ACCUSED, thru undersigned counsel, unto this Honorable Court most
respectfully avers that:

1. During the hearing of the Omnibus Motion and the Urgent

Motion last X 2017, the Honorable City Prosecutor manifested that
she does not object to the dismissal of the case against accused XX
provided a certified true copy or NSO copy of the death certificate
of herein accused be submitted to this Honorable Court.

2. The Honorable Court then advised herein counsel for the accused
to submit the said document and consequently the same is hereby
being submitted in compliance to the previous order.

WHEREFORE, premises considered, it is hereby respectfully prayed of

this Honorable Court to accept this compliance and dismiss this case insofar
as Accused XX is concerned, owing to this untimely death.
