PENDAHULUAN
A LATAR BELAKANG
Negara menurut John Locke dibentuk dari sebuah kesepakatan didasarkan persetujuan
dan kepercayaan dari individu-individu yang terhimpun menjadi masyarakat yang terdiri
atas dua perjanjian masyarakat yakni pactum unionis (perjanjian membentuk negara) dan
tujuan tertentu sesuai dengan kesepatan, upaya mencapai tujuan tersebut diselenggarakan
kemudian Pemerintah. Hal ini merupakan refleksi dari cita negara hukum, setiap negara
memiliki sistem hukumnya masing-masing dan ssetiap negara juga mengklaim diri
sebagai negara hukum1, dimana salah satu ciri dari negara hukum yakni adanya
adalah sekelompok manusia yang bersama-sama mendiami suatu wilayah tertentu untuk
mengurus tata tertib dan keselamatan sekelompok atau beberapa kelompok manusia.
Konsep demikian
Pemerintahan dalam sebuah negara dikepalai oleh sebuah organ atau lembaga,
terdapat dua sistem pemerintahan di dunia yakni Presidensial dan Parlementer, serta

C KERANGKA TEORI
Negara Hukum
Negara hukum adalah konsep baku yang selalu saja mengalami simplifikasi
makna menjadi dalam negara berlaku hukum5. Padahal secara filosofis negara hukum
terhadap pengawasan hukum. Artinya, ketika hukum eksis terhadap negara, maka

berdiri di atas hukum yang menjamin keadilan kepada warga negaranya. Keadilan
merupakan syarat bagi tercapainya kebahagiaan hidup untuk warga negaranya 6. Secara
hukum yang dibuat sesuai dengan kebutuhan masyarakat sebagaimana sebuah adegium
yang berbunyi ibi societa, ibi ius. berarti bahwa dimana terdapat masyarakat maka
dengan adanya bentuk Negara (polis) Athena serta pemikiran filsuf terkemuka yakni
Plato dan Aristoteles. Plato saat itu dalam karyanya yang berjudul nomoi kemudian
diterjemahkan kedalam bahasa Inggris menjadi The Laws membahas secara khusus
dikemukakan oleh Plato dalam karyanya yang berjudul Politics dimana suatu Negara
yang baik adalah yang dijalankan berdasarkan konstitusi dan berkedaulatan hukum,
dilaksanakan atas kehendak rakyat7. Konsepsi Negara hukum terus berkembang seiring
perkembangan zaman hingga memasuki era modern saat ini. The Commission of
International Jurist menggariskan Negara Hukum dalam 3 (tiga) prinsip yakni, (1)

Negara harus tunduk pada hukum; (2) Pemerintah menghormati hak-hak individu; (3)
Ciri negara hukum secara umum kemudian dijabarkan terperinci menurut Arief
asas Negara Hukum itu secara baru, yaitu meliputi 5 (lima) hal sebagai berikut:

termaktub dalam UUD NRI Tahun 1945 Pasal 1 ayat (3) yang berbunyi “Negara
Indonesia adalah negara hukum” dengan artian bahwa Indonesia diidealkan dan dicita-
citakan oleh the founding fathers sebagai suatu negara hukum11. Bentuk dari Indonesia
sebagai negara hukum adalah terpenuhinya ciri-ciri sebuah negara hukum yang telah
yakni UUD NRI Tahun 1945. Indonesia dikenal dengan Negara hukum pancasila yang
memiliki unsur-unsur utama yakni (1) Pancasila; (2) MPRI; (3) Sistem konstitusi; (4)
Persamaan; (5)Peradilan bebas. Unsur- unsur utama yang dimiliki oleh Negara hukum
menurunkan konsep Negara Hukum Indonesia dalam 13 (tiga belas) prinsip, yakni:12
(1) supremasi hukum; (2) persamaan dalam hukum; (3) asas legalitas; (4) pembatasan
kekuasaan; (5) organ-organ campuran yang bersifat independen; (6) peradilan bebas
dan tidak memihak; (7) peradilan tata usaha negara; (8) peradilan tata negara, (9)
perlindungan hak asasi manusia; (10) bersifat demokratis; (11) berfungsi sebagai sarana
mewujudkan tujuan bernegara, (12) transparansi dan kontrol sosial dan (13)

Kedaulatan Rakyat
dalam negara adalah rakyat yang merupakan ciri negara hukum atau negara demokrasi
konstitusional13. Dalam literatur ilmu hukum atau ilmu politik, kata kedaulatan berasal
dari kata soveregnity (bahasa Inggris), souverainete (bahasa Prancis), sovranus (bahasa
Italia). Kata-kata asing tersebut diturunkan dari kata latin superanus yang berarti “yang
dan “kedaulatan” berasal dari kata Arab daulah yang berarti rezim politik atau
kekuasaan15.
Kedaulatan sebagai istilah kenegaraan timbul pada abad ke-16 oleh Jean
Bodin dalam bukunya yang berjudul Six Livres de la Republique. Dalam bukunya

Teori kedaulatan rakyat lahir atas reaksi pada kedaulatan. Pelopor dari teori
bahwa kekuasaan tertinggi berada ditangan rakyat, Raja atau Kepala Negara hanya
merupakan pelaksana dari apa yang telah diputuskan atau dikehendaki oleh Rakyat.
Demokrasi
Demokrasi berasal dari bahasa yunani yakni demos yang berarti pemerintah dan
cratos yang berarti rakyat. Maka Demokrasi dapat diartikan sebagai pemerintahan yang
kekuasaan tertingginya berada ditangan rakyat, yang dikenal dengan pemerintahan dari-
oleh-unruk rakyat. Demokrasi berkembang pesat dan menjadi sistem pilihan untuk
sepenuhnya hanya mungkin terjadi pada negara yang wilayah dan jumlah warganya
sangat kecil, seperti di negara kota (polis) pada masa Yunani Kuno17. Demokrasi dalam

dikemukakan oleh David Held yang memaparkan 10 (sepuluh) model demokrasi,
yaitu19:
pribadi. Model ini disebut protektif karena tujuannya adalah untuk melindungi
pada masyarakat non industri yang merdeka dalam urusan ekonomi dan
politik. Warga negara menikmati persamaan politik dan ekonomi, tidak ada
orang yang menjadi bawahan orang lain. Lembaga legislatif dipilih secara
langsung. Eksekutif dijalankan oleh para pegawai yang ditunjuk atau dipilih
secara langsung.
iv. Developmental Democracy. Sistem ini ada pada negara laissez fairez yang
sebagai alat produksi. Dengan model ini politik diperlukan untuk : (1)

melindungi kepentingan individu, dan (2) kemajuan kelompok terpejalar
membangun masyarakat.
v. Direct Democracy and the End of Politics. Sistem ini ada pada msyarakat yang
mencapai kekebasan semua warga negara. Urusan publik dijalankan dan diatur
oleh seluruh anggota komunitas. Smeua pegawai dipilih dan dapat dihentikan

yang sempurna dengan sumber daya yang tersedia bagi semua orang serta
keterbukaan dan informasi dipastikan dapat diakses oleh seriap orang. Ciri-ciri
model ini meliputi : (1) warga negara berpartisipasi langsung dalam setiap
kebebasan dan kesamaan kondisi dan otonomi bagi kehidupan setiap individu
serta menjamin hak dan kewajiban yang sama. Karakteristik model ini
meliputi : (1) otonomi diabadikan dalam konstitusi; (2) sistem kepartaian yang

kekuasaan (separation of power) itu juga mencakup pengertian pembagian kekuasaan
yang biasa disebut dengan istilah division of power (distribution of power). Pemisahan
kekuasaan bersifat horizontal dalam arti kekuasaan dipisah- pisahkan ke dalam fungsi-
fungsi yang tercermin dalam lembaga-lembaga negara yang sederajat dan saling
dalam arti perwujudan kekuasaan itu dibagikan secara vertikal ke bawah kepada
fungsi. Pertama kali mengenai fungsi-fungsi kekuasaan negara dikenal di Perancis pada
abad ke-XVI, pada umumnya diakui lima yaitu: (i) fungsi diplomacie; (ii) fungsi

