    The parties file this status report pursuant to this Court’s order of July 10,

    2018. The defendants have decided to withdraw their appeal in this case. Because

    this appeal arises from a decision “adversely affecting the constitutionality” of a

    federal regulation, the Department of Justice has sent a letter notifying Congress of

    the determination not to maintain this appeal. See 28 U.S.C.

    530D(a)(1)(B)(ii). Pursuant to the terms of that letter, the Department of Justice

    expects to file a motion to dismiss this appeal in 30 days, on September 5, 2018.
