the work detailed on it is completed. For drawings prepared by the Engineer on
AutoCAD the Contractor will be provided with an AutoCAD computer file on CD Rom of the latest revision
of the drawing issued before completion of the works shown on that drawing. Each Contractor’s record
drawing shall be certified by the Contractor as being a complete and accurate record of the work detailed on it.
After approval of the Contractor's record drawings by the Engineer, the Contractor shall provide one
reproducible on plastic film of each drawing and AutoCAD files on an approved stable electronic magnetic
medium for those drawings originally prepared in AutoCAD and on CD Rom.

(6) As built Drawings: The contractor shall be responsible for the preparation of all “as
built drawings” as the work proceeds. These drawings shall be for the permanent record of the employer and
shall be in the form of a black-line reproducible film negative together with ten (10) prints for each drawing
produced. The quality and format of these drawings shall be subject to the approval of the Engineer. The issue
of a certificate of completion for the whole or a section of the Works, in accordance with the Conditions of
Contract Clause 48, shall be conditional upon the Contractor having completed for the said Works a complete
draft set of the record drawings to the satisfaction of the Engineer. Thereafter, the Contractor shall submit the
completed drawings in accordance with this Clause not later than 56 days after the issue of the Certificate of
Completion.

SP – 10 Right to Change

When additional information regarding the geological formations, or other conditions becomes available as a
result of excavation, testing, model studies, or exploratory work, the Engineer may find it desirable to change
dimensions or design of one or more of the features of the Works to conform to the newly disclosed conditions.
The Engineer reserves the right to make such reasonable changes, and the Contractor's Plant shall be laid out
and his operations shall be conducted so as to accommodate any such reasonable changes in the Works with no
increase in cost to the Employer.

SP – 11 Drawings and Data Furnished by the Contractor

Where Drawings are required by the Specifications or the Drawings for planning and performance of the work
under the Contract or for materials or equipment to be fabricated, manufactured and furnished by the
Contractor or his sub-contractors, the Contractor shall provide such planning or assembly and detailed shop
drawings as required and have them approved before proceeding with the work. All such drawings shall be
adequately and properly checked before submittal to the Engineer for approval and shall be so designated. All
unchecked drawings received by the Engineer for approval will be returned “Not approved”.

Four copies of such drawings shall be submitted to the Engineer in the form of prints from the original checked
drawings. One print each of these drawings will be returned to the Contractors by the Engineer, marked
“Approved”, “Approved subject to amendments noted”, or “Not approved, resubmission required as noted”.
The notes “Approved” or “Approved subject to amendments noted” will authorise the Contractor to proceed
with the fabrication/manufacture/construction of the equipment/structure/item covered by such drawings,
subject to the corrections, if any, noted thereon. When prints of drawings have been marked “Not approved,
resubmission required as noted”, the Contractor shall make the necessary revisions on the drawings and shall,
within 30 days, submit prints for approval in the same manner as before. Any fabrication or manufacturing or

construction during or before approval of the drawings will be at the Contractor's risk. The Engineer shall have
the right to require the Contractor to make any changes in the design which may be necessary, in the opinion of
the Engineer, to make the materials or equipment or items conform to the requirements and intent of these
Specifications without additional cost to the Employer. Approval of the Contractor's drawings shall not relieve
the Contractor of any part of his obligation to meet all of the requirements of these Specifications or of the
responsibility for the correctness of his drawings. At the time of delivery of the equipment or materials, the
Contractor, if requested to do so, shall furnish to the Engineer two complete sets of the final Approved
Drawings that relate to that equipment or materials.

SP – 12 Co-operation with other Contractors

Nothing contained herein and nothing marked on the Drawings shall be interpreted as giving the Contractor
or other contractors of the Employer exclusive occupancy of the work area provided by the Employer. When
the work area of one contract is the necessary or convenient means of access for the execution of another
contract, such privilege of access or other reasonable privilege shall be granted by the Contractor or by other
contractors of the Employer to the required extent, in the manner and at the times necessary. Any difference
or conflict which may arise between the Contractor and other contractors of the Employer will be adjusted
and determined by the Engineer. No joint occupancy or use of right-of-way shall be made the basis of any
claim for delay or damages to or against the Employer.

