Genuine temporary entrant criterion


I have considered your initial statement to the department however there are some concerns
that I would like you to address below:

● You have completed a certificate IV in Ageing Support and have enrolled in further
studies for 2 years by undertaking 2 certificate IV level courses until 2021. The purpose
of the student visa is to progress academically. It seems from your lack of academic
progression you are enrolled in similar certificate courses by prolonging your time in
Australia. Based on your PTE scores I also find that you have the language skills to
study courses at a higher level. Why are you studying 2 courses at the certificate IV
level instead of progressing to either a Diploma or an Advanced Diploma level?
● After completing these 2 courses in Disability and Community Services, your total time
stuyding in Australia will be over 4 and half years and it would appear you would have
only completed studies at the certificate IV level. Do you intend on studying beyond
January 2021? and when do you intend on returning to the Philippines to pursue a
career?
● Having relatives in Australia acts as an incentive for you to remain onshore on
temporary visas. What incentives do you have to return to your home country? Do you
have any job opportunities in your home country?
● What value does certificate IV courses from Australia have on employment opportunities
in your home country when you already possess a Bachelor of Nursing from the
Philippines?
● your reasons for choosing to study in Australia rather than in your home country or
usual country of residence
● the relevance of your course(s) of study to your academic and/or employment
background
● the relevance of the course(s) of study to your future career and/or educational plans.

Provide evidence of your economic circumstances in your home country.

This may include evidence of employment or business undertakings for at least the 12
months immediately before the lodgement of your visa application, evidence of an offer
of employment on your return home, income tax return reports or bank statements for the
previous 12 months.

Provide evidence of your ties to your home country or usual country of residence that
shows that you have significant incentives to return home at the end of your stay in Australia.

This may include evidence of financial, family or social ties.

Provide evidence of your current employment.

Evidence should include the address of your employer, period of employment and details
about the position held. Include the name and contact details of a person who can verify the
terms of your employment.

Relationship to the source of funds

You have provided a letter that indicates that your aunt and uncle are financially sponsoring
your studies and living costs in Australia. However you have not provided any evidence to
the department that shows how they are related to you. Based on your birth certificate it
appears that your father and your uncle share the same surname. Can you show evidence
that they are related to each other. This is normally demonstrated by providing a birth
certificate of your financial sponsor and your parent birth certificate that shows they are
related. Please ensure that the documents are scanned of high quality and easy to read.
Provide evidence of the relationship between yourself and the person who is providing you
with financial support.

Only certain people are acceptable in terms of providing you with financial support. Refer to
the Application Document Checklist available at www.homeaffairs.gov.au/trav/visa-1/500-

Providing documents
Do not send us original documents unless we ask you for them. If you send copies of your
documents, ensure that they are certified copies.

If you provide us with fraudulent documents or claims, this may result in processing delays
and possibly your application being refused.

Translating your documents


Any document in a language other than English must be accompanied by a certified English
translation:
● a translator in Australia must be accredited by the National Accreditation Authority for
Translators and Interpreters
● a translator outside Australia does not need to be accredited, but they must endorse
the translation with their full name, address, telephone number, and details of their
qualifications and experience in the language being translated.

You must provide a scan of the original and the translation.

Certified copies
For the purposes of this application any one of the following persons can certify in writing that
a document is a true copy of the original document.

In Australia:
● a Justice of the Peace; or
● a Commissioner for Declarations
● a person before whom a statutory declaration may be made under the Statutory
Declarations Act 1959 (for example a nurse, legal practitioner, medical practitioner,
pharmacist or dentist)
● a registered migration agent (whose registration is not suspended or subject to a
caution).

Outside Australia:
● a person who is the equivalent of a Justice of the Peace or Commissioner for
Declarations in that place (for example a public notary)