DIBERBAGAI NEGARA
Komparasi atau perbandingan adalah salah satu metode pendekatan yang digunakan
dalam ilmu hukum dengan melihat persamaan dan perbedaan yang dimiliki oleh objek yang
adalah salah satu kunci pembelajaran hukum tata negara dalam konteks umum. 35
Perbandingan hukum tata negara, atau perbandingan konstitsi, merupakan cabang ilmu
hukum yang menggunakan metode perbandingan satu aspek hukum tata negara antara dua
negara atau lebih.36 Memahami banyak konstitusi di dunia akan sangat bermanfaat untuk
memperluas spektrum pemikiran dan menemukan solusi kreatif terhadap persoalan yang
dihadapi bangsa37. Maka, guna memahami bagaimana penetapan pasangan calon terpilih

The procedure set out in Part A of Schedule 3 applies to the election of the President.
(3) An election to fill a vacancy in the office of President must be held at a time and
on a date determined by the President of the Constitutional Court, but not more than
30 days after the vacancy occurs.
Section 87 Assumption of office by President : When elected President, a person
ceases to be a member of the National Assembly and, within five days, must assume
office by swearing or affirming faithfulness to the Republic and obedience to the
Constitution, in accordance with Schedule 2.
Section 88 Term of office of President : (1) The President's term of office begins on
assuming office and ends upon a vacancy occurring or when the person next elected
President assumes office. (2) No person may hold office as President for more than
two terms, but when a person is elected to fill a vacancy in the office of President, the
period between that election and the next election of a President is not regarded as a
term.

Section (1) : The President of the Republic is elected by direct, secret and universal
suffrage.
Section (2) : The election acquired through the absolute majority of the expressed
votes.
Section (3) : The other modes of presidential election are defined by the law.
Article 72
The President of the Republic exercises the supreme magistracy within the limits
defined by the Constitution.
Article 73
Section (1) : To be eligible to the Presidency of the Republic, the candidate should: -
have, solely, the Algerian nationality by origin; - be a Muslim; - be more than forty
(40) years-old the day of the election; - enjoy full civil and political rights; - prove the
Algerian nationality of the spouse; - justify his participation in the 1st of November
1954 Revolution for the candidates born before July 1942; - justify the non-
involvement of the parents of the candidate born after July 1942, in actions hostile to

the 1st of November 1954 Revolution; - submit a public declaration of his personal
and real estate existing either within Algeria or abroad.
Section (2) : Other conditions are prescribed by the law.
Article 74
Section (1) : The duration of the presidential mandate is five (5) years.
Section (2) : The President of the Republic can be reelected once only.
Article 75
Section (1) : The President of the Republic takes an oath before the People and in the
presence of the high authorities of the Nation, in the week following his election.
Section (2) : He enters into of lice after taking the Oath.
Article 76
The President of the Republic takes the Oath in the following terms:

reinforcement of the democratic process, respect the free choice of the people as well
as the institutions and laws of the Republic, preserve the integrity of the national
territory, the unity of the people and the nation, protect the fundamental human and
citizen's rights and liberties, work for the development and progress of the people and
put all my strength to the achievement of the great ideals of justice, freedom and
peace in the world. God is my witness"

Person holding an Office of Trust or Profit under the United States, shall be appointed
an Elector.
(3) The Electors shall meet in their respective States, and vote by Ballot for two
Persons, of whom one at least shall not be an Inhabitant of the same State with
themselves. And they shall make a List of all the Persons voted for, and of the
Number of Votes for each; which List they shall sign and certify, and transmit sealed
to the Seat of the Government of the United States, directed to the President of the
Senate. The President of the Senate shall, in the Presence of the Senate and House of
Representatives, open all the Certificates, and the Votes shall then be counted. The
Person having the greatest Number of Votes shall be the President, if such Number be
a Majority of the whole Number of Electors appointed; and if there be more than one
who have such Majority, and have an equal Number of Votes, then the House of
Representatives shall immediately chuse by Ballot one of them for President; and if
no Person have a Majority, then from the five highest on the List the said House shall
in like Manner chuse the President. But in chusing the President, the Votes shall be
taken by States the Representation from each State having one Vote; A quorum for this
Purpose shall consist of a Member or Members from two thirds of the States, and a
Majority of all the States shall be necessary to a Choice. In every Case, after the
Choice of the President, the Person having the greater Number of Votes of the Electors
shall be the Vice President. But if there should remain two or more who have equal
Votes, the Senate shall chuse from them by Ballot the Vice President.
(4) The Congress may determine the Time of chusing the Electors, and the Day on
which they shall give their Votes; which Day shall be the same throughout the United
States.
(5) No person except a natural born Citizen, or a Citizen of the United States, at the
time of the Adoption of this Constitution, shall be eligible to the Office of President;
neither shall any Person be eligible to that Office who shall not have attained to the
Age of thirty five Years, and been fourteen Years a Resident within the United States.
(6) In case of the removal of the President from Office, or of his Death, Resignation
or Inability to discharge the Powers and Duties of the said Office, the Same shall
devolve on the Vice President, and the Congress may by Law provide for the Case of
Removal, Death, Resignation or Inability, both of the President and Vice President,
declaring what Officer shall then act as President, and such Officer shall act
accordingly, until the Disability be removed, or a President shall be elected.
(7) The President shall, at stated Times, receive for his Services, a Compensation,
which shall neither be increased nor diminished during the Period for which he shall
have been elected, and he shall not receive within that Period any other Emolument
from the United States, or any of them.
(8) Before he enter on the Execution of his Office, he shall take the following Oath or
Affirmation: "I do solemnly swear (or affirm) that I will faithfully execute the Office
of President of the United States, and will to the best of my Ability, preserve, protect
and defend the Constitution of the United States."

D. ARGENTINA

pemerintahan didampingi oleh seorang Wakil Presiden yang dipilih secara langsung setiap 4
tahun, diperbolehkan menjabat selama tidak lebih dari dua periode dan kemudian diperboleh
dipilih kembali ketika mencapai maksimal masa jabatan setelahnya tidak aktif untuk satu

Section 87 : The Executive Power of the Nation shall be vested in a citizen with the

Vice- President of the Nation. In case of removal, death, resignation, or inability of
the President and the Vice- President of the Nation, Congress shall determine the
public officer who shall exercise the Presidency until the ceasing of the grounds of
inability or the election of a new President.

Section 89 : To be elected President or Vice-President of the Nation it is necessary to
have been born in the Argentine territory, or to be the son of a native born citizen if
born in a foreign country; and to have the other qualifications required to be elected
senator.
Section 90 : The President and Vice-President shall hold their offices for the term of
four years; and they may be re- elected or may succeed each other for only one
consecutive term. If they have been re-elected or they have succeeded each other, they
cannot be elected for either of these two positions but with the interval of one term.
Section 91 : The President of the Nation shall cease to exercise power on the same
day his four-years term expires; no event that may have interrupted it shall constitute
grounds for completing the term later.
Section 92 : The President and Vice-President receive a remuneration paid out of the
Treasury of the Nation, which shall not be altered during their term of office. During
this same period they shall neither hold any other office nor receive any other
emolument from the Nation or from any province whatsoever.
Section 93 : On assuming office, the President and Vice- President shall take oath
before the President of the Senate and before Congress assembled, respecting their
religious beliefs, to: "perform with loyalty and patriotism the office of President (or
Vice-President) of the Nation, and to faithfully observe the Constitution of the
Argentine Nation, and to cause it to be observed.