SP – 13 Quality of Materials

(1) All materials, fixtures, fittings, and supplies furnished under the Contract Documents shall be new and
unused, of standard first-grade quality, of the best workmanship and design and shall be at least equal to
approved samples. No inferior or low-grade materials, supplies or articles will be either approved or accepted,
and all work of assembly and construction shall be done in a first-class and workmanlike manner. In asking for
prices of materials intended for delivery to the site and incorporation in the works under any portion of these
Specifications, the Contractor shall provide the manufacturer or supplier with complete information as may, in
any case, be necessary to secure compliance with this Clause and, in every case, he shall quote this Clause in
full to each such manufacturer or supplier.

(2) Prior to procurement, the Contractor shall furnish to the Engineer, for his approval, the name of the
manufacturers of all equipment and materials which he contemplates incorporating in the Works. With this
information the Contractor shall also furnish such pertinent information as to capacities, efficiencies and sizes,
and such other information as may be required by the Engineer. Samples of materials shall be submitted to the
Engineer for approval when so directed. Equipment, materials, supplies and articles installed or used without
the Engineer's approval shall be at the risk of subsequent rejection.

(3) Materials shall be transported, handled and stored in such a manner as to prevent deterioration,
damage or contamination.

SP – 14 Standards and Specifications

(1) Except as otherwise provided by these Specifications or the Drawings, all materials, equipment and
fabrication and testing thereof shall confirm to the latest applicable standards and specifications issued by the
agencies listed below or to equivalent applicable standard and specifications for manufacture and supply.
Copies of relevant standards and specifications must be held by the Contractor; if not they shall be purchased
from the indicated agency which publishes them:

AISC American Institute of Steel Construction
ASME American Society of Mechanical Engineers
ASA American Standards Association
AWS American Welding Society
BS British Standards Institution, and any other agency noted in the Specification.

They shall be made available for reference by the Engineer.

(2) If the contractor, at any time and for any reason, wishes to deviate from the above standards or
desires to use materials or equipment not covered by the above agencies, he shall state the exact nature of
the changes, the reason for making the changes and shall submit complete specifications of the material and
equipment to the Engineer for approval.

SP – 15 Inspection and Tests

All equipment and materials furnished under these Specifications and all work performed in connection
therewith will be subject to rigid inspection by the Engineer or his authorised agent. Inspection at the
manufacturer's plant will be made to determine that the equipment and material meet the requirement of these
specifications. The Contractor shall notify the Engineer not less than 14 days in advance of the date and place
that the equipment or material will be available for inspection. No equipment or material shall be transported
until inspection at the manufacturer's plant has been made and final drawings have been furnished by the
Contractor and accepted by the Engineer. Acceptance of equipment and materials or the waiving of the
inspection thereof shall in no way relieve the Contractor of the responsibility for furnishing equipment and
materials meeting the requirements of the Contract Documents.

SP – 16 Contractor's Camps

(1) The Contractor shall provide such camps as are required for the proper and efficient progress of the
work to house his own employees. The Contractor shall be responsible for and provide all services to living
quarters and shall pay all charges in connection therewith and shall see to it that sanitary laws and regulations
in force in the area are complied with. The Contractor shall be responsible for and provide all necessary
fencing and security to these areas. On completion of the Contract, all buildings and such other works shall be
disposed of by the Contractor at his discretion. The Contractor shall be deemed to have taken into account in
his Bid the residual/salvage value of all such buildings and materials.

(2) The Contractor's camps shall comply with the rules of the Pakistan Labour Camp Rules, 1960, issued
by the Pakistan Health, Welfare and Local Government Department and the requirements therein set forth. The
said rules are available with the Employer's Representative.
(3) The Contractor shall be responsible for hiring of the required land on lease basis for the duration of the
Contract, for the purpose of Contractor's camps. All costs for lease of the land required for such purposes shall
be paid by the Contractor.

