ANNUAL REPORT
2017
MESSAGE
Ordained and promulgated by the sovereign Filipino people,
the 1987 Constitution serves as the basic and paramount law to
which all other laws must conform. As can be gleaned from its Preamble,
the 1987 Constitution was established in order to build a just and humane
society and establish a government that embodies the ideals and aspirations of the
Filipino people. It was enacted in order to promote the common good, conserve
and develop the nation’s patrimony, and secure to the Filipino people and their
posterity the blessings of independence and democracy under the Rule of Law and
a regime of truth, justice, freedom, love, equality, and peace. Being the highest law
of the land, it is elementary that all persons, including the highest officials of the
land, accede to the 1987 Constitution. It cannot be gainsaid that constitutional
principles and doctrines must be respected at all times. They cannot be subjected
to the whims and caprices of the government and its officials who run it.
No less than the 1987 Constitution confers the power of judicial review on
the Judicial Branch of the government. Section 1, Article VIII of the 1987
Constitution provides that judicial power includes “the duty of the courts of
justice to settle actual controversies involving rights which are legally demandable
and enforceable, and to determine whether or not there has been a grave abuse
of discretion amounting to lack or excess of jurisdiction on the part of any
branch or instrumentality of the government.” Notably, the aforesaid provision
in the 1987 Constitution introduced the concept of the expanded certiorari
jurisdiction of the courts of justice, ensuring the potency and power of judicial
review to curb grave abuse of discretion by any branch or instrumentality of the
government. Under their expanded certiorari jurisdiction, courts of justice are able
to determine the limits of power of the agencies and offices of the government.

the only constitutional organ which can be called upon to determine the