E. AUSTRIA

Article 60 [Election]
(1) The Federal President is elected by the nation on the basis of equal, direct, secret,
and personal suffrage. If there is only one candidate, the election takes place by way
of referendum. Anyone with House of Representatives suffrage is entitled to vote.
Voting in the election is compulsory in Federal States where State law so provides.
Detailed provisions about the electoral procedure and possible compulsory voting will
be established by a federal law. This same law shall in particular lay down the reasons
held to excuse non-participation in the election regardless of compulsory voting.
(2) The candidate who polls more than half of all valid votes has been elected. If no
such majority results, a second ballot takes place. Votes in this can validly be cast only
for one of the two candidates who have polled the most votes in the first ballot; but
each of the two groups of voters who put up these two candidates can in the second
ballot nominate another individual to replace its original candidate.
(3) Only a person who has House of Representatives franchise and was thirty five
years old before the first of January of the year in which the election is held can be
elected Federal President. Members of reigning houses or of formerly regnant families
are excluded from eligibility.
(4) The result of the election of the Federal President shall be officially published by
the Federal Chancellor.
(5) The Federal President holds office for six years. Re-election for the immediately
following term of office is admissible once.

(6) Before expiry of his term of office the Federal President can be deposed by
referendum. The referendum shall be held if the Federal Assembly so demands. The
Federal Assembly shall be convoked by the Federal Chancellor for this purpose if the
House of Representatives has passed such a motion. The House of Representatives
vote requires the presence of at least half the members and a majority of two thirds of
the votes cast. By such a House of Representatives vote, the Federal President is
prevented from the further exercise of his office. Rejection by the referendum of the
deposition works as a new election and entails the dissolution of the House of
Representatives (Article 29 (1)). The Federal President's total term of office may not
exceed twelve years.
Article 61 [Incompatibility]
(1) During his tenure of office, the Federal President may not belong to any popular
representative body nor exercise any other occupation.
(2) The title "Federal President" may not, even with an addition or in the context of
another designation, be used by anyone else. It is protected by law.
Article 62 [Oath]
(1) On his assumption of office the Federal President renders the following
affirmation before the Federal Assembly:
"I solemnly promise that I shall faithfully observe the Constitution and all the laws of
the Republic and shall fulfill my duty to the best of my knowledge and belief."

(3) In the exercise of all his functions, save only that of appointing The Prime

Minister; Provided that The question whether any, and if so what, advice has been
tendered by The Prime Minister to the President shall not be enquired into in any
court.
(4) A person shall not be qualified for election as President if hea. is less than thirty-
five years of age; bor b. is not qualified for election a member of Parliament; or c. has
been removed from the office of President by impeachment under this Constitution.
(5) The Prime Minister shall keep the President informed on matters of domestic and
foreign policy, and submit for the consideration of The Cabinet any matter which the
President may request him to refer to it.

G. BRAZIL

Ketentuan demikian dapat dilihat dalam Konstitusi Brazil yakni sebagai berikut :
Article 77 [Election] : (0) Election of the President and of the Vice President of the
Republic takes place simultaneously, ninety days before the end of the current
presidential term of office; (1) Election of the President of the Republic includes
election of the Vice President registered with him; (2) The candidate who, being
registered by a political party, obtains an absolute majority of votes, not counting
blank or void votes, is considered to be elected as President; (3) If no candidate
attains an absolute majority in the first ballot, another election hat to be held within
twenty days after announcement of the results; the two candidates who obtained the
greatest number of votes then compete and the one who obtains a majority of valid
votes is considered elected; (4) In the event that, before the second election is held, a
candidate dies, withdraws, or is legally impaired, the candidate with the greatest
number of votes among the remaining candidates is called.; (5) If, in the event of the

preceding paragraphs, more than one candidate with an equal number of votes
remain in second place, the eldest one is qualified.
Article 78 [Taking of office, Oath Before Congress: (0) The President and the Vice
President of the Republic takes office in a session of Congress. They take an oath to
maintain, defend, and carry out the Constitution, comply with the laws, further the
general good of the Brazilian people, sustain the union, integrity, and independence
of Brazil: (1) In the event that ten days as from the date scheduled for taking of
office, the President or the Vice President, except for force majeure, has not taken
office, such office has to be declared vacant.
Article 79 [Vice President]: (0) The Vice President replaces the President in the
event of impediment and succeeds him in the event of vacancy; (1) The Vice
President of the Republic, in addition to other duties attributed to him by
supplemental laws, assists the President whenever called by the President for special
missions.
Article 82 [Term]: The term of office of the President of the Republic is four years
and he may not be re-elected for the subsequent term. { Note: The 1997 re-eletion
amendment is in force, but has not yet been included into the ICL-Edition. } The
term of office commences on January 1st of the year following the year of his
election.

H. ESTONIA

An Estonian citizen by birth who has attained forty years of age may be nominated as
a candidate for President of the Republic.
The President of the Republic shall be elected by secret ballot. Each member of the
Riigikogu shall have one vote. A candidate in favour of whom a two-thirds majority
of the membership of the Riigikogu votes shall be considered elected. If no candidate
receives the required majority, a new round of voting shall be held on the next day.
Before the second round of voting, a new nomination of candidates shall be held. If
no candidate receives the required majority in the second round of voting, a third
round of voting shall be held on the same da between the two candidates who receive
the greatest number of votes in the second round. If the President of the Republic is
still not elected in the third round of voting, the Chairman of the Riigikogu shall,
within one month, convene an electoral body to elect the President of the Republic.

The electoral body shall be comprised of members of the Riigikogu and
representatives of the local government councils. Each local government council shall
elect at least one representative to the electoral body, who must be an Estonian citizen.
The Riigikogu shall present the two candidates who receive the greatest number of
votes in the Riigikogu to the electoral body as candidates for President. The rig-t to
nominate a candidate for President also rests with not less than twentyone members of
the electoral body.
The electoral body shall elect the President of the Republic by a majority of the voting
electoral body members. If no candidate is elected in the first round, a second round
of voting shall be held on the same day between the two candidates who receive the
greatest number of votes.
The specific procedure for the election of the President of the Republic shall be
provided by the President of the Republic Election Act.

(3) There shall be a Vice-President who shall have the same qualifications and term of
office and be elected with, and in the same manner, as the President. He may be
removed from office in the same manner as the President. The Vice-President may be
appointed as a Member of the Cabinet. Such appointment requires no confirmation.

