x Delay in the transfer of fund.

Two times fund was returned backi. On 25th August, 2010 Dr. Lenin
Raghuvanshi Executive Director, Peoples’ Vigilance Committee on
Human Rights PVCHR)/Jan Mitra Nyas went for the hunger strikeii.
The strike has finished after an hours when the grant of Rupees
1975334.43 was transferred in the account of Jan Mitra Nyas. iii

A. Recruitment & Selection of staff

The advertisement of vacancy for the post of Advisor (Communication and


advocacy), Model Block Co-ordiantor, Psycho –community worker, Data
Entry operator and media fellow were published in the various local Hindi
newspapers and the job portal for Indian NGOsiv. The candidates were short
listed through telephonic interview and finally selected through interview
processv. The appointments on other post were on the performance
appraisal and review.

B. WORKSHOPvii

B.1 ORIENTATION & SUPERVISION WORKSHOP

The workshop on orientation and supervision workshop commenced from


7th August – 9th August, 2010 in Hotel Kamesh Hut, Varanasi. The workshop
was formally inaugurated with the formal introduction and followed with the
schedule module.viii

The participants were divided in the group of three for Situational Analysis of
the model block.

Dr. Lenin explained the participants about the definition of torture as


mentioned in the United Nation Convention against Torture and also
explained the aim of torture.

Definition of TORTURE
x Any act by which severe pain or suffering, whether physical or mental,
is intentionally inflicted on a person for such purposes as obtaining
from him information or a confession, punishing him for an act he has
committed or is suspected of having committed.
x Torture is inflicted in the most vulnerable section of the population in
different countries all over the world.
x It is a demonstration of inhumanity of human beings to fellow human
beings.

AIMS OF TORTURE
x To obtain information: After arrest, a person is usually subjected to
torture get information about his/her activities (and others involved in
it).
x To force a confession: The torturer tortures the victim forcing
him/her to admit to the crime.
x To get a testimony incriminating others: Torture can force a victim
to sign a statement incriminating other people in a crime so that more
people can be arrested.
x To punish prisoners (of conscience) or detainees
x To intimidate or coerce individual(s), for any reason based on
discrimination of any kind
x To take revenge: The torturer can also torture victims as a personal
revenge.
x To destroy the personality: Systematic and psychological torture is
generally used to destroy the leadership/strong individuals
x To spread terror in the community: The regime/rebel group
tortures anyone who dares oppose them or sometimes in case of rebel
groups, when community people don’t want to join them.

Limitation:
x Impunity is still the biggest impediment to prevention of torture.
x Detailed knowledge and objective data on the prevalence of torture is
limited since torture mostly occurs behind closed doors and is often
denied.

x Alternative sources of information, in particular from torture victims,
when investigating torture cases and building effective prevention
strategies.
x With a long history of showing the human impact of torture, there is a
unique opportunity and need to intensify prevention of torture

well as social healing process –justice heals
x Fighting impunity by bringing perpetrators to justice helps prevent

INSIGHTS AND LESSONS LEARNED


x Community building approach highlights the need to respond to the
individual capacities and resilience; to vulnerabilities, risk factors,
problems and symptoms.
x Puts premium on building the resilience of individuals and
strengthening the capacity of the group to respond; be of help to
individual members not capable of functioning very well; whose well-
being are greatly affected by torture or long-held imprisonment.
x Community based structure of PVCHR enables the more resilient
prisoners to take an active role in supporting PVCHR’s psychosocial
work inside detention center.
x PVCHR builds upon building bridges of dialogues between authorities
and survivors -better appreciation of each one’s context and
perspectives towards coming up with plans mutually beneficial to both
parties

Dr. Maheshanad explained Community mobilization and peoples’


involvement. He explained to on the given below point for the formation for
community.

x Marking harmonious relationship (brotherhood & sisterhood)

He also explained in the community you will find three types of person,
follower, opponent and impartial. He suggested to

Next day workshop started with the recap of the first day. Dr. Lenin briefly
explained about PVCHR and RCT through power point and also include the
about the successful implementation of three pilot project.

Ms. Shabana gave the overview presentation on the project and followed
with the presentation Monitoring Tools & Indicators by Mr. Upendra Kumar.
After lunch Mr. Ajay Singh explained about the financial manual of the
organization and financial dispersement.

The participants were divided in the two groups to prepare the plan of action
according to the proposal provided to them in Hindi.

B.2 TOT WORKSHOP ON TESTIMONIAL THERAPY

The workshop on the training of trainer for model block followed with the
supervision and orientation workshop in Hotel Kamesh Hut, Varanasi from
10th August, 2010 – 20th August, 2010. The workshop designed according to
the schedule on testimonial therapy.ix

Week one: Theory & Role Play

In the theoretical part same power point was used by the trainer (Dr. Lenin
and Ms. Shabana and assisted by Mr. Upendra Kumar), which was used in
the previous workshop on Testimonial Therapy.

The first day started with the introduction of testimony, history of


testimonial method, Traumatic stress, Traumatic stress symptoms, Type of
stressor, and psychosocial community work.

