SANGGUNIAN RESOLUTION NO. 2015-096


A RESOLUTION REQUESTING THE DEPARTMENT OF ENVIRONMENT
AND NATURAL RESOURCES (DENR) OFFICE AND THE CITY
ENVIRONMENT AND NATURAL RESOURCES (CENRO) OFFICE TO
CONDUCT AN IMMEDIATE SURVEY TO THE DELINEATION OF THE
AGREED WATERSHED AREA IN BARANGAY BAYABAS, CABADBARAN
CITY.

WHEREAS, presented to the Sangguniang Panlungsod of Cabadbaran for


appropriate action is a Resolution No. 01-2015 from Bayabas Cultural Communities
Organization, Inc. “A Resolution strongly but respectfully expressing
opposition/disagreement with the Community Watershed in Barangay Bayabas as
Proposed by the City Environment and Natural Resources Office in representation of
LGU of the City of Cabadbaran, Province of Agusan del Norte”;

WHEREAS, this was referred to the Committee on Environment and Natural


Resources for evaluation, comments and report;

WHEREAS, the Committee convened for a hearing and it was attended by


Engr. Eva M. Milan, City ENRO; Mr. Archilles C. Ebron, DENR Representative,
Mr. Julieto M. Dady, Tribal Chieftain and the Barangay Council of Bayabas headed by
Barangay Captain Milagros Estioco;

WHEREAS, the Committee in its report dated June 2015 states that:

During the long and elaborated discussion, the Committee found


out that the issue at hand is a very, very complicated matter.

The facts that came out extends up to the boundary conflict


between Barangay Bayabas and Puting Bato, the mining exploration of
SEMCO and the conflicting opinion of the Cultural Community and the
Council of Barangay Bayabas.

It was observed that the main reason of the Cultural Community in


passing their Resolution is more on the economic side brought about by
the SEMCO Exploration, and the protection of the watershed is secondary
as the Community is willing to reduce the watershed area just to
maximize the exploration area of the SEMCO.

The Department of Environment and Natural Resources and the


City Environment and Natural Resources Office had widen the watershed
area as much as possible, with the end view of excluding a wide area
out of exploration activities.

On the other hand, the Council of Barangay Bayabas are divided


as to the matter of exploration and environment protection.

After a tedious and exhaustive dialogue, it was finally agreed that:

1. The community watershed project in Barangay Bayabas shall


allocate an area of about 50 hectares from the reservoir plus 40
meters buffer zone both sides for the boundaries to protect the
water resource.
2. The SEMCO Exploration will no longer be allowed to do the
exploration within the protected area.

Recommendations:

1. The Committee recommends for the favorable approval of


the proposed community watershed project in Barangay
Bayabas, this City.
2. The agreed 50 hectares and the 40 meters buffer zone shall
hereafter be identified both boundaries by the DENR and
CENRO through Engr. Eva M. Milan to ensure that the entire
watershed area will be protected and will no longer be
included in any exploration or activities, pursuant to Section 1
of Executive order No. 79 entitled: “Institutionalizing and
Implementing Reforms in the Philippine Mining Sector
providing Policies and Guidelines to Ensure Environmental
Protection and Responsible Mining in the Utilization of Mineral
Resources”.

3. The Barangay Council of Barangay Bayabas recommends to


both DENR Office and CENR Office, this City, to conduct
survey for the immediate delineation of the agreed areas.

NOW THEREFORE

BE IT RESOLVED, by the 3rd Sangguniang Panlungsod, in its 87th Regular


Session, to request the Department of Environment and Natural Resources (DENR)
and City Environment and Natural Resources (CENRO) to conduct an immediate
survey to the delineation of the agreed watershed area in Barangay Bayabas,
Cabadbaran City.

RESOLVED FURTHER, to provide copies of this Resolution to


Mr. Vince A. Estopito, OIC, CENRO Officer, Doña Rosario, Tubay, Agusan del Norte
and Engr. Eva M. Milan, City Environment and Natural Resources Officer-Designate,
this City for appropriate action.

RESOLVED FURTHERMORE, to provide copies of this Resolution to


Datu Julieto M. Dady, Tribal Chieftain, Bayabas Cabadbaran Cultural Communities
Organization, Inc.,; the Barangay Council of Bayabas headed by Barangay
Captain Milagros Estioco and the City Legal Officer, all of this City, for
information.
