LAND DOCUMENTATION PROCESS

1. Once a potential large tract of land is identified and preliminarily qualified based on our key criteria (e.g., led by an
enlightened clan patriarch/Datu, within the area of control of the MILF, not planted with irrigated rice, 20 meters
or more above sea level elevation, technically viable for Cavendish banana, etc.), we obtain a Cadastral Map of the
area from the DENR which contains the meets and bounds, lot nos., sizes (hectare or sq m), names of the claimants
and detailed technical descriptions. It is assumed that each claimant had applied for and obtained from the
appropriate government agency the proper legal proof of individual land ownership (see #2).

2. Based on the Cadastral Map, we locate each claimant and request him to provide us a copy of the legal proof of
individual land ownership in his possession. The common proofs include:

Original Certificate of Title (OCT) issued by the DENR


Transfer Certificate of Title (TCT) issued by the RoD
TCT/Certificate of Land Ownership (TCT/CLOA) issued by the DAR
TCT/Emancipation Patent (TCT/EP) issued by the DAR
Certificate of Stewardship Agreement (CSA) issued by DENR
Certificate of Ancestral Domain Title (CADT) issued by the DENR

2.1 Ideally, the claimant has a copy of the proof and the data in the proof and Cadastral Map are the same and
there is no compelling reason for further validation. In this case, we sign a Farm Development and Management
Contract (FDMC) with the claimant/landowner.

2.2 In case the claimant has a copy of the proof but there is/are discrepancy/ies between the data in the proof
and Cadastral Map but the claimant can produce the proper legal document that will address the discrepancy/ies
(e.g., Deed of Sale showing Person A [the name in the Cadastral Map] sold the land to Person B [the current actual
claimant] but the DoS has not yet been registered with the RoD, etc.), we sign a Memorandum of Agreement (MoA)
with the actual current claimant/landowner, as a bridge document, in gist agreeing in general that we already
commit to the provisions of the FDMC and the claimant already allows us to proceed with the plantation
development while the new TCT is being processed to support subsequently the signing of the FDMC ASAP. Ditto
for dowry, pawn, etc.

2.3 Other cases are evaluated prudently based on each specific situation. If we establish a certain level of
acceptability on the documents at hand and other pertinent documents and information, we sign a MoA similar to
#22 and work with the claimant in obtaining the proper legal proof and in eventually signing an FDMC ASAP.
