Dear Council Members,
This letter is an impostant update related to the application for a special permit for Holyoke Gardens, The HFD, HPD,
BOH and building department have received many complaints related to 903 Dwight Street, owned by David Caputo
(Holyoke Gardens). These departments have followed up on the complaints and now have expressed deep concern
over this project that have very recently developed. The following is a summary of the findings;
As early as July complaints about the owner renting rooms at this property and growing “over 100 plants” were made
to various departments. The HFD, BOH, HPD and Building department tried to conduct inspections of the house but
were denied entry by Mr. Caputo.
‘On September 10" the BOH, HPD, Building Department, and HFD were allowed partial entry and conducted an
inspection of 903 Dwight Street. Upon inspection it was found that the single-family house was being used as a
boarding house by definition and the house had extensive modifications to conduct a commercial grow operation.
‘There was an inspection on the 11" and 12" in which extensive work on the property was found and over 75 plants
removed from the property by the HPD.
‘This information was not readily available to share with the ordinance committee giving the timing. Attached you
will find the reports and relative documents. I have not personally inspected the property but have volunteered on
behalf of the other departments to compile to share with the council members. It is my suggestion to send it back to
the ordinance committee for discussion on this matter,

NOTICE OF VIOLATIONS
In response to a complaint made to the department of Codes and Inspections on 7-9-2018, an inspection
was completed on 9-11-2018.
‘Acting under the authority of Section 3A of Chapter 143 of the Massachusetts General Laws and Chapter
1 of the Massachusetts State Building Code, 9” ed. (780 CMR), the Holyoke Building Commissioner has
caused an inspection to be conducted at the above referenced property. According to city records, this
property is owned by the above addressed person or persons. The inspection of said property revealed the
following violations of the State Building Code and/or City Ordinances:
11.1.1 Buildings or Structures Hereafter Altered. A building or structure, in whole or
in part, altered to change from one use group to another, to a different use within the same use
group, the maximum live load capacity, or the occupancy load capacity shall not be occupied or used
until the certificate has been issued certifying that the work has been completed in accordance with the
provisions of the approved permits and of the applicable codes for which a permit is required,
Additionally:
109.4 Work Commencing Before Building Permit Issued. Any person who commences any work on a
building or structure governed by this code before obtaining the necessary building permit shall be in
violation of this code and subject to penalties.
And:
Section 18-83 of the City of Holyoke Ordinances; Except in an emergency, as determined by the
building commissioner, where work for which a permit is required by this division is started or proceeded
with prior to obtaining said permit, the above fee shall be double, but the payment of such fee shall not
relieve a person, firm or corporation from fully complying with the requirements of this division in the
execution of the work or from any penalty prescribed herein,

At 2:23 pm it was found that a commercial marijuana growth facility wa: full operation in the
third-floor attic space of the residential single-family home. Extensive electrical and plumbing
alterations were made to the space to accommodate the operation without the required permits
from the Building Department. It was also found that more than 4 unrelated people were leasing
spaces within the single-family home which constitutes an additional illegal change of use of the
structure from a single-family home to a non-transient boarding house. These use changes require
permits from the Department of Codes and Inspections.
‘Violation of Massachusetts State Building Code
Pursuant to 780CMR Section 113 Appeals of tie Massachusetts State Building Code, if you are aggrieved by this decision
‘you have the right to appeal to the Board of Building Regulations and Standards within forty-five days after the service of
ihis notice.
113.1 General. Appeals of orders, decisions, determinations and failures to act made by any state or local agency or any
person or state or local agency charged with the administration or enforcement of the state building code or any of its rules
and regulations, except the specialized codes of M.G.L. ¢. 143, § 96, relative to the application and interpretation of 780
CMR shall be addressed by the Building Code Appeals Board in accordance with M.G.L. c. 143, § 100. An application to
file an appeal may be found at www.mass.gov.
Please contact this office within five (5) days of receipt of this letter and inform me as to how you plan to
correct these issues. Failure to do so will result in legal action. I look forward to your cooperation in this
matter. I may be reached between the hours of 8:30a.m. and 4:30p.m.

Notes: We received numerous anonymous complaints about this property stating that the owner is renting the 3rd floor and it
has no second way out. Also, that the owner, Dave Caputo, is renting by the bedroom and that he has over 100 marijuana
plants inside. After meeting with the BOH, BD, PD we decided to do an inspection, The Task Force conducted an inspection
but the owner was not home and we were not allowed entrance by the renters (who looked drugged or high. A phone call was
made for Mr. Caputo to contact us.