(4) The President and the Vice-President shall be elected by direct vote of the people
for a term of six years which shall begin at noon on the thirtieth day of June next
following the day of the election and shall end at noon of the same date, six years
thereafter. The President shall not be eligible for any re-election. No person who has
succeeded as President and has served as such for more than four years shall be
qualified for election to the same office at any time. No Vice-President shall serve for
more than two successive terms. Voluntary renunciation of the office for any length of
time shall not be considered as an interruption in the continuity of the service for the
full term for which he was elected. Unless otherwise provided by law, the regular
election for President and Vice-President shall be held on the second Monday of May.
The returns of every election for President and Vice-President, duly certified by the
board of canvassers of each province or city, shall be transmitted to the Congress,
directed to the President of the Senate. Upon receipt of the certificates of canvass, the
President of the Senate shall, not later than thirty days after the day of the election,
open all the certificates in the presence of the Senate and the House of
Representatives in joint public session, and the Congress, upon determination of the
authenticity and due execution thereof in the manner provided by law, canvass the
votes. The person having the highest number of votes shall be proclaimed elected, but
in case two or more shall have an equal and highest number of votes, one of them
shall forthwith be chosen by the vote of a majority of all the Members of both Houses
of the Congress, voting separately. The Congress shall promulgate its rules for the
canvassing of the certificates. The Supreme Court, sitting en banc, shall be the sole
judge of all contests relating to the election, returns, and qualifications of the
President or Vice-President, and may promulgate its rules for the purpose.

K. GHANA

Article 62 : A person shall not be qualified for election as the President of Ghana
unless - (a) he is a citizen of Ghana by birth; (b) he has attained the age of forty
years; and (c) he is a person who is otherwise qualified to be elected a Member of
Parliament, except that the disqualifications set out in paragraphs (c), (d), and (e) of
clause (2) of article 94 of this Constitution shall not be removed, in respect of any
such person, by a presidential pardon or by the lapse of time as provided for in clause
(5) of that article.
Article 63
(1) A person shall not be a candidate in a presidential election unless he is nominated
for election as President by a document which - (a) is signed by him; and (b) is
signed by not less than two persons who are registered voters resident in the area of
authority of each district assembly; (c) is delivered to the Electoral Commission on or
before the day appointed as nomination day in relation to the election; (d) designates a
person to serve as Vice-President.
(2) The election of the President shall be on the terms of universal adult suffrage and
shall, subject to the provisions of this Constitution, be conducted in accordance with
such regulations as may be presecribed by constitutional instrument by the Electoral
Commission and shall be held so as to begin - (a) where a President is in office, not
earlier than four months nor later than one month before his term of office expires;
and (b) in any other case, within three months after the office of President becomes
vacant; and shall be held at such place and shall begin on such date as the Electoral
Commission shall, by constitutional instrument, specify.
(3) A person shall not be elected as President of Ghana unless at the presidential
election the number of votes cast in his favour is more than fifty per cent of the total
number of valid votes cast at the election.
(4) Where at a presidential election there are more than two candidates and no
candidate obtains the number or percentage of votes specified in clause (3) of this

article a second election shall be held within twenty-one days after the previous
election.
(5) The candidates for a presidential election held under clause (4) of this article shall
be the two candidates who obtained the two highest numbers of votes at the previous
election.
(6) Where at a presidential election three or more candidates obtain the two highest
numbers of votes referred to in clause (5) of this article, then unless there are
withdrawals such that only two candidates remain, another election shall held within
twenty-one days after the previous election at which the candidates who obtained the
two highest numbers of votes shall, subject to any withdrawal, be continued until a
President is elected.
(7) A presidential candidate under clause (5) or (6) of this article may, be writing
under his hand, withdraw his candidature at any time before the election.
(8) If after a second presidential election held under clause (4) of this article the two
candidates obtained an equal number of votes, then, notwithstanding any withdrawal,
another election shall be held within twenty-one days after the election at which the
two candidates shall be the only candidates and the same process shall, subject to any
withdrawal, be continued until a President is elected.
(9) An instrument which - (a) is executed under the hand of the Chairman of the
Electoral Commission and under the seal of the Commission; and (b) states that the
person named in the instrument was declared elected as the President of Ghana at the
election of the President, shall be prima facie evidence that the person named was so
elected.
Article 64.
(1) The validity of the election of the President may be challenged only by a citizen of
Ghana who may present a petition for the purpose to the Supreme Court within
twenty-one days after the declaration of the result of the election in respect of which
the petition is presented.
(2) A declaration by the Supreme Court that the election of the President is not valid
shall be without prejudice to anything done by the President before the declaration.
(3) The Rules of Court Committee shall, by constitutional instrument, make rules of
court for the practice and procedure for petitions to the Supreme Court challenging
the election of a President.
Article 65
The Electoral Commission shall, by constitutional instrument, make regulations for
the purpose of giving effect to article 63 of this Constitution.
Article 66.
(1) A person elected as President shall, subject to clause (3) of this article, hold office
for a term of four years beginning from the date on which he is sworn in as President.
(2) A person shall not be elected to hold office as President of Ghana for more than
two terms.
(3) The office of President shall become vacant - (a) on the expiration of the period
specified in clause (1) of this article; or (b) if the incumbent dies or resigns from
office or ceases to hold office under article 69 of this Constitution.
(4) The President may, by writing signed by him, and addressed to the Speaker of
Parliament, resign from his office as President.

dividing the population of the State by the total number of the elected members of
the Assembly; (b) if, after taking the said multiples of one thousand, the remainder is
not less than five hundred, then the vote of each member referred to in sub-clause (a)
shall be further increased by one; (c) each elected member of either House of
Parliament shall have such number of votes as may be obtained by dividing the total
number of votes assigned to the members of the Legislative Assemblies of the States
under sub-clauses (a) and (b) by the total number of the elected members of both
Houses of Parliament, fractions exceeding one-half being counted as one and other
fractions being disregarded; (3) The election of the President shall be held in
accordance with the system of proportional representation by means of the single
transferable vote and the voting at such election shall be by secret ballot.
Explanation: In this article, the expression "population" means the population as
ascertained at the last preceding census of which the relevant figures have been
published: Provided that the reference in this Explanation to the last preceding
census of which the relevant figures have been published shall, until the relevant
figures for the first census taken after the year 2000 have been published, be
construed as a reference to the 1971 census.
Article 57 Eligibility for re-election : A person who holds, or who has held, office
as President shall, subject to the other provisions of this Constitution be eligible for
re-election to that office.

Article 66 Election of Vice-President : (1) The Vice-President shall be elected by
the members of an electoral college consisting of the members of both Houses of
Parliament in accordance with the system of proportional representation by means of
a single transferable vote and the voting at such election shall be by secret ballot; (2)
The Vice-President shall not be a member of either House of Parliament or of a
House of the Legislature of any State, and if a member of either House of Parliament
or of a House of the Legislature of any State be elected Vice-President, he shall be
deemed to have vacated his seat in that House on the date on which he enters upon
his office as Vice-President; (3) No person shall be eligible for election as Vice-
President unless he - (a) is a citizen on India; (b) has completed the age of thirty-five
years; and (c) is qualified for election as a member of the Council of States; (4) A
person shall not be eligible for election as Vice-President if he holds any office of
profit under the Government of India or the Government of any State or under any
local or other authority subject to the control of any of the said Governments.
Explanation: For the purposes of this article, a person shall not be deemed to hold
any office of profit by reason only that he is the President of Vice-President of the
Union or the Governor of any State or is a Minister either for the Union or for any
State.

House of Representatives [Bundestag]; (6) The person receiving the votes of the
majority of the members of the Federal Convention is elected. Where such majority is
not obtained by any candidate in two ballots, the candidate who receives the largest
number of votes in the next ballot is elected; (7) Details are regulated by a federal
statute.
Article 56 [Oath of office]: On assuming his office, the President takes the following
oath before the assembled members of the House of Representatives [Bundestag] and
the Senate [Bundesrat]: "I swear that I will dedicate my efforts to the well-being of the
German people, enhance their benefits, avert hamm from them, uphold and defend the
Constitution and the statutes of the Federation, fulfil my duties conscientiously, and
do justice to all. So help me God." The oath may also be taken without religious
affirmation.

