11 TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA,
12 1976, BY ADDING SECTION 59-63-160 SO AS TO PROVIDE
13 A PENALTY FOR A PERSON WHO VIOLATES THE
14 PROVISIONS OF THE SAFE SCHOOLS CLIMATE ACT
15 REGARDING HARASSMENT, INTIMIDATION, OR
16 BULLYING.

18 Be it enacted by the General Assembly of the State of South
19 Carolina:

21 SECTION 1. Article 2, Chapter 63, Title 59 of the 1976 Code is
22 amended by adding:

24 “Section 59-63-160. In addition to other penalties as may be
25 provided by law pursuant to Article 7, Chapter 3, Title 16, a person
26 who violates the provisions of this article with respect to
27 harassment, intimidation, or bullying towards a student as defined
28 in Section 59-63-120 and prohibited by Section 59-63-130(A) is
29 guilty of a misdemeanor and, upon conviction, must be fined not
30 more than five hundred dollars or imprisoned for not more than
31 one year.”

33 SECTION 2. The repeal or amendment by this act of any law,
34 whether temporary or permanent or civil or criminal, does not
35 affect pending actions, rights, duties, or liabilities founded thereon,
36 or alter, discharge, release or extinguish any penalty, forfeiture, or
37 liability incurred under the repealed or amended law, unless the
38 repealed or amended provision shall so expressly provide. After
39 the effective date of this act, all laws repealed or amended by this
40 act must be taken and treated as remaining in full force and effect
41 for the purpose of sustaining any pending or vested right, civil
42 action, special proceeding, criminal prosecution, or appeal existing

1 as of the effective date of this act, and for the enforcement of
2 rights, duties, penalties, forfeitures, and liabilities as they stood
3 under the repealed or amended laws.

5 SECTION 3. This act takes effect upon approval by the Governor.
