WHEREAS, RA 10396 provides that all issues arising from labor and
employment shall be subject to mandatory conciliation-mediation;

WHEREAS, undergoing the said mandatory conciliation-mediation is a pre

condition to the filing of complaint for compulsory arbitration;

WHEREFORE, RESOLVED AS IT IS HEREBY RESOLVED, that while the

dispute is under mandatory conciliation-mediation, the prescriptive period for filing of
the complaint for compulsory arbitration shall be interrupted upon filing of the Request
for Assistance (RFA) under SENA. The prescriptive period shall resume upon receipt by
the Requesting Party of the referral issued by the SEADO.
