COURSE OUTLINE
in
PRACTICE COURT I

Course Description : Learning the practical aspects of law, particularly in preparing


for trial of cases.

Students will be divided into groups and each group will in turn be divided into two groups
representing the plaintiff and the defendant. The output will be a comprehensive Trial Guide in
preparation for Practice Court II where mock trials will be conducted. Each group is urged to
make use of discovery procedures provided for in the Rules of Court.

Major case topics to be taken up:

I. Group I - Petition for Habeas Corpus (Custody of Minor)


[Practice in the examination of child witness and expert witness]

II. Group II - Criminal Complaint for Rape


[Practice in interviewing the victim; possible witness/es and/or
presenting SOCO]

III. Group III - Criminal complaint for Homicide against two police officers who
killed a minor suspected of being a drug pusher
[Practice in the gathering of evidence, with emphasis on electronic
evidence].

IV. Group IV - Complaint for Damages (Reckless Imprudence resulting in Serious


Physical Injuries)
[Practice in deposing a witness; preparation of written
interrogatories]

To be submitted are the following:


1. Civil case: Complaint: Answer; Reply, Pre-Trial Brief; Judicial Affidavits; Evidence
to be presented
2. Criminal case: Complaint Affidavit for filing with the Prosecutor’s Office; Counter-
Affidavit; Reply Affidavit; Rejoinder Affidavit; Judicial Affidavit (when applicable);
Aide Memoire (for conducting direct examination); Comprehensive Trial Guide which
should include the list of witnesses, gist of their testimony, documentary/real evidence
to be presented, cross-examination guide