Article 190 : The President of the Republic will be elected for a period of four (4)
years by [a majority of] one-half plus one of the ballots which, in a secret and direct
manner, the citizens will cast on the date and following the procedures determined
by the law. If no candidate should secure the said majority, a runoff election will be
held three (3) weeks later when only those two (2) candidates who received the most
votes in the first round of balloting will participate. The candidate with the larger
number of votes will be declared President.
In the case of the death or permanent physical incapacity of either of the two (2)
candidates receiving the majority of votes, his/her party or political movement may
enter a new candidate for the runoff election. If the party or movement fails to do so
or if the vacancy stems from another reason, that candidate will be replaced by
whoever won third place in the first round and so on in successive and descending
order.
Should the vacancy occur less than two (2) weeks before the second round of
balloting, the second round will be postponed by 15 days
Article 191 : In order to be President of the Republic, an individual must be
Colombian by birth, a citizen in good standing, and over 30 years of age.

Article 192 : The President of the Republic will assume his/her office before
Congress and will take the following oath: “I swear to God and promise to the
people to faithfully execute the Constitution and the laws of Colombia.”
If, for any reason, the President should be unable to assume his/her office before
Congress, he/she will do so before the Supreme Court of Justice or, failing that,
before two (2) witnesses.
Article 197 : No one may be elected to occupy the post of President of the Republic
for more than two (2) terms of office.
Nobody may be elected President or Vice President of the Republic who has fulfilled

may any citizen be elected who has held one of the following posts in the year
preceding the election:

Justice, of the Constitutional Court, of the Council of State, of the Superior Council
of Judicature, or of the National Electoral Council; General Prosecutor of the
Nation; Ombudsman; Controller General of the Republic; Attorney General of the
Nation; National Registrar of Civil Status; Commanders of the Armed Forces;
Director General of the Police; Departmental Governor; or Mayor.
Article 202 : The Vice President of the Republic will be elected by popular vote on
the same day and in the same manner as the President of the Republic.
The candidates for the runoff election, if there should be one, will in each case be
those who participated in the general election.
The Vice President will hold office for the same period as the President and will
replace the President in case of temporary or permanent presidential vacancy, even if
such a vacancy should occur before the assumption by the President of his/her
office.
In case of a temporary vacancy in the position of President of the Republic, it will be
sufficient that the Vice President should take possession of the President’s position
as soon as possible so that he/she may exercise it whenever necessary. In case of a
permanent vacancy in the position of the President of the Republic, the Vice
President will assume the office until the end of the term.
The President of the Republic will be able to entrust to the Vice President missions
or special duties and to assign to him/her any responsibility of the Executive Branch.
The Vice President may not assume the functions of Minister-Delegate.
Article 203 : When there is a vacancy in the position of Vice President due to his/her
assumption of the powers of the Presidency, the office [of Vice President] will be
assumed by a minister in the order of precedence established by law. The individual
who, in accordance with this article, replaces the President will belong to the same
party or movement and will exercise the Presidency until such time as Congress, in
its own right and within the thirty (30) days following the date when the presidential
vacancy occurs, elects the Vice President who will assume the Presidency of the
Republic.

Article 204 : In order to be elected Vice President the same qualifications are
required which are needed to be President of the Republic.
The Vice President may be reelected for the following term if he/she joins the ticket
of the incumbent President.
The Vice President may be elected President of the Republic for the following term
if the incumbent President does not present himself/herself as candidate.
Article 205 : In case of a permanent vacancy in the position of Vice President,
Congress will meet in its own right or on convocation by the President of the
Republic in order to elect [the person] who will fill the office for the rest of the term.
A permanent vacancy in the position of Vice President is created by his/her death,
his/her accepted resignation, or permanent physical disability recognized by
Congress.
Article 262 : The election of the President and Vice President may not overlap other
elections. Congressional elections will be carried out on a date separate from the
election of departmental and municipal officials.

service of Pakistan or occupy any other position carrying the right to remuneration

Article 44 Section (1) : Subject to the Constitution, the President shall hold office
for a term of five years from the day he enters upon his office: Provided that the
President shall, notwithstanding the expiration of his term, continue to hold office
until his successor enters upon his office.
Article 44 Section (2) : Subject to the Constitution, a person holding office as
President shall be eligible for re election to that office, but no person shall hold that
office for more than two consecutive terms.

Article 7 Section (3) : The election of the new President shall take place not less
than twenty days and not more than thirty-five days before the expiry of the powers
of the President in office.

Article 7 Section (4) : In the event of the Presidency of the Republic falling vacant
for any cause whatsoever, or of an impediment being formally recorded by the
Constitutional Council upon referral to it by the Government and ruling by an
absolute majority of its members, the functions of the President of the Republic,
with the exception of those laid down in Articles 11 and 12 below, shall be
temporarily exercised by the President of the Senate, or, if the latter is in his turn
impeded from exercising these functions, by the Government. In the event of a
vacancy, or when the impediment is declared permanent by the Constitutional
Council, polling for the election of a new President shall take place, except in cases
of force majeure formally recognized by the Constitutional Council, not less than
twenty days and not more than thirty-five days after the beginning of the vacancy or
the declaration of the permanence of the impediment. If one of the persons who
publicly announced their decision to stand for election less than thirty days before
the final date for lodging the presentations of candidature dies or is otherwise
prevented within seven days prior to that date, the Constitutional Council may
decide to postpone the election.
Article 7 Section (5) : If one of the candidates dies or is otherwise prevented before
the first ballot, the Constitutional Council shall pronounce the postponement of the
election.
Article 7 Section (6) : Should one of the candidates heading the poll in the first
ballot die or be otherwise prevented prior to any withdrawals, the Constitutional
Council shall declare that the election procedure must be repeated in full; the same
shall apply in the event of one of the candidates standing in the second ballot dying
or being otherwise prevented.
Article 7 Section (7) : All cases shall be referred to the Constitutional Council in the
manner set out in the second paragraph of Article 61 below or determined for the
presentation of candidates in the organic act provided for in Article 6 above.
Article 7 Section (8) : The Constitutional Council may extend the periods stipulated
in the third and fifth paragraphs, provided that polling takes place not later than
thirty-five days after the Constitutional Council's decision. If implementation of the
provisions of this paragraph results in the postponement of the election to a date.
after the expiry of the powers of the President in office, the latter shall remain in
office until the proclamation of his successor.
Article 7 Section (9) : Neither Articles 9 and 50 nor Article 89 of the Constitution
may be applied while the Presidency of the Republic is vacant, nor during the period
between the declaration of the permanence of the impediment preventing the
President of the Republic from discharging his duties and the election of his
successor.

