Section 4. Pro forma motion for reconsideration. – A pro forma motion for reconsideration shall
not have any legal effect.
A pro forma motion for reconsideration is one:
(a) when the movant fails to make reference to the documentary evidence on
record or the provisions of law alleger’ to be contrary to the conclusions of the
Student Court; and
(b) which does not satisfy the requirements of the Rules;
Section 5. Period to resolve the motion. – A motion for reconsideration shall be resolved within
five (5) days from the time it is submitted for resolution.
Section 6. Effect on Member of the Student Court who did not participate in the deliberations. –
A Member of the Student Court cannot participate in the deliberations on the motion for reconsideration
and vote thereon if s/he did not participate in the original case or complaint or have abstained in voting,
inhibited, or absent therefrom.
Rule 11
Applicability of the Rules
These Rules shall not apply in proceeding governed by other rules, such as, but not limited to,
election cases, college assemblies who adopt their own internal rules to settle disputes, and other cases not
herein provided for, except by way of analogy or in a suppletory character and whenever practicable and
convenient.
Rule 12
Effectiveness
These Rules shall take effect on February 29, 2009. It shall govern all cases brought after it takes
effect. All amendments to these Rules shall apply prospectively, and shall be made solely by the Student
Court en banc.