The afternoon session started with mindfulness meditation and followed


with the communication exercise i.e. active listening

The problem encountered in the initial exercise of the active listening


is given below:

x Making trust with the survivor

x The survivor was of different gender

x Language: as interviewer was from different region

x Direct and immediate question to the survivor.

x The survivors need more penetration

x Feeling of being victim (fear)

x The sitting posture of the interviewer

The second day training started with the brief recap of the activities of first
day and followed with the theoretical part Assessment of mental health
problems: the questionnaire (M&E) of interventions.

Suggestion:

o To take the consent from the respondent for scaling in the


participation scale.

Problem encountered while filling the initial M&E in the participatory


discussion:

x The direct interviewing the question and answer was boring to the one
survivor.
x The interviewer was very quick.
x The survivor was self answering the question
x Interpretation of question.
x One participant misplaced the name of the survivor in place of the
survivor village.
x Problem identified in filling the participation scale

The third day started with the recapulation of session one; procedure for
testimony and guideline for writing good testimony. Mr. Anurag (Survivor) &
Mr. Upendra (Interviewer) and Satya Prakash Dev Pandey (Notetaker) did

role play for better expressing emotion and fear, which help participants in
taking the testimony.

The afternoon session starts with the mindfulness meditation facilitated by


the one of the participant. In the role play participants were divided into
group of three, one interviewer, one note taker and one Survivor. The
survivors were given 5 minutes to study or image the incidence full of pain
and trauma. Roles were exchanged and every participant played the role of
Interviewer, Note taker and Survivors.

The fourth day started with the recap of the third day by one of the
participant. The training proceeded with the session second i.e. closing of
the story. Mr. Upendra (Interviewer) read the story to the Mr. Anurag
(Survivor), he made few corrections and in second session survivor has more
trust on the therapists.

On fifth day honor ceremonyx for the survivor of police torture and bonded
labour was organized on 14th August, 2010 in Madarsa Usmania in front of
police chowki, Bazardiha (weaver’s colony) in Varanasi. The program started
at 11:30 with the recitation of Aayat (versus) of Holy book Quran by the
priest of the Madarsa and prayed for the salvation of the two martyr of police
firing. The participation of people from different religion belief provided
moral support to all the primary and secondary survivor of the police firing.

The testimony of the five survivors was read to the public and the survivors
were honored with the testimony and traditional white shawl. The name of
the survivors is Mr. Abdul Rahman, Mr.Wasim Akram, Mr.Anup Chaubey,
Mr. Ram Dayal and Mohd. Jahid Ansari

After hearing his testimony Abdul Rahman started crying and the eyes of the
people presented in the hall become wet and they became unvoiced. Few
people initiated to economically support for his operation.

Anup Kumar Chaubey, a native of Chaubeypur is a victim of Kacheri bomb


blast of 23 November, 2007. He worked as a munshi of the lawyer. He
received a compensation of 50,000 Rupees from the state government.
However he is yet to get any financial assistance from the centre.

The other persons including Mohammed Zahid Ansari alias Mangru of


Phulpur was victims of alleged police torture and Ram DayalMushar of Sarai
village was harassed by his master.

The basic objective behind organizing this honor ceremony during workshop
to was to instil confidence among the victims on rule of law with secular
value and motivates them to fight for justice. They raised their voice and
demanded justice.

The program ended by giving vote of thanks by the secretary of Madarsa

On 15th August, 2010 after celebrating Independence Day in the office all
participants went to see the Peelive live movie based on testimonial
approach to highlight the plight of farmers and insensitive role of media. The
motive behind watching this movie

B.3 SUPERVISION:

The supervision meeting of all staff of RCT project was held in PVCHR
office from 21st September, 2010 to 25th September, 2010 by Dr. Inger
Aggerxii

x Refresher training of staff in 'how to produce “a healing story” as


outcome of the TT:

The participants shared the 10 testimonies produced by themselves in


Hindi and it was translated in English for the understanding of
resource person Dr. Inger Agger and interns from Germany Mr.
Thomas. The problem identified is given below:-

x The testimony was not –focused not –focused


x The Background was too long
x Recent story of TOV was very short
x Lack of focus theme such as Caste discrimination (Behaviour with
Mushar) etc.
x Pain, agony & strength
x Not focused on main trauma
x No emotion and psychological mapping
x Few testimony were boring and confusing

The participants were taught to write good testimony considering the


given below points.

x Theme: Crime/Human Rights Violation

x Introduction

x Incidence: Pain & Agony & Strength of the survivor, effect of torture
on family & life. Torture – Physical + Emotional and effect

x Future

The participants themselves edited the testimony and now testimony was
well written.

The concept of peer support and editorial board emerged after the
discussion.

x Assist on refining curriculum for the ToT training on TT

The small changes were done in the schedule for the TOT training on
TT after discussion. Only the last day of the both week was refined.

x Rehabilitation case supervision

The three cases of Seema Gupta, Ram Lal, Bhikari Sahani were
discussed. The therapists informed the challenges, success and
explain to the other participants through role play. After lunch he
three failure cases of Ms. Indra Chaubey, Mr. Dasmi Vanwasi and
Ms. Shashi Kala were discussed and the therapists shared the
problem and challenges faced by them.

x Meet and discuss options for research study on TT

Meeting with Prof. Priyankar Upadhya, Professor & Director, Malviya


Centre for Peace Research, Banaras Hindu University for the options
for research on TT. He agreed to support the research scholar under
his guidance.