Indonesia adalah negara kesatuan dengan jumlah penduduk pada tahun 2015 sebanyak
252.370.792 jiwa40 dan luas wilayah sebesar 1.913.578,68km2 terdiri atas pulau-pulau baik
kecil maupun besar yang kemudian dibagi menjadi 34 Provinsi41. Untuk mengakomodir
kebutuhan rakyat yang cukup banyak jumlahnya dimana Indonesia dinobatkan sebagai negara
terdapat nomor 4 dengan perkiraan penduduk pada tahun 2018 sebanyak 262.787.403 jiwa 42.

demokrasi dan negara hukum dimana Pemilu merupakan salah cara pelaksanaan demokrasi
mengingat bahwa tidak ada satu negarapun yang sepenuhnya dapat menjalankan demokrasi
langsung, kemudian rakyat melalui Pemilu dapat memilih wakil-wakil yang membentuk
produk hukum, serta melakukan pengawasan pelaksanaan hukum. Pemilu juga merupakan
representasi pelaksanaan ciri negara hukum yang lain yaitu pelaksanaan perlindungan hak
asasi manusia, khususnya hak untuk memilih dan dipilih, serta wujud dari persamaan

Dan terdapat bagian khusus dalam UUD NRI Tahun 1945 selaku konstitusi negara
yang membahas berkenaan dengan Pemilu yakni dalam BAB VIIB : Pemilihan Umum, yang
merupakan hasil amandemen ke-3 UUD NRI Tahun 1945 yakni Pasal 22E yang terdiri atas 6
Pasal 22E ayat (1) : Pemilihan umum dilaksanakan secara langsung, umum, bebas,
rahasia, jujur, dan adil setiap lima tahun sekali.
Pasal 22E ayat (2) : Pemilihan umum diselenggarakan untuk memilih anggota
Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Presiden dan Wakil Presiden
dan Dewan Perwakilan Rakyat Daerah.
Pasal 22E ayat (3) : Peserta pemilihan umum untuk memilih anggota Dewan
Perwakilan Rakyat dan anggota Dewan Perwakilan Rakyat Daerah adalah partai
politik.
Pasal 22E ayat (4) : Peserta pemilihan umum untuk memilih anggota Dewan
Perwakilan Daerah adalah perseorangan.
Pasal 22E ayat (5) : Pemilihan umum diselenggarakan oleh suatu komisi
pemilihan umum yang bersifat nasional, tetap, dan mandiri.
Pasal 22E ayat (6) :Ketentuan lebih lanjut tentang pemilihan umum diatur dengan
undang-undang.
Indonesia adalah negara dengan sistem presidensial dimana Presiden berperan sebagai
kepala negara sekaligus kepala pemerintahan, hal ini mengacu kepada amanat konsitusi yakni
Pasal 4 ayat (1) UUD NRI Tahun 1945, "Presiden Republik Indonesia memegang kekuasaan
didampingi dan dibantu oleh seorang Wakil Presiden sebagaimana diatur dalam Pasal 4 ayat
(2) UUD NRI Tahun 1945, “Dalam melakukan kewajibannya Presiden dibantu oleh satu
orang Wakil Presiden”. Dalam kurun waktu 1945 hingga saat ini Indonesia memiliki Presiden

pemilihan, peresmian atau pelantikan para calon terpilih46. Berdasarkan Pasal 22E ayat (5)
UUD NRI Tahun 1945 maka penyelenggaraan pemilihan umum dipegang oleh sebuah komisi
yang bertanggung dalam keseluruhan tahapan ini, komisi tersebut yakni KPU (Komisi
Pemilihan Umum) yang kemudian bersama dengan badan pengawasan yakni BAWASLU

Hasil amandemen UUD NRI Tahun 1945 yang ke-3 pada tahun 2001 juga
menambahkan mekanisme pengisian jabatan Presiden dan Wakil Presiden secara lebih rinci
dalam Pasal 6A dan 7 UUD NRI Tahun 1945 yang menjadi guide line Pemilu Presiden dan
Pasal 6A ayat (1) UUD NRI Tahun 1945 :Presiden dan Wakil Presiden dipilih dalam
satu pasangan secara langsung oleh rakyat
Pasal 6A ayat (2) UUD NRI Tahun 1945: Pasangan calon Presiden dan Wakil Presiden
diusulkan oleh partai politik atau gabungan partai politik peserta pemilihan umum
sebelum pelaksanaan pemilihan umum.
Pasal 6A ayat (3) UUD NRI Tahun 1945: Pasangan calon Presiden dan Wakil Presiden
yang mendapatkan suara lebih dari lima puluh persen dari jumlah suara dalam
pemilihan umum dengan sedikitnya dua puluh persen suara di setiap provinsi yang
tersebar di lebih dari setengah jumlah provinsi di Indonesia, dilantik menjadi Presiden
dan Wakil Presiden.
Pasal 6A ayat (4) UUD NRI Tahun 1945: Dalam hal tidak ada pasangan calon
Presiden dan Wakil Presiden terpilih dua pasangan calon yang memperoleh suara
terbanyak pertama dan kedua dalam pemilihan umum dipilih oleh rakyat secara
langsung dan pasangan yang memperoleh suara rakyat terbanyak dilantik sebagai
Presiden dan Wakil Presiden.
Pasal 6A ayat (5) UUD NRI Tahun 1945: Tata cara pelaksanaan pemilihan Presiden
dan Wakil Presiden lebih lanjut diatur dalam undang-undang.
Pasal 7 UUD NRI Tahun 1945: Presiden dan Wakil Presiden memegang jabatan
selama lima tahun, dan sesudahnya dapat dipilih kembali dalam jabatan yang sama,
hanya untuk satu kali masa jabatan.
Partai politik yang dapat mengusulkan calon Presiden dan Wakil Presdien adalah yang
dapat disebut sebagai “peserta pemilihan umum” dengan telah memenuhi beberapa tahapan

2. Melewati tahap verifikasi administrasi dan faktual di lapangan untuk memastikan
undang.
3. Mendapatkan keputusan dari KPU sebagai partai politik peserta pemilihan umum.
Pemilu Presiden dan Wakil Presiden di Indonesia dilakukan lima tahun sekali
sebagaimana disebutkan dalam Pasal 7 UUD NRI Tahun 1945. Terdapat beberapa alasan
1. Pendapat atau aspirasi rakyat mengenai berbagai aspek kehidupan bersama dalam
masyarakat bersifat dinamis dan berkembang dari waktu ke waktu. Dalam jangka
waktu tertentu dapat saja terjadi sebagian besar rakyat berubah pendapatnya mengenai
kebijakan negara.
2. Kondisi kehidupan bersama dalam masyarakat dapat berubah baik dinamika di dalam
jumlah penduduk dan rakyat dewasa terutama para pemilih baru (new voter) atau
pemilih pemula belum tentu mempunyai sikap yang sama dengan generasi terdahulu.
Perkembangan proses penetapan dan pemilihan Presiden dan Wakil Presiden menurut
Saldi Isra yang dibagi menjadi tiga periode yakni orde baru, era reformasi, dan pasca

mengalami sepuluh kali Pemilu. Mekanisme maupun pelaksanaan Pemilu di Indonesia dari
masa ke masa berkembang sejalan dengan tuntutan demokrasi 50. Sebagimana dipaparkan
diatas, Presiden dan Wakil Presiden mengalami perkembangan, sebelumnya Presiden dan
Wakil Presiden dianggap sebagai entitas yang berbeda dan Wakil Presiden tidak begitu
diperhatikan pengaturannya, hal ini juga yang kerap terjadi dibeberapa negara. Pemilihan
masa transisi negara, sistem tidak langsung atau perwakilan juga diterapkan oleh beberapa
negara seperti : Amerika Serikat, Ethiopia, India, Jerman, dan Pakistan. Hingga kemudian
Presiden dan Wakil Presiden dipilih melalui proses pemilihan umum secarang langsung
seperti yang diterapakan di Argentina, Brazil, Kolombia, Meksiko, Mesir, Perancis dan Rusia.
Sebelum dilaksanakan Pemilu Presiden dan Wakil Presiden secara langsung dilakukan survey
oleh konsorsium Lembaga pengumpul pendapat umum bekerja sama dengan sekretariat
MPR/DPR. Sejumlah mayoritas rakyat Indonesia menghendaki sistem Pemilu Presiden dan
Wakil Presiden secara langsung. Pengumpulan pendapat dengan melalui survey oleh
konsorsium dilakukan pada tanggal 7 sampai 29 Juli 2000. Jumlah responden 3000 berusia
lebih 18 tahun di 100 desa/kelurahan51. Menurut Saldi Isra terdapat beberapa alasan (raison
d’etre) yang mendorong diselenggarakannya pemilihan Presiden dan Wakil Presiden secara

