A road haulage company, which is an established carrier of non-hazardous bulk liquids, has
been invited to tender for a contract to transport significant quantities of bulk flammable
materials in tank containers. Advise the haulier on:

i) The criteria under which a ‘dangerous goods safety adviser’ must be appointed under
the Transport of Dangerous Goods (Safety Advisers) Regulations 1999. (4)

 Employers who transport dangerous goods by road or rail are now obliged to appoint
vocationally qualified safety advisors whose qualification relates to both the type of
transport and the goods carried.
 The haulier transporting ‘dangerous goods’ is defined by the Carriage of Dangerous
Goods (Classification, Packaging and Labelling) Regulations 1996
 Where his main or secondary activity is transport of dangerous goods or where if
there is an occasional activity, the transport creates significant risk to health, safety or
the environment

ii) The main functions of the ‘dangerous good safety adviser’, giving examples of how
this key role should support other requirements that will be placed on the haulier in
the event that the tender is successful. (16)

 Advise on health, safety and environmental matters in connection with the transport
of dangerous goods
 Monitoring legal compliance in connection with the transport of dangerous goods
 Preparing an annual report to the employer
 Preparing a report on any accident occurring during the transport that has affected
the H&S of any person or has caused damage to the environment
 Monitoring procedures for the purchase of vehicles, checking the equipment, training
of employees, record-keeping, ensuring that employees have detailed operational
instructions and emergencies
