EMPLOYMENT CONTRACT
Acacia Property Developers LTD whose headquarters is located in Kigali, Nyarugenge, KN 67
Kiyovu Cell, herein represented by the Managing Director, hereafter named “EMPLOYER“
concludes this open ended contract with:

Hereafter named “EMPLOYEE” and declaring him/herself free from any commitments. It is
established that the present contract is governed by the general statute for civil servants
employment in the Republic of Rwanda.

Article 1: Legal Basis:

The Contract is based on Law N° 13/2009 of 27/05/2009 regulating labor in Rwanda.


In order to achieve this, you will be on “Probation” for a period of 3/6 months during which you
will undergo training induction and will also be expected to integrate harmoniously with the
other team members. On successful completion of “Probation” Period, you will be confirmed, if
found suitable.

Article 2: DURATION

Article 3: POSITION/Nature of Job


You will be employed as a ------------ or in such other capacity of a like as may from time to time

Please note that you may on occasion be required to perform other tasks that are not part of your
normal duties, but may be necessary due to the operational requirements of the company.
Your key performance areas will be noted in your job description. The job description forms part
of this contract.

Article 4: SALARY/WAGE
You shall receive a net salary of frw 150,000 (One hundred and Fifty thousand Rwandan
Francs) net of statutory deductions (rssb/paye) paid to the following Bank Account as provided
by you

You hereby agree that the company may deduct from your salary at any time during your
employment or on its termination, any sums which you may owe to the company.

Article 5: WORKING HOURS


state the law in number of hours per week schedule by management , Over time hours must be
prior approved by the General Manager/Human Resources Manager and will be compensated in
rest hours.

Article 6: TERMINATION
Either party may terminate the employment contract for cause by giving to the other party prior
notice of thirty (30) calendar days in writing for the employee who has completed (1) one year of
employment and (15) fifteen calendar days below (1) one year except for employees on
probation.
This shall not be applicable if the employee is still on probation. Cause may include, but is not
limited to, unsatisfactory performance, the employer’s business reducing to a level where the
employee’s services cannot be sustained, incapacity of the employee, misconduct, frustration of
the employer’s business by any governmental/regulatory authority.

The employment of the employee may be terminated at any time without notice for gross
misconduct. No need as it will be contained in the employee handbook.
Gross misconduct includes but is not limited to the following actions: abandonment of work
without justifiable reasons, criminal conviction, fraud, taking of alcohol or any other drugs at the
company premises, breach of confidentiality, insubordination of superiors, theft, negligence of
the employee which could be detrimental to the management of hotel interest, participation in an
unlawful industrial action. No need as it will be contained in the employee handbook.
On termination of the contract for any reason, all company items in the possession of the
employee shall be handed over to the employer before any dues are released to the employee.
The employee undertakes to refund the employer for all losses of material, and equipment
entrusted into their personal care and established to have been lost whilst in the employee’s
possession. No need as it will be contained in the employee handbook.
After termination of employment contract, the employee will make sure that he/she is given all
entitlement rights such as work certificate and the related. No need as it will be contained in the
employee handbook.

Article 7: Internal Rules and regulations:

COMMENCEMENT AND PLACE OF WORK


Your employment shall commence on the day of 7th July 2018, and your duty station shall be
Kigali, Rwanda. Include in the duration and place
EMPLOYMENT OFFER – this should be a separate document
You successfully completed your probation period.

ANNUAL LEAVE/ HOLIDAYS


The employee is entitled to all applicable leave/holiday in accordance with the Rwanda labor
law.
All Leave must be cleared in the preceding year and can also be prorated monthly and taken
before completion of one calendar year.
Should you be required to work on a public holiday, you shall be compensated with one extra
day off.
Leave, pending off days and Public Holidays are not redeemable in cash.