1. Presiden yang terpilih melalui pemilihan langsung akan mendapat mandat dan
dukungan yang lebih riil rakyat sebagai wujud kontrak sosial antara pemilih dengan
tokoh yang dipilih. Kemauan orang-orang yang memilih (volonte generale) akan
dalam proses pemilihan dengan sistem perwakilan. Intrik politik akan dengan mudah
terjadi dalam sistem multipartai. Apalagi kalau pemilihan umum tidak menghasilkan
partai pemenang mayoritas, maka tawar-tawar politik menjadi sesuatu yang tidak
mungkin dihindarkan

tinggi negara lain termasuk kepada Presiden. Akibatnya, kelangsungan kedudukan
Terdapat beberapa model dalam pemilihan umum secara langsung yakni sebagai berikut54 :
1. Sistem pemilihan langsung Amerika Serikat (AS) atau Electoral College System. Pada
sistem ini rakyat tidak juga langsung memilih calon Presiden tetapi melalui
pengalokasian jumlah suara dewan pemilih (electoral college votes) pada setiap
propinsi (state). Jika seorang kandidat memenangkan sebuah state maka ia akan
mendapat semua jumlah electoral college (the winner takes all) pada daerah
bersangkutan.
Presiden atau FPTP atau first-past the post. Seorang kandidat dapat menjadi Presiden
meskipun hanya meraih kurang dari separuh suara pemilih. Sistem ini membuka
memenangkan pemilihan kurang dari 50% lebih terbuka. Jika ini terjadi maka
presiden terpilih akan mendapatkan legitimasi yang rendah karena tidak mampu

4. Sistem Nigeria. Di Nigeria, seorang kandidat Presiden dinyatakan sebagai pemenang
apabila kandidat tersebut dapat meraih sedikitnya 30% suara di sedikitnya 2/3 (dua
pertiga) dari 36 negara bagian di Nigeria (termasuk ibu kota Nigeria). Sistem ini
memenangkan pemilu tahun 1999 dengan sistem ini dan memperoleh 63% suara dari
keseluruhan pemilih.
Tahun 2004 menjadi tahun pertama bagi Presiden dan Wakil Presiden dipilih secara
langsung dipilih oleh rakyat Indonesia, pelaksanaan Pemilu bagi presiden dan wakil presiden
diatur dalam Undang-Undang Nomor 23 Tahun 2003 tentang Pemilihan Umum Presiden dan
Wakil Presiden. Pemilu Presiden dan Wakil Presiden dilaksanakan dengan sistem dua putaran
atau two round system, sistem dua putaran ini diterapkan dibeberapa negara seperti Argentina,
Brazil, Colombia, Prancis, India, Mesir, dan Rusia. Pemilu Indonesia pada tahun 2004
dengan peserta Pemilu dan hasil suara yang diperoleh dapat dilihat dalam tabel sebagai
berikut55 :

Kelima pasangan calon presiden dan wakil presiden peserta putaran pertama belum
ada yang memenuhi ketentuan yakni memperoleh suara lebih dari 50%, maka dilakukan
Pemilu putaran kedua dengan peserta dua pasang calon presiden dan wakil presiden yang
memperoleh suara terbanyak pada putaran pertama. Hasil dari putaran kedua adalah sebagai
berikut56 :
Pemilu tahun 2009 landasan hukum yang digunakan adalah Undang-Undang Nomor 42
Tahun 2008 tentang Pemilihan Umum Presiden dan Wakil Presiden. Pembaharuan ini
memunculkan persyaratan baru yakni berkenaan dengan Partai Politik pengusung calon
Presiden dan Wakil Presiden adalah yang memiliki sekurang-kurangnya 20% kursi legislatif
atau yang memperoleh sedikitnya 25% dari perolehan suara nasional dalam Pemilu DPR 57.
Pemilu Presiden dan Wakil Presiden dilaksanakan dengan sistem dua putaran atau two round
system dilaksanakan pada tanggal 8 Juli 2009 dan berlangsung satu putaran saja karena salah
satu pasangan calon sudah memenuhi perolehan suara lebih dari 50%. Daftar peserta Pemilu

Pada Pemilu 2014 untuk memilih Presiden dan Wakil Presiden masa bakti 2014-2019
landasan hukum yang digunakan adalah Undang-Undang Nomor 42 Tahun 2008 tentang
Pemilihan Umum Presiden dan Wakil Presiden. Pemilihan diselenggarakan dengan sistem
dua putaran atau two round system yang dilaksanakan pada 9 Juli 2014 dengan tidak adanya
putaran kedua karena calon telah memenuhi ketentuan suara yakni memperoleh suara lebih
dari 50% dari jumlah suara dengan sedikitnya 20% suara di setiap provinsi yang tersebar di
lebih dari 50% jumlah provinsi di Indonesia. Daftar Peserta Pemilu Presiden dan Wakil
Presiden pada tahun 2014 dengan hasil perolehan suara dapat disimak dalam tabel sebagai
berikut :

pembicaraan adalah berkenaan dengan syarat perolehan kursi bagi Partai yang mengusungkan
calon Presiden dan Wakil Presiden yakni dalam Pasal 5 ayat (4) Undang-Undang Nomor 23
Tahun 2003, “sekurang-kurangnya 15% (lima belas persen) dari jumlah kursi DPR atau 20%
(dua puluh persen) dari perolehan suara sah secara nasional dalam Pemilu anggota DPR”

Dengan cara demikian, maka keputusan untuk diterapkannya sistem pemilu serentak
mulai tahun 2019 dapat dijadikan momentum untuk penguatan sistem pemerintahan. Ini
harus dijadikan agenda utama pasca terbentuknya pemerintahan hasil pemilu 2014,
sehingga periode 2014-2019 benar dimanfaatkan untuk konsolidasi demokrasi yang lebih

ketatanegaraan tersebut, pelaksanaan Pilpres setelah Pemilu Anggota Lembaga
Perwakilan tidak memberi penguatan atas sistem pemerintahan yang dikehendaki oleh
konstitusi. Oleh karena itu, norma pelaksanaan Pilpres yang dilakukan setelah Pemilu
Anggota Lembaga Perwakilan telah nyata tidak sesuai dengan semangat yang

dikandung oleh UUD 1945 dan tidak sesuai dengan makna pemilihan umum yang
dimaksud oleh UUD 194563.
Pemilu anggota DPR, DPD dan DPDR dinilai sebagai sebuah desuetudo atau konvensi
dianggap tidak bertentangan dengan hukum64. Akhir dari Putusan Nomor 51-52-59/PUU-
VI/2008 adalah menyatakan bahwa Pemilu Presiden yang diselenggarakan setelah Pemilu
akan datang, Pemilu Presiden mesti dilaksanakan secara bersamaan dengan Pemilu Anggota
Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum dengan sistematika yang
terdiri dari terdiri atas 573 pasal, penjelasan, dan 4 lampiran yang merupakan gabungan dari
Undang-Undang Nomor 42 tahun 2008 tentang Pemilihan Umum Presiden dan Wakil

Dari persyaratan yang harus dipenuhi oleh Presiden dan Wakil Presiden diatas
memiliki kemiripan dengan beberapa negara, seperti yang disebutkan dalam beberapa
konstitusi negara Brazil, India, Kolombia, Mesir, Pakistan. Beberapa negara mengatur
ketentuan masa tinggal seperti Amerika Serikat yang mengatur masa tinggal selama 14 tahun
dan Rusia yang mengatur masa tinggal selama 10 Tahun, sedangkan Meksiko mewajibkan
calon Presiden dan Wakil Presiden untuk tinggal setidaknya selama satu tahun sebelum masa
pemilihan diselenggarakan. Untuk menjadi Presiden dan Wakil Presiden beberapa negara
seperti Amerika Serikat, India, Meksiko, dan Rusia memiliki ketentuan yang sama dengan

syarat Indonesia sebelum dilakukan perubahan yakni 35 Tahun, sedangkan untuk persyaratan
umur yang telah dirubah menjadi 40 tahun juga dianut oleh Jerman, Mesir, dan Pakistan.

