DEED OF DONATION

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF DONATION made and entered by and between:

THE PROVINCE OF ILOILO, a Local Government Unit duly created and

existing under the laws of the Republic of the Philippines with office address at
Provincial Capitol Bldg., Bonifacio Drive, Iloilo City represented herein by its
Governor, ARTHUR D. DEFENSOR, SR., by virtue of Sangguniang
Panlalawigan Resolution No. 2017-804 entitled" Resolution Embodying
Appropriation Ordinance No. 2017-07, authorizing the general fund annual
budget for calendar year 2018 of the Province of Iloilo in the amount of Two
Billion Six Hundred Fifteen Million Seven Hundred One Thousand Five Hundred
Seventy Four Pesos ( P 2, 615, 701, 574. 00) hereinafter referred to as the
DONOR;

BARANGAY CABANTOHAN, LEMERY, ILOILO , a local government unit

of the Republic of the Philippines, with official address at Cabantohan
Barangay Hall, Brgy. Cabantohan, Lemery, Iloilo herein represented by
Punong Barangay Niel A. Salutin, hereinafter referred to as the DONEE:

WITNESSETH:
WHEREAS, Brgy. Cabantohan, Lemery, Iloilo is in need of monoblock
chairs for the barangay activities such as barangay assembly, community day
and other community related activities, programs and public functions;

WHEREAS, the DONOR is committed to provide assistance to its

constituents when funds so warrant in terms of goods and services;

WHEREAS, Section 16 of the Local Government Code provides "that,

Every local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or
incidental for its efficient and effective governance, and those which are
essential to the promotion of the general welfare. Within their respective
territorial jurisdictions, local government units shall ensure and support, among
other things, the preservation and enrichment of culture, promote health and
safety, enhance the right of the people to a balanced ecology, encourage and
support the development of appropriate and self-reliant scientific and
technological capabilities, improve public morals, enhance economic prosperity
and social justice, promote full employment among their residents, maintain
peace and order, and preserve the comfort and convenience of their inhabitants."

WHEREAS, Section 5 of Resolution No. 2017-804 provides " Section 5.

That the Governor is hereby authorized to transfer funds, sign and enter
Memorandum of Agreements, transfer without cost to national Government
Agencies, Provincial, City, Municipal and Barangay Leagues for the
implementation of infrastructure projects, subsidy to local government units
and donations pursuant to Section 381 of the Local Government Code of 1991.
This is in compliance with the requirements of the Commission on Audit under
COA Circular No. 2012-001 dated June 14, 2012, prescribing the Revised
Guidelines and Documentary Requirements for Common Transactions.
 NOW THEREFORE, for and in consideration of the commitment of the
DONOR to promote the general welfare of its constituents and by virtue of the
authority of the Sangguniang Panlalawigan, I, Arthur D. Defensor, Sr.,
Governor, Province of Iloilo, by these presents, do hereby GIVE AND
TRANSFER unto the DONEE, Fifty ( 50) pieces monoblock chairs for the use of
Barangay Cabantohan, Lemery, Iloilo for its various activities.

That the DONEE does hereby accept and receive this DONATION made in
its favor by the DONOR and does hereby express its gratitude for the kindness
and liberality of the DONOR.

IN WITNESS WHEREOF, the DONOR and DONEE have hereunto set

their hands this _____________________, 2018 in the City of Iloilo, Philippines.