SICK LEAVE
Sick leave shall be taken in advice of a qualified medical practitioner from a recognized medical
institution.
For the employee to benefit from the sick leave, he/she shall forward to employer a written
certificate signed by a recognized medical doctor and failure to that it will be considered as
abandonment of duty.
Where the sick leave goes beyond fifteen (15) days, the employer may require the worker to
bring him/her a certificate signed by three recognized medical doctors. The worker has the right
to his/her salaries for the three (3) first month. State as contained din the labor law..
A NON –PAID SICK LEAVE
The employer shall not pay back to the employee who has been absent for more than two (2)
days due to illness without handing in a certificate signed by a recognized medical doctor.
The worker who has been on a payable sick leave for three (3) months shall have the right to a
non-payable work suspension for three (3) months. I am not sure this is applicable and must be
initiated by the medical reports not a staff applying for medical leave
ABSENCE
Absence from duty except on sick leave, or annual leave is a breach of the terms of this
employment contract and may be considered as abandonment of duty.
MEDICAL EXAMINATION
The company shall be entitled at any time during your employment to require you, where
justified or required by legislation, to undergo a medical examination by a medical practitioner
of its choice for the purposes of an enquiry into your health/welfare and or/or into your capacity
to continue in employment with the company. The outcome of such examination/s shall however
not be utilized to unfairly discriminate against you. Is this legally accepted here in Rwanda.
Check for I know many countries signed the ratification to avoid discriminating persons with
terminal illnesses.
SEARCHES
You may be required to submit yourself to spot check searches of your person and your locker
possessions by a person designated by the company. Failure to abide by this will be seen as a
serious disciplinary offence, which may lead to your dismissal.
COMPANY RULES
You have been provided along with this agreement a Employee booklet which contains all rules
and regulations of the company. By signing and accepting this agreement you accept to abide by
all contained therein and breach of any the rules and regulations may because for disciplinary
action including termination of your contract agreement.

You shall also be just and faithful in all dealings and transactions in or about the company’s
business and you shall render a true account of all matters relating thereto and you shall inform
the company of all letters, accounts, writings, acts of negligence, dishonesty and/or other
misconduct affecting the company and things in anywise concerning the business of the
company within your knowledge.
At all times you shall well and faithfully serve the company and use your best endeavor to
promote its interests and protect its property from theft, loss, damage or neglect which may come
to your termination of employment.
CHANGES TO WAGES AND CONDITIONS OF EMPLOYMENT
Your terms and conditions of employment are further subject to, and may be varied from time to
time, after consultation with you, by a company review or legislation changes.
CONFIDENTIALITY
You shall not at any time divulge to any person any trade secrets or any other confidential
information concerning the company’s business or affairs nor that of any of its associates without
the company’s written consent. Failure to abide by this clause will be seen as a serious
disciplinary offence, which may lead to your dismissal.
COMPANY’S Equipment and Company Intellectual Rights
You hereby agree that the company has the right to access, monitor, read, filter, block, delete,
use and act upon any incoming or outgoing e-mail messages sent or received by you, attachments
to such e-mails, hyperlinks in such e-mail messages or attachments, web sites visited by you and
files or records saved automatically or by you on the company’s equipment.
You will be required to undertake responsibility for all apparatus, equipment and materials
provided to you for the carrying out of your duties.
All material (physical and intellectual) acquired or produced by yourself in the course of your
employment will remain the property of the company.
BREATHALYSER TESTS
In order to preserve the relationship of trust that exists between the company and its employees,
the company reserves the right to require you to undertake a breathalyzer test at any point in
time. Should you refuse to undergo either test, such refusal will be seen in a serious light as it
amounts to a refusal to carry out a reasonable instruction and it may therefore result in your
dismissal.
GENERAL
In addition, you are required to adhere to all operating and compliance policies that may be in
force from time to time that can change your duties and responsibilities.
You are expected to perform your duties in the best interests of the company and refrain from
any action which may in any manner harm the good name and reputation of the company or

which may place the company in an invidious or compromising position. As such you are
expected to display total honest and integrity in the performance of your duties and to exercise
good care and skill.
Please note that no private work, of any nature, may be undertaken by you. You are not
permitted to work either for yourself or for any other employer, or offer your services in a
consulting capacity without the express authorization from the company. Not necessary at the
moment.

ENTIRE AGREEMENT
This employment contract constitutes the entire agreement between the employee and employer
related to the subject hereof.
This contract supersedes all previous agreements.
Any other issues not covered under this agreement shall be regulated by the staff handbook
which is deemed to form an integral part of this agreement.
Having read and understood the above terms and conditions herein, I hereby affix my signature
indicating my acceptance to the terms specified therein and that I have read the Employee
handbook and accept all what is contained therein.
