AFFIDAVIT OF WITNESS

I, PROCOPIO S. ANDOY, of legal age, married, Filipino, a resident

of San Isidro St., Barangay Moog, Laguindingan, Misamis Oriental,
state under oath as follows:

PRELIMINARY STATEMENT

“The person examining me is Atty. Kratos G. Maribojoc, with

office address at GK Diamond Village, Laguindingan, Misamis
Oriental. The examination is being done at the same address. I am
answering his questions based on my personal knowledge of the facts
and that I am fully aware of the legal consequences I may face for
narrating false statements under oath.”

1. Q: Will you swear to tell the truth and nothing but the truth in
these proceedings?

A: Yes, I do.

2. Q: Are you aware that you may face criminal liability for false
testimony or perjury if you will not tell the truth?

A: I am, Attorney.

3. Q: Do you personally know the accused in this instant case

Mr. Norman Gaid?

A: Yes, he is my neighbor from the GK Diamond Village.

4. Q: What is your interest in this case, if any?

A: I am testifying on the defense for Mr. Norman Gaid, who

drove a jeepney (PUV) with plate no. KVG 771, and was
 involved in a vehicular accident that killed Michael Daayata,
a minor.

5. Q: Where were you exactly when the incident occurred?

A: I was his passenger, and I was seated in front, directly next

to him.

6. Q: What other particular instances can you recall?

A: I noticed that the driver (Mr. Gaid) was driving slowly and
carefully, because the jeepney he was driving just passed by
Laguindingan National High School, and all of a sudden the
jeepney experience a noticable wiggle, it is as if we drove
over a road hump.

7. Q: Why do you think the driver drove slowly?

A: Because it is already customary for vehicles and other

motorists in our community and other neighboring towns, to
come to a full stop whenever they see students crossing the
frontage of a school or drive in a slow manner whenever they
approach a school, even when there are no students who are
actually crossing the road.

8. Q: What else can you recall, if any?

A: I heard somebody shout from the outside, saying that a

certain boy was run over by the jeepney I was riding on. I did
not notice anyone else hailing for the jeepney I was riding on,
because it was already full of passengers and cargo.

9. Q: What happened, after this?

A: The driver and the other passengers immediately got out

of the jeepney.
 10. Q: Is there anything else you would like to add?

A: None, Attorney.