(4) No separate measurement and payment for provision of Contractor’s Camp and facilities shall be
made and costs in that respect shall be deemed to be included in unit rates for other BoQ items.

SP - 17 Quantities

The quantities set forth in the Bill of Quantities are in no case exact quantities and in some instances are
impossible to determine until after conditions have become known during construction. The quantities show in
the Bill of Quantities are for use as a basis for comparing bids only, and the Employer does not expressly or by
implication agree that the actual work performed or material furnished or installed will correspond therewith;
and further, during the progress of the work, the Engineer may find it advisable and shall have the right to
make changes in locations of portions of the work, to omit portions of the work, and to increase or decrease the
quantities, as may be deemed necessary or desirable. Under no circumstances or conditions will the Contractor
be paid anything on account of anticipated profits from the work, or any portion thereof covered by the
Contract, which is not actually performed. Nor will the Contractor be paid more than the unit rates bid for any
item in the Bill of Quantities contained in the Bid because the actual quantity is greater or less than the quantity
shown in the Bill of Quantities except as otherwise provided elsewhere in the Contract.

SP - 18 Offices and Facilities for the Engineer

The Contractor shall also provide such site offices and facilities for use of the Engineer as specified
elsewhere in these Specifications. The Contractor shall be deemed to have taken into account in his Bid the
cost of providing such facilities unless specificallay provided for in the Bill of Quantities.
SP - 19 Sanitation
The Contractor shall maintain the Site and all working areas in a hygienic condition and in all matters of health
and sanitation shall comply with the requirements of the local Medical Officer of Health or other competent
authority. The Contractor shall provide, maintain and clean throughout the period of construction of the
Works, suitable and sufficient latrines for use by his employees. He shall ensure that his employees do not foul
the Site, but make proper use of the latrines.

SP – 20 Construction Programme

A provisional Construction Programme in the Bar Chart Form is given as Appendix-II. Within the period stated
in the Contract, the Contractor shall submit to the Engineer for approval his construction programme or
schedules. The schedules shall contain adjustment, if any, to the proposed construction schedule submitted with
the Bid. The operations under each section of the schedules submitted by the Contractor shall be broken down
in greater detail than that shown on the schedule submitted with the Bid. The Start Date and Intended
Completion Date and any other target dates indicated as mandatory shall be shown as such date or earlier on
the schedule submitted by the Contractor. Other dates or rates of progress for various parts of the works in the
schedule may be changed by the Contractor after approval by the Engineer. However, the Contractor shall
schedule the work so as to enable a systematic completion of the work by segments of the Works, such as by
area command, main and subsidiary drain catchments or other logical sequence of areas/types of work.

SP – 21 Temporary Drain Crossings


The Contractor shall provide and maintain temporary crossings on any drain to allow continuous use by
vehicular or pedestrian traffic, as indicated on the Drawings and as otherwise established by the Engineer. All
costs incidental to furnishing of these temporary crossings shall be deemed to have been included in the bid
prices of the related construction items of the Bill of Quantities and no separate payment, for any reason
whatsoever, will be made to the Contractor on this account.

SP – 22 Layout of Works and Surveys

(1) The Engineer will set out reference stations on the Site with accompanying points and benchmarks to
enable the Contractor to establish therefrom his survey control in accordance with the Technical Provisions,
Section – 10, Surveying Works.

(2) The Contractor shall be responsible for all setting out. The Engineer may make checks as the work
progresses to verify lines and grades established by the Contractor and to determine the conformity of the work
with the requirements of Contract Specifications and Drawings. Such checking by the Engineer shall not
relieve the Contractor of his responsibility to perform the work in accordance with the Drawings and
Specifications and the lines and grades given therein.

(3) Where more than one reference station is given on site the Contractor shall, prior to any construction,
confirm/receive acceptance from the Engineer of elevations for each of the reference stations used. Vertical
control for each surface drain shall be effected from the first benchmark at or near the outfall of each drain.

Elevations and coordinates for location of benchmarks shall be taken from the Drawings provided.
Horizontal control for specific structures shall be relative to drain centreline RD as defined by the Engineer
and any permanent features which may be clearly marked on the drawings.
