AFFIDAVIT OF LOSS

I, JUDE THADDEUS D. SYBICO, married, of legal age, Filipino and with

address at Poblacion, Danao City, after having been duly sworn in accordance with
law, depose and state THAT:

1. I received on 16 July 2014 a Subpoena Duces Tecum issued upon authority of

the Honorable office of the Deputy Ombudsman for the Visayas Pelagio S.
Apostol dated 25, June 2014 although it was officially addressed to Atty. Mark
C. Tolentino (Cebu Provincial Administrator) requiring the latter “to SUBMIT
xxx, within ten (10) days from receipt hereof, original and/or clear and
certified copies of the following documents:

1. Memorandum Receipt for Equipment (MRE) of vehicle (Toyota

Hilux) with Plate No. SHT 398; and
2. Driver’s Trip Ticket dated July 22, 2013.

or “to issue a certification under oath if said document/s are not available
explaining clearly the reason/s thereof.”;

2. Albert addressed to the Cebu Provincial Administrator, I hold as judicious and

most becoming to likewise “explain the reasons” for the loss of the Driver’s Trip
Ticket as an earnest of my desire to cooperate in the investigation and resolution of the
extant issue given that it is my office that is the custodian of the said document;

3. As a result of the powerful earthquake that struck the Island of Cebu last October
15, 2015, the Legislative Building where I hold office was so shaken by the temblor
that our equipments, furnitures, computers, office appliances, files and documents, as
that of all the other Sangguniang Panlalawigan members, were placed in a state of
tumultuous disarray and destruction;

4. The structural integrity of the Legislative Building now in a perilous condition the
Provincial Government declared the transfer of all Sangguniang Panlalawigan office
to the main Executive Building;

5. In the face of emergency, danger and disorder coerced by the countless

aftershocks following the earthquake which saw the Legislative Building already
weakened by visible cracks in various parts of it, the exodus to the Executive Building
was done in haste, with chaos prevailing over order and turmoil more pronounced than
tranquility;

6. In the bedlam that reigned, many documents, including but not limited to official
communications sent and received, resolutions, letters of request, logbooks,
legislative binders, Daily Time Record, Trip Tickets, etc., were, by force of
unavoidable circumstances, abandoned, misplaced, lost, destroyed and discarded
when beyond saving;

7. The fullest measure of assiduous and diligent efforts were made to locate the
“Driver’s Trip Ticket of July 22, 2014” as specified in the said Subpoena but the
same proved fruitless and for naught;

8. I am executing this Affidavit to attest to the truth of the foregoing facts, to explain
the loss of the aforementioned Driver’s Trip Ticket and for whatever legal purpose it
may serve.
