Use of Immobilisation Device ee] Clamps}
Hereunder are directives pertaining to the use of immobilisation device
which are to be read in conjunction with Administrative Order No. 24/2018
issued on 9% June 2018.
2, As you may be aware, Regulations 3 and 5 of the Road Traffic
(Immobilization of Vehicles) Regulations 1997 provide that no immobilisation
device fixed to a vehicle shall be removed from the vehicle except after payment
of a prescribed fee Rs 1,000, Some Police Officers are confused as to whether the
driver should besides the fee paid for declamping, also be booked for illegal
parking.
3. In view of the above, the advice of the Director of Public Prosecutions was
sought and it has been ruled out that such practice would constitute to double
jeopardy:
4. Henceforth, Police Officers fixing immobilisation devices to motor vehicles
would only require the drivers to pay to the nearest Police Station from the
place of the offence the prescribed fee of Rs 1000. They should not contravene
the drivers for illegal parking.
5. Divisional Commanders and Branch Officers concerned are to bring the
contents of this circular to the attention of all Officers working under their
orders for strict compliance. They are to ensure that proper records as spelt out
in the Administrative Order No. 24/2018 are maintained and regularly checked.
