Waiver of Liability and Assumption of Risk

WAIVER OF LIABILITY:
Member acknowledges that the use of Citadel Nutrition’s facilities, equipment, merchandise, services, and
programs involves an inherent risk of personal injury to member and member’s guest and invitees. Member
voluntarily agrees to assume all risks of personal injury to member, member’s family and unborn children,
guests or invitees and waives any and all claims or actions that member may have against Citadel Nutrition, any
of its parents, subsidiaries, or other affiliates and any of their respective officers, directors, employees, agents,
successors and assigns for any such personal injury (and no such person or entity shall be liable to member,
member’s family or unborn children, guests or invitees for any such personal injury), including, without
limitation:

(1) Injuries arising from use of any exercise equipment, machines, and or personal training services.
(2) Injuries arising from participation in supervised or unsupervised activities in Citadel Nutrition facilities.
(3) Injuries arising from Citadel Nutrition’s negligence, whether direct or indirect
(4) Injuries, disease, infection or medical disorders resulting from exercising at Citadel Nutrition facilities,
including heart attacks, strokes, heat stress, sprains, broken bones, and torn or damaged muscles, ligaments
or tendons
(5) Accidental injuries within any Citadel Nutrition facilities.

Member also waives all claims against Citadel Nutrition, any of its parents, subsidiaries or other affiliates and
any of their respective officers, directors, employees, agents, successors, and assigns for any claims member
may have under of the state’s consumer protection statutes. The provisions of this paragraph shall survive the
termination of this agreement and member’s membership.

ASSUMPTION OF RISK AND INDEMNIFICATION:

Member acknowledges that:
(1) Citadel Nutrition does not manufacture any of the fitness or other equipment at its facilities and
(2) Citadel Nutrition or any of its parents, subsidiaries or other affiliates or any of their respective officers,
directors, employees, agents, successors or assigns shall not be held liable for any such defective equipment
or products used or sold in Citadel Nutrition facilities including but not limited to vitamins, food products,
sports drinks, nutritional supplements or any other products sold at its facilities.

Member shall indemnify Citadel Nutrition, its parents, subsidiaries and other affiliates and each of their
respective officers, directors, employees, agents, successors and assigns (an “Indemnified Party”) and save and
hold each of them harmless against and pay on behalf of or reimburse any such indemnified party as and when
incurred for any losses which such indemnified party may suffer, sustain or become subject to, as a result of, in
connection with, relating or incidental to or by virtue of any claim that is the subject of the waiver set forth
above. The provisions of this paragraph shall survive the termination of this Agreement and Member’s
membership.

I hereby acknowledge, agree and understand that the use of Citadel Nutrition facilities, services, equipment or
premises, involves risks of injury to my person and property. By engaging in such use I assume full responsibility
for such risks. Therefore, on behalf of myself, my heirs, personal representatives or assigns, I do hereby release,
waive, hold harmless, and covenant not to sue Citadel Nutrition, Inc., its successor(s) or related entities,
directors, officers, employees, volunteers, independent contractors, and agents from any liability and all claims
arising from my use of Citadel Nutrition’s facilities, services, equipment or premises. This waiver of all claims
includes, but is not limited to, personal injury (including death) from accidents or illness, as well as any and all
claims resulting from damage to, loss of, or theft of property.

I understand that I am releasing Citadel Nutrition from all liability to me, my heirs, and our assigns, for any loss
or damage to me, and forever give up any claims therefore on account of injury to person or property whether
caused by the active or passive negligence of Citadel Nutrition.

Citadel Nutrition Training Center Rules

1. Use your personal access card and/or membership ID for admittance into the training center.
a. Access cards may not be shared.
b. Do not let unauthorized individuals into the gym. Guests may only be allowed with prior
authorization from Citadel Nutrition.
2. Individuals under the age of 18 are not permitted in the Training Center without prior authorization from
Citadel Nutrition.
3. Proper Hygiene Required. Shirts or tank tops must be worn at all times.
4. Please return weights and/or plates to their respective racks or storage when you complete your workout.
5. Clean machines and equipment after use as required.
6. No smoking or tobacco use in the training center.
7. Food is permitted only in designated areas and not in the general training area.
8. Chalk use is permitted and encouraged, but please refrain from making a mess.
9. Each competitive tier member is assigned and responsible for their own access control card
10. Competitive tier members are not permitted to share access control with anyone
11. Competitive tier members are not permitted to let non-members in the gym without prior authorization
from Citadel Nutrition
12. Gym hours are 6AM to 12AM
13. Members performing movements requiring spotters when lifting alone must do them with safety bars or
inside a power rack
14. Collars or pins must be used on all free weight movements
15. Olympic lifts cannot be done with metal plates and must be performed on platforms

Citadel Nutrition reserves the right to amend or alter these rules at any time in our sole discretion. All
amendments to these rules and regulations are effective immediately. In accordance with your membership, we
may revoke or suspend your membership if you fail to follow the rules and regulations or for any reason of
nuisance, disturbance, moral turpitude or fraud.