Namun, penerapan presidential treshold dalam Pemilu Serentak menjadi ancaman
bagi partai politik yang baru dibentuk setelah Pemilu tahun 2014 dan memiliki calon yang
potensi untuk dapat ikut serta dalam pencalonan Presiden dan Wakil Presiden dimana jumlah
kursi dan suara mengacu pada pemilihan lima tahun sebelumnya yakni Pemilu Legislatif
tahun 2014, hal ini bertentangan dengan Pasal 6A ayat (2) UUD NRI Tahun 1945 yang
menjamin hak setiap partai politik peserta pemilu bisa mengajukan pasangan calon presiden
dan wakil presiden. Konsep presidential treshold dalam kasus ini rawan menjadi permainan
politik bagi partai besar karena sejatinya tidak ada bukti secara pasti bahwa penerapan

tinggi etika dan moralitas. Berkenaan dengan kemandirian penyelenggara, perlu ada
komitmen atau konsensus bagi calon anggota KPU untuk tidak terlibat menjadi
anggota partai politik minimal 5 tahun sejak berakhirnya masa kerja di KPU.
3. Pemilih yang rasional, cerdas dan bermoral. Kriteria pemilih semacam ini hanya bisa
terwujud manakala pendidikan politik (baik formal dan nonformal) dilakukan secara
intens dan sungguh-sungguh, baik oleh Pro kontra perihal besaran dan keberlakuan
lebih luas. Usulan semacam ini dilandasi oleh kenyataan dimana setelah
penyelenggaraan pemilihan umum (baik pemilu legislatif dan pilpres) ada beberapa
oknum mantan anggota KPU yang “hijrah” menjadi pengurus partai politik besar,
bahkan menduduki jabatan elit dalam kepengurusan partai tersebut. Hal ini tidak
“konsesi” atas “bantuan” mantan anggota KPU dengan partai politik dimaksud saat
bernegara. Pemahaman semacam ini akan memberi modal bagi mereka saat
kehendak/keinginannya, meski ada pengaruh atau tekanan apapun (materil dan non
materil).

4. Peranan pemerintah lebih diintensifkan terutama dalam menyiapkan database daftar
pemilih yang lengkap dan akurat. Peranan pemerintah juga menjadi urgent dan vital
bertanggung jawab.
5. Proses penjaringan bakal calon menjadi calon di lingkungan partai politik yang
membuka ruang cukup besar dan luas bagi setiap pihak yang berkepentingan. Partai
dilakukan secara demokratis dan terbuka”. Aspek demokratis harus tercermin dengan
melibatkan seluruh komponen partai mulai level terendah sampai level tertinggi,
partai politik sebagai pengusung. Gagasan ini sudah sering diutarakan dengan
pertimbangan bahwa selama ini (pilpres 2004 dan 2009), partai politik atau gabungan
partai politik belum sepenuhnya mampu menjaring dan menyaring calon presiden dan
wakil presiden yang berkualitas. Faktor konsensus politik lebih dominan ketimbang
rekam jejak (track record), kompetensi dan integritas. Hanya saja disadari bahwa
jalan keluarnya untuk terwujudnya gagasan tersebut diawali dari tingkat konstitusi,

A SIMPULAN
Konsepsi pemilihan untuk mengisi posisi jabatan politik merupakan penerapan dari
Commission of Jurist. Pemilihan Presiden dan Wakil Presiden dalam praktiknya dimayoritas
negara di dunia dilakukan dalam satu kesatuan, meski terdapat beberapa negara yang tidak
memiliki wakil presiden dalam tatanan jabatan politiknya. Pemilihan Presiden dan Wakil
Presiden dapat dilakukan secara langsung melibatkan rakyat atau melalui cara tidak langsung
melalui lembaga perwakilan. Pengaturan berkenaan dengan Pemilihan Presiden dan Wakil
Presiden dapat ditemui dalam konstisui dan pengaturan perundang-undang berkenaan dengan
Pemilihan Umum.
Di Indonesia terhitung sejak proklamasi kemerdekaan hingga saat ini setidaknya telah
menyelenggarakan kurang lebih 10 Pemilihan Umum untuk memilih Presiden dan Wakil
Presiden, DPR (Dewan Perwakilan Rakyat), DPRD (Dewan Perwakilan Rakyat Daerah), dan
DPD (Dewan Perwakilan Daerah) berdasarkan amanat konstitusi dan pengaturan lebih lanjut

tahapan. Tahap-tahap yang dilewati dalam proses pemilihan umum meliputi pendaftaran

pemilihan, peresmian atau pelantikan para calon terpilih. Penyelenggaraan Pemilihan Umum
dilakukan oleh sebuah komisi yang bertanggung dalam keseluruhan tahapan ini, komisi
tersebut yakni KPU (Komisi Pemilihan Umum) yang kemudian bersama dengan badan
pengawasan yakni BAWASLU (Badan Pengawasan Pemilihan Umum) dan DKPP (Dewan

diselenggarakan dari tahun 2004, 2009, hingga 2014 yakni Undang-Undang Nomor 23 Tahun
2003 sebagaimana telah dirubah dalam Undang-Undang Nomor 42 Tahun 2008 tentang
Pemilihan Umum Presiden dan Wakil Presiden. Menyongsong Pemilu Presiden 2019,
terdapat perubahan dimana mekanisme Pemilu yang pada mulanya terpisah baik dalam waktu
maupun mekanisme penyelenggaraan antara Pemilu bagi DPR (Dewan Perwakilan Rakyat),
DPRD (Dewan Perwakilan Rakyat Daerah), dan DPD (Dewan Perwakilan Daerah) dengan
Presiden dan Wakil Presiden. Kini mengalami pembaharuan dengan Pemilu Serentak.

Perbandingan konstitusi perlu dilakukan untuk membuka cakrawala pengetahuan.
Dengan melakukan perbandingan berbagai negara dalam bingkai konstitusi Negara dapat
mencari dan menemukan beberapa persamaan dan perbedaan ketentuan yang dapat berguna
untuk mengembangkan kehidupan negara yang lebih baik atau mungkin melakukan
bahwa dengan perbandingan adalah salah satu kunci pembelajaran hukum tata negara dalam
konteks umum.
Presiden dan Wakil Presiden sebagai pelaksana kekuasaan tertinggi dalam negara
pasangan Presiden dan Wakil Presiden dapat memberikan formulasi baru yang berguna dalam
membentuk pemerintahan dan kehidupan bernegara yang lebih baik. Sangat disayangkan
ketika literatur guna pengkajian terkhususkan perbandingan negara sedikit sulit dijumpai
negara sehingga tidak semua dapat memahami, padahal dengan melakukan perbandingan
dapat mempermudah pencapaian tujuan yang dipaparkan diatas. Maka diharapkan fokus
penelitian dengan metode perbandingan lebih menarik peminat dan lebih dipermudah dengan