Visited to Department of Psychiatry, Banaras Hindu University and


met with the Prof. Sanjay Gupta for few minutes.

x Coaching the staffs on the TT - on the spot & Honor Ceremony

On 25th September, 2010 honor ceremony was organized in Raup


Ghasia Basti in Sonbhadra district. The program started with the
Karma dance and followed with the honor ceremony of five survivors
Ms. Ramwati, Ms. Kalawati, Mr. Ramawadh, Mr. Lakshman Prasad
and Mr. Gulab. The brief testimony was read out by the Human
Rights
Defender/Community
Worker and survivors
were honoured with the
traditional white shawl
and garland. The
program end with vote of
thanks and paying
homage to the martyr’s
stone.

solidarity and around
300 peoples from 10 villages participated

II. HONOR CEREMONYxiii

High profile Honor Ceremony

The high profile honor ceremony of survivor of torture and organized


violence on 54 birth anniversary of Veteran Journalist Sri Sushil Tripathi
on 18th July, 2010 in Hotel Kamesh Hut, Varanasi.

The program started by paying homage on the photo of pro – survivor


veteran Journalist by political leader Mr. Mohan Prakash, Dr. Shailendra
Kumar Tripathi, Parikshit and Priyanka, Mayor Mr. Kaushlendra Singh,
AcharyaSant. Vivek Das, Vijay Narayen, Dr. S.M Gangulay, Tarun
KantiBasu and many other renowned person of the city and local
participation of around 150 people who join the struggle against TOV.

The program proceeds giving brief introduction about him, as he raised the
issues related to the down trodden and victims of any category candidly.
Expressing their views, the participants recalled the contribution of the late
journalist in the field of media and he fought for the cause of poor and
victim through pen.

The testimony of the twelve survivors was read to the public and the
survivors were honored with the testimony and traditional white shawl. The
name of the survivors Ram Ji Gupta, Mrs. Neetu Gupta, Mr. Mahatim, Mr.
Vinod Gupta, Mr. Phool Chand, Mr. Harkhali, Mr. Jahid, Mr. Bikhari
Sahani, Mr. Lal Chandra Sonker, Mrs. Mamta Singh, Mr. Pankaj Kumar
Verma, Mr. Dilip Seth.

After hearing the emotional part of the testimony Bikhari Sahani started
crying and the eyes of the people presented in the hall become wet. "I feed
my family by pulling trolleys for 18 hours after working day and night. I took
a loan of Rs 24,000 to build a shelter for my family to save it from rains.
One fine day two officer came along with around 50 cops and bulldozer and
without any information razed my house. We could not save our belongings.
The incident left my wife in coma and later she died. Now I need justice after
all I am a human being. Please do something for my children otherwise they
will starve to death."

Ram Ji Gupta became nervous after hearing the soft feeling, on 12


February this year my entire family got to face police torture. Late in the
night I opened the door of my house on hearing a knock. A couple of
policemen barged into my house and started beating up female of my house
with boots and belts. Even they tried to molest my wife and my daughter in
law. Then they dragged us to police station and abused us. An ordinary man

is not safe in the city. I want CBI and the CB-CID to investigate the matter
and ensure justice for my family.

Mahatim felt proud after being honored and fearlessly narrated his self
suffering to the media. He reaffirmed his fight against mafia don Munna
Bajrangi up to the last battle for the conclusion of the case.

Overall impact of the honor ceremony is in form of survivor's commitment


against impunity.

On the occasion the five girls also Chanda, Jyoti, Puja, Vimla and Madhuri
-who fought against the child marriage, were awarded with Savitri Bai
Phule award. They Prevail and emanate from the traditional culture or male
supremacy. As most women in India suffer directly or indirectly by the
existing patriarchal structure of the society. Denying the child marriage the
parents of these girls faced odd situation in the society.

After the girls are being honored by this award and high profile media
publicity, the parents of these girls feel psychological courage and join the
movement against the child marriage as organized violence against women.
It is noted that it is in result 10 years effort in the area of Baghwanala with
the support of Child Right and You (CRY), Sir Dorabji Tata Trust (SDTT),
Parul Sharma, Raj Dulari Foundation, Helma Ritscher, DIG (Germany) and
InWent.

Dr. Lenin Raghuvanshi announced "Sushil Tripathi media fellowship" for


"Promoting a psycho -legal framework to reduce torture and organized
violence in India" of 1 lakhs 20 thousand Rupees each to three including
two from Hindi and one from English for two years for 10 story reporting.
The media fellowship will be declared on the birth anniversary of great writer
MunshiPrem Chandra (Shakespeare of Hindi literature) on 31st July, 2010.

The program was moderated by Sri Ashok Anand and ended with the vote of
thanks by Ms. Shruti Nagvanshi.
